Hello,
I am new to this site and had a question about the Nov. bulletin that maybe someone might be able to answer. I am EB3 ROW and I am still not able to submit my I-140 + I-485 concurrently by 5 days (my PD is July 5, 2002).
Do you expect the EB3 ROW dates to move forward at all in the Dec. bulletin?
I just need to know because my lawyer is pressuring me to submit my I-140 not concurrently, but I wondered if I just should wait for a month.

I have a question regarding an appeal I did a year ago for a rejected LC.
I have an approved LC and I-140 on an entry level position (EB3) with my company. after I got a promotion to a senior position that requires a masters degree but with a smilar job description but more senior and supervisory responsabilities with the same company. after promotion, I filed for a new LC (EB2) but it got rejected because DOL thinks it is the same position as the already approved LC. my company and I wrote a letter as an appeal on Sep 2006 within 30 days from rejection of LC to BALCA explaining that new position requires a masters degree and it is a senior position with more supervisory duties. as of today, almost a year later, we haven't heard anything regarding DOL (BALCA) decision on my appeal. is anybody in the same situation?? what should I do next?? also I read somewhere that DOl might revoke the already approved LC EB3 after I filed a second LC for EB2 with the same employer. can DOL revoke the first LC EB3 after I have an approved I-140?? please help. we can come up with many excuses that would easily fall under "emergent personal or bona fide business reasons" category.
I thought we must get ready with some reasons, when using AP to re-enter US. I have come up with some of my own that I may use:
1) Grandpa or Grandma is sick (most common reason, perhaps no body uses it as a reason anymore)(bona fide personal reason)
2) Land dispute (bona fide business reason)
3) Parents home need urgent repair (bona fide business reason)
4) Water shortage problem (bona fide business reason)

Recently I returned after a one month trip to India. At DC airport the CBP secondary inspection officer grilled us rough. First he called my wife and asked why did we leave US. She told that since my parents are old and not in good health we visited them. Then he started asking for documents proving it. And told us that without documents he won't let us enter. He went on to say that AP is only on humanitarian basis and unless CBP officer is satisfied with proof they cannot allow AP holder to enter. Finally after convincing him for another 30 min he let us in.
This was a really shocking experience. Are employment based GC's AP supposed to be treated like humanitarian AP? or was the CBP officer over reacting? Gurus please throw some light.
Thanks for sharing this experience, I feel sorry for you that you & your family had to go thru this. I want to check with you what finally conviced the officer to change his initial stand to let you in? This will help us to learn from your experience... Thanks

Sorry - Not everybody is(or wants to be like) Narayan Moorthy.
I bet Narayan Moorthy doesnt have time(if not willingness) to clean his toilet NOW. Maybe we wud have when he was younger(before Infosys) which is a different stroy altogether.
I always cleaned my room, in India and here. What's wrong with that? Infosys founder Narayan Murthy cleans his own toilet (as per his own admission to a newspaper). Does it make him an 'inferior' person to you? Don't you vacuum your room every weekend? Does that make you any lesser person? Ever heard of dignity of labor?

my pd is march 07. my agency told me they converted my I 140 into premium on june 18.But my case status still hasn changed from 'RECIEVED N PENDING". Is there any delay by the uscis usually in changing the status?

The fact that India and china priority dates are same for EB-2 suggests some spill over has already occured from ROW. We just do not know how much more spill over is possible.

Not sure if this helps, but this kind of thing happened to me 8 years back when my wife was pregnant. I asked my employer about insurance; he said I can continue coverage if I keep paying my premiums. Even if you have to pay a bit more than actual premium it should be better than not having at all. The other option is COBRA as some one already mentioned.
If that does not work out, call your current insurance company and ask them what are your options in the event you lose your job. You don't have to tell them that you're going to be laid off yet. As the wise say, we don't have to tell everything to the other person until it is really required to disclose. You might end up finding some facts that you probably are not aware of.
