I know of a company which will keep $2 + 10% for payroll taxes. A lot better than the one above.
There is so much competetion in this space that people have reduced their margins to next to nothing.

The approval of h1 will not invalidate H4 visa. The usage of h1 visa invalidates H4 visa.
if you have h1 approved and don't join the company, then your h4 remains intact. Once you join a company on h1, you will fill out i-9 form, which informs the concerend authorities about your status change.

FYI They are not taking into consideration cases that have opted for Consular Processing after I 140 approval that may be pending at NVC due to visa dates.

Hello,
In all the stories of INS, USCIS, DHS that I've read here, the lack of visibility, customer service and accountability seem to be the common theme.
However, I was pleasantly surprized by a call from IO a few weeks back in local office asking me for extra documents (Current employment letter as the original one was from 2007, 2007 tax returns and 2007/08 W-2).
He told me that though he had sent a letter, the letter would take a few days to reach and hence he wanted to call me up. He also told me that as my original fingerprints are expiring on 26th Feb, I should send the response as soon as possible to enable him to process the application.
Though I still don't have any extra hope that the application will be processed soon, it was nice to see a change in USCIS approach.
Hope this was not an exception to rule and we see more such behavior from USCIS that helps in clearing us from this awkward limbo situation.

I am in the same boat. In my online status it showed exactly same msg. Then after couple of days it started showing the following msg:
Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS
Current Status: This case has been sent to our local office for processing.
On May 19, 2008, we transferred this case to our DES MOINES, IA location for additional processing. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, call customer service. We process cases in the order we receive them. You can use our processing dates to estimate when this case will be done. This case has been sent to our DES MOINES, IA location. Follow the link below to check processing dates. You can also receive automatic e-mail updates as we process your case. Not an amended H1. It is an H1B extension for 3 years after I140.
The question is if you have this approval in your hand (whose start date is after your current visa validity) and you return to the country within your visa validity, will the official have I-94 valid till the end of the new approval or till the date your current visa is valid?
According to "Last Action" Rule of USCIS, there is a possibility that your H1B extention approval becomes invalid because the POE gave validity till your visa end.
Seems all so screwed up. But red-tape rules are never white and black.

Just to add, this is the risk of not working for the company after getting the EAD. The employer can easily prove that the person had no intention of working for the company. AC21 cannot protect that person.

Hello All,
I have a valid H1 (I-797, I-94) till 2009, but my H1 Visa on my passport has expired in 2005. My wife has a valid H4 till 2009; similarly her H4 visa on her passport got expired, we haven�t traveled outside of US from then. Now she is planning to go to India next month because of some family urgency and she is planning to take an appointment for H4 visa stamping in Chennai consulate (India). My question is, is there going to be any problem for her stamping as my Visa on my passport has been expired even though I have a valid H1 I-797 till 2009?. Is there any rule which states primary applicant has to have valid visa on his/her passport for H4 stamping.
If any one of you had a similar situation please share your experiece, it will be very helpful.

(1) Employers will have ability to pay issues or just do not want to carry paperwork after you leave - cancelling 140 is beneficial for them - they win the goodwill of USCIS
(2) For USCIS - handling AC21 paperwork means assigning an IO and time and resources - without any fee associated - it is easier to send denial and get money through MTR so that the IO can be working on your case as "billable work" and not "free work"
(3) The intent of long duration standards set by USCIS is nto make immigration difficult and not easy, so when one changes job using AC21 - with no process in place - it is easy to mess up things rather than fixing them.
(4) In reality - in a perfect world - there is no need for AC21 regulations - this is just a provision for cases where there are long delays - so I doubt if this process will be officially handled through forms and fees and procedures - USCIS handles this only through memos and IOs have their own way.
Please participate in the AC21 campaign and lets make it a success. We have to stop seeing denials and start seeing atleast RFE or NOID

Thanks for sharing your experiences. Is LLC corp employer eligible to do H-1 transfer? I have an American citizen friend who has a LLC corp and work as an independent contractor. Can he file for my H-1 transfer and can I work for him?
His annual income is about 150 to 200K. I think he takes about 100K as salary and rest as company profit.
I have my 140 approved and 485 pending (>180 days).
Any potential risks with this approach?

I thought about that for a minute too. This guy has joined on Dec 06, don't know if he made any financial contribution, don't know if he acted upon any action items IV core requested us to do (hopefully he did)
