    I filed mine in July and still dont have the AP renewal yet. Its coming close to 90 days. does anyone know what I can do after the 90 day period to get my AP? is there such a thing as an interim AP or an expedited process after 90 days from the notice date?

    My company lawyer addressed this part. The way it works is that they will work on your file only when your PD is current. So even if you apply now, they most likely wont work on it after July as your PD wont be current. Then when next time (say in Jan 2008) when your PD becomes current, they will pick up all the files for that month and start working on it. It might be that they will work on your file on Jan1st or Jan 31st. You can send your wife AOS the moment your PD becomes current. So you want to make sure that it reaches there before they approve your AOS. In case you are extremely unlucky, then they would start working on your file on 1st day of the month and finish it before end of that day, making it impossible for your wife's application to go through. Thats rare though. So if you can make sure that her app reaches on 1st day of the month in which PD is current, then they should most likely add her to your AOS and work on those together and make your life go forward....its a chance which you will be taking...But again life is a chance


    If you are single and are in a position not to get married b4 August 17th please think b4 applying for 485. It is of no use to you unless you want to switch jobs on EAD which is a HUGE RISK!!My guess is you are going to get married at some point of time(Barring guys who are already in their midlife crisis b4 marriage) and would apply for your wife's Adjustment of Status. Please apply 485 togather when the PD bcomes current again. Bear in mind that even if you apply now b4 marriage you have to maintain your H1-B status. It will only make it worse when one had already applied for I-485 coz you could only get 1 year extensions as opposed to 3 years when you have an approved I-140 and have not filed for 485. Don't get overzealous and apply now and regret later!!

    Can you please read Raj3078's response earlier in the thread and then your suggestion? As I understood them they are mutually exclusive things. One is apply for 485 and one is wait. I want to know one thing among other things.

    Is the ONLY benefit for applying 485 , for me, is to get EAD? I mean, if I don't apply for AOS now, I am assured that me and my spouse can file together when PD becomes current and they will approve ONLY if my PD is current. Isn't that right? That could be five years away, but, my spouse will be able to piggyback on my GC processing.

    Please remember that my fiancee is already on H1-B currently in India. I am from India too.

    Why not? Although I have applied for GC, I have no desire to take US citizenship, just to let you know. The majority does not mean the whole world and also does not mean everyone. There are Indian citizens that love India. Parents should be able to make decisions for their kids until they are 18. The kid can take US citizenship when he is 18 if parents have opted for Indian citizenship.
    well said my friend and i agree with you completely. although, i grappled with this issue when we had a baby.......the question where i got stumped was - if i got Indian Citizenship for my child (born in US), what would be the child's legal status here? and, also if we were traveling outside the country - how would the child reenter US?

    there is nothing on the N-400 form that asks how you became a resident and how long you stayed at the job.
    they will only ask you at the interview.
    some of us are working under very abusive circumstances and i'm sure the interviewer will understand your reasons for leaving earlier.
    i think the whole fraud/stay 6 months thing is just another ploy for some employers to keep using some of us for longer.

    Sure, your point is very much valid. What I understand from the Freakenomics experiment and EB3I behavior with respect to IV is that only a few folks have the perseverance to go all the way from D to B.

    Take 100 folks with C grade and give them the $50 offer for B. May be 80% will reach that goal. (I do not recall the actual results of the experiment).

    Take 100 folks with D grade and give them the $50 offer for B. Ideally we should see 80% of folks improving their grade to a C (one level up). But in real life only may be half as much (40%) will actually improve their grades to a C.

    Interesting experiment, and I can see that is how human beings respond sometimes.

    However we are guaranteed something in return when we TRY to do what we believe in, regardless of the odds as we see them: the satisfaction of DOING something about it, and a real shot at getting what we want.

    Easy to try it. Pick anything, literally anything about your life you want to change (from changing your job to losing weight to calling up your parents more frequently).

    Then WITHOUT THE FEAR OF FAILURE, do something about it. It will either work out, which will be terrific. Or it won't... maybe you don't success at that job interview after all, or you still put on weight. Even then, the satisfaction that comes from having TRIED is yours to keep! (Personally, I have found this to be more motivating for trying those things again, as opposed to the hopelessness that results from not trying and then seeing things not improve.) And of course, since failure is only one of two possibilities that there can be, you do succeed 50% of the times that you try honestly!

    In case of IV's efforts including the upcoming Advocacy Day, that is exactly how I feel.

    Hi,

    I am joining with Tek systems and they don't give as permanent position in offer letter rather just said contractor.. but I am full time with my current employer.

    Do you think its going to be any problem from changing Full time to Contractor?

    AC21 letter - wording is very important - the offer MUST be Permanant fulltime and the prospects for future employment must also be good - this is exactly what they request in a RFE or a NOID.

    If your letter says it is temporary position, you will have issues.

    I just want to make sure that IV not forgotten People that stuck in PBEC. So far as an active member and an active contributor for IV I have to say that I'm dissapointed as far as the way IV addressed PBEC Issued.
    Most of disscussion in IV forum seems like focusing on retrogression issue only.

    for people that have their case are among 350000 case pending in PBEC the retrogression has no effect at all unless their case clear out before the retrogression get solved.

    There are so many of us had been waiting for their labor get approved.
    5, 6, 7 year are a long wait.

    I noted that IV do have PBEC mentioned on the web fax, but please make sure that retrogression is not the main goal of IV.

    i am not sure why you think kavya wont excel in her life - she already has a great headstart with close to 40grand in winnings! i also dont know why you think she will end up working for a non-ivy league educated manager - & even then why its a bad thing to win a spelling bee..too many gaps or leaps in thoughts/logic?!

    If you come across and experience families who make their kids to go through the labor (hell) then and then only you would understand what he is trying to say. The other way of experiencing is to watch the pattern and construct of these spelling bees carefully and apply your own thinking process. Once you do this you would almost agree what logiclife was trying to throw to us.Spelling Bee competition, though make a child well aware about the roots of the words (latin, Greek roots) and provide enough exposure to the kid to understand the English language in its essence, it does not teach a kid how to think, how to become creative and innovative.

    Of course nobody can generalize that particular winninng kid will/may/won't/may not do good in life but more or less these are not the competitions through which parents with reasoning or thinking ability would let their children go. Yes there are some advantages but if you try to enlist then list of disadvantages would become lengthier..

    i just read on another forum, that about 70,000 visa's come up for the new fiscal year which starts 1st october, so it might take a couple of months to see any movement, but it will happen, as they have got to wait and see and get a better feel for how many filers there were for july/augest, as they havent processed them all yet, then we will see something happen. so lets wait and see what the Nov bullitin says, and if the rally had any kind of effect.

    I140 at TSC is August 26th. Several others and I have their July apps pending. Gosh, this concurrent crap without current PD is playing havoc in several of our lives..

    What a nightmare and sad state of affairs.

    I am in the same state as you are. This just sucks. First I got stuck in the rotten BEC for years and then, this happens. USCIS should be sued for playing with our future.

    If the USCIS cashes the checks and then returns the packets (total $1490 in my case), is there any legal recourse to get a refund from them? Since they are pretty much doing whatever they want, this thought just occurred to me.

    Scenario1:
    If you are on H1 in your 6th year with EAD (not used) then after 6th year will be applicant be on EAD or does he has to fill I-9 with employer


    Based on how HR departments handle i9 forms, in most companies, they may not know when your h1b or EAD is expiring - some HRs may have calender triggers and request for updated EADs or h1b extensions. Usually you need to show the EAD or H1b extension with updated i 94 and they take a copy and place it in your file so that if there is an audit, they will produce the documents.
    So it is your duty to inform your HR department that you wish to work using EAD after 6th year so that they update the i 9 form


    Scenario2:
    If you are on H1 in your at the end of 6th year with EAD (not used) then before the end of 6th year an applicant loosed job. then from that point will he be automatically be on EAD or does he has to do some thing to file till he gets a job (because once he find a job and he might apply for new h1 or join with EAD and he can file I-9)


    Basically, if your 485 is pending for more than 180 days and you lose job, then technically you can start using EAD and move on using AC21. You can even get a h1b transfer as your 140 is pending or approved.
    EAD is not a status and one does not fall int EAD status - if you lost job on h1b and satisfy AC21 criteria then you are in pending AOS state and use EAD to work.

    If you go for reneval you should have atleast one year validity in your I-94. Other wise they may not extend.
