Sent letters to WH and IV. Besides, I printed 100 copies of the original template and kept them in an Indian grocery store, with the permission from the store owner, although it took a long time to explain our situation to the owner of the shop.

If true this would REALLY benefit a lot of spouses especially someone like our core member Shilpa.
I am just surprised that none of the Big law firms have reported it. I guess now the h4's will have to wait till Oct 2007 to get their H1Bs
Is this a new "law"? I thought USCIS cannot pass "laws" on its own. Or this simply an intepretation of an existing legal procedure ---- which I understand USCIS is allowed to do on its own?

Not going to happen - whole point of not giving h1's their Social Security is to use to fund USs' dwindling Social Security funds. H1 is supposed to fund SS for the Baby boomers here. There is no way in hell we will get it before 10 years on H1.

I think it all started in 2007. As you guys know there were mass applications filed in 2007 from everyone who were current including EB2/ROW/I/C and EB3 /ROW/I/C.
AFAIK, close to 1 million applications were filed during this period if you include 485s , EADs and APs and all by all the folks.
All was fine until this time and then came 2008 where some people who were still on H1 applied for EADs and APs as USCIS started to give EADs for 2 years.
Then in 2008 there was a new rule put in place stating that there need to be an Employer-Employee relationship for the people working on H1, this has created some kind of panic among employees and employers and people started to invoke EADs left and right thinking it was not safe to continue to be on H1.
And since then as the economy started to take toll, people were laid off and employers were not willing to transfer H1s as they were too many queries on H1 extensions and transfers. Everyone thought that it was never to be safe to be on H1 and started to invoke EADs either to change for better jobs and people looking for jobs also invoked EADs as it was easier to move..
Then came Oct 2009 and we saw that not many Labors are getting filed by EB2 ROW applicants and very few employers were filing Labors as the Unemployment was in 2 digits % wise and were not able to convince DOS on non availability of citizen/PRs workers to do same or similar jobs.
Also most of the Labors were audited and it took close to a year to clear all that backlog before people were eventually approved in EB2-ROW applicants, until we saw July visa bulletin which raised our hopes.Based on the spill over they were supposed to approve close more than 40k EB2 I/C applications in the last 3 months of the year.
But there was a twist in their understanding. As most of the people who got EADs in 2008 were ripe for renewals(this includes EB-2 ROW/I/C, EB-3 ROW/I/C).And hence applied in mass for their renewals. This caused a huge delay in approving the EAD renewals and you have already heard sad stories about it..
Out of all this, All I can say is that USCIS was working harder than ever during the past 3-4 months to approve so many cases and hence I assume there is a genuine workload to clear all those cases.
Based on the approval trends, I think they have already allocated visas to the applicants who were current and started to approve as soon as the case has been looked into unlike what they used to follow of requesting visas after final verification.
Remember USCIS cannot give an excuse of not utilizing all the visas for the current year and blame on FBI name checks and all , as they had 3 sweet years to adjudicate the applications. And I guess they were under tremendous pressure to approve the cases by Sept 2010 month end.
Just my Honest Opinion.

Divorce in India takes a minimum 1 year to adjudicate if you were married less than 1 year. Otherwise, it is up to the discretion of the judge. Courts in India require a 'cooling period', with 'counseling / mediation'. Latter is basically a a sham.
That said, as a trained mediator, and negotiator, I would say ... a win-win outcome is always better for all parties. What happens to be 'win-win' is of course subjective.
Good luck in whatever you do! Trust me, things always work out well in the end.
It is very complicated to get divorce in India, if your wife don't file with you. Divorces are valid in India when there is no fraud and agreed by both the parties.

The guy should keep his mouth shut. If the USCIS finds out about two wives, more likely he will be deported under 8 USC 1182(a)(10).
As for getting a visa for a girlfriend (unmarried couples), that's out of the question as well. You have to provide a marriage certificate.

You gave me EAD, you gave me AP, you gave me receipts......why did you put me back at the mercy of NSC again? WHYYY? you knew they suck!!!
No FP yet for me or my wife. Been calling CIS.....feels like talking to a wall.
I guess we CSC transferees are DOOMED!!!
There shall be light at the end of the tunnel....or it could just be an incoming train :-)

All i can say for you is angoor khatte hain(grapes are sour for you) since you didnt get it.
This is what happens to jealous people.
Anyways, we have played by the rules.
What do you say about people getting GC by lottery.
Go and blame the govt for the rules not us.

Who is your employer?
When you GC is screwed you dont have a reason or purpose to keep quiet.
Post their name here, no one will ever join him.
File a lawsuit against them..I am sure you may have had emails about his promises or you paying money for GC.

my case is quite funny.
Applications went to texas service center originally.
From there they were transferred to California where they issued my EAD and AP but transferred the application back to TEXAS.
Oddly enough the only thing that i initially got in the mail was a transfer notice and the ead cards. I didn't get the receipt notice, the AP or a FP notice?????/
Any Idea whether anyone got ead without FP?

So jsb if congressman and Ombudsman doesnt work either is there anything which will work ? Can one actually go physically to the Service Center and ask to speak to the PRO (Public relations officer) or something ?
I have heard on this forum someone doing that, i.e. flying to Texas and asking to meet those who matter. Initially they did not entertain him, but eventually he succeeded. It costs nothing trying via the Ombudsman route, may be a bit if a hassle via the Congressman route. You should try both. Mention your situation, clearly bringing out the anomally. Ask if you are cleared on all fronts and your PD is current what is holding up. It might work....Best of luck.

But if you never do and then (after 485 has been pending for 180 days and provided 140 was not revoked) port to another, how do you show you ever had the intent to work for them? The same answer to the same Q10 in the same memo says: "Adjudicators should not presume absence of such intent and may take the I-140 and supporting documents themselves as prima facie evidence of such intent, but in appropriate cases additional evidence or investigation may be appropriate." So what will be your "additional evidence" of your intent if you never worked for the original petitioning employer? Looks like working for the original petitioner (not neccessarily for all the 180 days after 485 was filed but as long as they don't withdraw 140 before 180 days is up) is the main proof of your intent to work for them and their intent to hire you permanently after you have GC.

Employee authorizes the Company to deduct and withhold such payment in full from any compensation or other amounts otherwise owed or payable to Employee. Bottom line, once you sign in legal terms you are agreeing to the company terms & conditions...as I highlighted above, its pretty clear that if you leave before the set time frame you will be responsible for paying them back!!

I have noticed soft LUD's on all receipts including I140, H1B with all other receipts (485, EAD and AP) for my self and my spouse after using AC21 with H1B transfer.
Not received FP yet and did not call Service center for it.
Any clues? or any experienced the same.

In a way it�s nice that USCIS is tracking all applications together (H1B transfer, I140, I485 for a candidate). It atleast gives the confidence that they are tracking all together and may not get any RFE�s to give them copy of I140 or such.

Discover does not issue a credit card if you are not a PR or citizen..even though you have good credit history..
