    Our attorney has set a Saturday deadline for the submission of all forms so that the filing can be done in Jul 1st week - They have reiterated several times that the visa numbers can be unavailable in the middle of July and this cannot be reversed even though USCIS cannot legally override the DOS bulletin.

    The right way to reform immigration.

    An NRO Primary Document

    Editor's note: This letter was released this morning by John Fonte of the Hudson Institute.
    Prominent Conservatives and Civic Leaders Urge President Bush and Congress to Back Enforcement First on Immigration

    Leading conservatives and civic leaders have signed an �open letter� on immigration declaring that �border and interior enforcement must be funded, operational, implemented, and proven successful � and only then can we debate the status of current illegal immigrants, or the need for new guest worker programs.�


    The signers include William Bennett, Robert Bork, William F Buckley, Ward Connerly, Newt Gingrich, David Horowitz, David Keene, John Leo, Herbert London, Rich Lowry, Daniel Pipes, Phyllis Schlafly, and Thomas Sowell among others.

    Hudson Senior Fellow John Fonte, who organized the letter, said:


    �We want to commend the members of Congress who have supported enforcement first including 85% of all Congressional Republicans, 36 Democrats in the House and 4 in the Senate.�


    �We particularly want to thank Senator Jeff Sessions (R-AL) and House chairmen Jim Sensenbrenner (R-WI) and Peter King (R-NY) for their leadership role in putting America�s national interests in border and interior enforcement first.�

    As a matter of organizational policy, Hudson Institute does not take stances on pending legislation.

    �First Things First on Immigration: An Open Letter to President Bush, Senate Majority Leader Frist, and Speaker of the House, Hastert�

    Recently, columnist Thomas Sowell wrote: �It will take time to see how various new border control methods work out in practice and there is no reason to rush ahead to deal with people already illegally in this country before the facts are in on how well the borders have been secured.�

    We the undersigned agree with this statement. In 1986, Congress passed �comprehensive� immigration reform that included amnesty for around 3 million illegal immigrants, border enforcement, and interior enforcement (employer sanctions). Amnesty came, but enforcement was never seriously implemented either at the border or in the interior.

    Let us not make this mistake again. We favor what Newt Gingrich has described as �sequencing.� First border and interior enforcement must be funded, operational, implemented, and proven successful � and only then can we debate the status of current illegal immigrants, or the need for new guest worker programs. We are in the middle of a global war on terror. 2006 is not 1986. Today, we need proof that enforcement (both at the border and in the interior) is successful before anything else happens. As Ronald Reagan used to say �trust, but verify.�

    The majority of Republicans in the Senate opposed the recently passed Hagel-Martinez bill. Senator Vitter (R-LA) said that because border enforcement will not be in place, �this [bill] will in fact make the illegal immigration problem much bigger.� The No. 3 Republican in the Senate, Senator Rick Santorum (PA) said, �We need a border-security bill first.� Senator Vitter, Senator Santorum, the majority of Senate Republicans, and the majority of House Republicans are right � we need proven enforcement before we do anything else. Adopting cosmetic legislation to appear to be �doing something� about enforcement, but which actually makes the situation worse, is not statesmanship, it is demagogy.

    We thank the majority of the Senate Republicans (33 in all) and the seven Democrats who supported the Isakson amendment, which insists upon verifiable benchmarks for border security before considering other issues. Moreover, we say �Thank You� to Jim Sensenbrenner, Peter King, and the bi-partisan House majority including 36 Democrats, that passed HR 4437. We may quibble with a clause here and there, but you in the House and the majority of Senate Republicans are right to emphasize that the Congress and the President must deal with enforcement first and other issues later. Stand fast; the American people are overwhelmingly with you.

    With Infopass appointment you get to meet IO (may be level I, or Level II) face-to-face, SR is done via phone.

    I dont know if a pepper spray and a cell phone would help if a Cayote or a Mountain Lion stand in front of someone while walking/running alone..knock on wood...that is not unusaul in So.Cal. The best way to address security concerns is to walk in groups or walk in a slightly busier area.

    I have been swimming and strength training for quite some time now and have started kettle bells and Taek Won Do this year. I do see a lot of women working out. All I am saying is that these forums have a lower proportion of females.......pure statistics.
    And yes; there are a lot of females working out and the ones who do take up martial arts are more serious than the guys. However the most common excuse cited by the ones who hesitate to take up running/walking, is security. I am trying to get the ones who are not working out to get out; the ones who are; have a lot of tenacity.

    .............BTW, be nice to me. By the time you come to DC to run the race, I might have my brown belt :)

    I hope I dont get biometric appt as well this time and get the approval directly.
    Or else I would have to waste one half day for that.
    Hopefully your wifes EAD will also be approved shortly.Keep us posted.

    Mine is TSC and yes I got the biometric appointment last time. Also good thing is that this time they have given the start date of from the expiration date of the current EAD.
    However as I said im still waiting for my wife's EAD (efiled on the same day)

    I thnk no. As I-140 is only fo ryou. not fo rhte dependants.
    So as long as you are married and your spouse is in US before you file AOS you should be fine.Clarification: you should be married before approval of your I-485. If your spouse is in US you can file I-485 for her otherwise - consular processing if dates are current.

    Totoro: I really liked the way you alone initiated and handled the fight against Stimulate Package - ITIN issue. You can be a true leader and helpful in many way to this/any community. People like you can make difference in people's lives.

    There are so many issues we are facing as a community. Let's pick top 3 ( OR 5 )for you to discuss with them. If there is any room, you can discuss least imp. issues as well.

    Issue NO 1: Retrogression / Backlog for EB3/EB2
    How to solve it ?
    - Visa Recapture
    - Saving visa by not issuing visas to applicant who are not current as per "Processing Times' Currently, CIS is approving many I-485s with PDs having currant but are not currant as per ' Processing Times'. 'Processing Times' needs to be respected. This will save huge number of visa for retrogressed countries.
    - Buying Visa for dependants and not counting towards annual cap. ( Easy way to reduce backlog - more than 50% visa would be saved. Will solve problem in 1-2 years. No other action required.)
    - Removing per country limit.( Requires changes in law - tough task/long shot.)
    - Buy a house and get a GC idea ( its been widely discussed in media ...)
    - Any more suggestion ?

    Issue NO: 2 Allowing people to file I-485 /EAD/AP even their PD is not current. - MUST BE DONE.
    Let's help these guys who can't file I-485/EAD as their PDs are not current. These are the people who are likely to suffer most in case of a job loss/visa issue. Even, their LCA/ I-140s are approved, it will become useless if they get fired/companies run some in problems etc. which can happen to any one in current times. Personally, I say - this should be our priority - can be fixed easily. It would also attract them to join us. A dying soldier saves other first.

    Issue NO : 4

    Issue No - 5 Allowing work-permit for H4/dependants ( Not that important but will change lives for many)

    Issue No - 6 AC21 - Helps greatly to individuals in tough times in maintaining their status. Any further modifications for AC21 ?

    You mentioned Stimulus package and ITIN issue, as I remember people with spouses having ITIN didn't get any rebate...

    I have been looking at number and the IV forum and there are very handful number of cases with December 2005 that have been touched.

    I think we need to cheer up and be optimistic in addition to creating SR, senator route and infopass. I have a feeling that all the October, Nov and December cases might be in a single lump of files and we will get it in the next week or so.

    I am in the same boat. I wish you are true. Its so frustrating to see 2006 folks getting approved (I am happy for them that at least they are getting approved but it is unfair that we are still waiting) and we are still waiting. Ridiculous....

    I called up the number yesterday and luckily some lady picked up. She was not even willing to answer :((. When I asked about the status, she said it will take 20 days time. I dont know why they have mentioned it in website as 7 business days. I think indian consulate doesnt know the meaning of customer service. In this modern era, why cant they keep a site to track our status...

    let me take a guess - at the minimum - 2 years for your PD and 4-5 years for my PD.

    I am quite confused. My date is June 2002 first week .
    Not sure if it makes sense to Port to Eb2 , but big uknown is how long it would take PD to move up to June 2002.

    Finally, it is my turn to get the approval email. At 2.30 pm MST, I received the approval email, but still no emails for my two dependants. The waiting-game is not yet over:-)

    PD: 05/2004
    RD: 08/05/2007
    ND: 10/03/2007

    I wish good luck to everyone who have been waiting for your turns!

    I had an Infopass appointment this morning with a very helpful and informative IO, and he confirmed that my dependants' cases were also approved on 09/01. Looks like TSC email system doesn't work properly as there were no emails for my dependants. I belive that some of you folks may have already been approved with no status change and CPO emails. Good luck again for all you who are current and have been waiting for approvals.
