    As I said before, I am never going to fly thru UK, even though I sill have a transit visa valid till Nov 2008. I can still feel the pain.

    Yeah I would say get a direct flight to India via Continental or whatever else is available ( AIR INDIA would not be anyone's preference I guess ) rather than going through these idiotic countries.

    I have direct responses from Murthy and Rajiv Khanna now . Plus 2 other american lawyers I know. The answers have variations. I'm going to do my own research and would encourage others to do the same before coming to a conclusion on this.

    The Federal government has a whole agency to protect people against such discrimination, and we are here speculating on nuances. If somebody denied you employment on EAD, just talk to them and see what they say. You don't need anything in writing.

    Agree. Most of us are not lawyers. Why add another job duty? The only legal document that I ever sign concerning employment is the I-9. It say discriminating EAD is illegal, and should be reported. Just go with that to the govt. As it is we are spending so much time to just maintain legal status. Let DOJ, DHS do their job, and not worry about every single detail.

    Tell me whats the point of IV fighting for multi-year EAD (maybe good news is around the corner) if employers won't take it.

    USCIS announced today that beginning on Friday, May 18, 2007, it will terminate Premium Processing Service for Form I-140 petitions that request labor certification substitution. USCIS anticipates a substantial increase in the number of petitioning employers that will file Form I-140 petitions requesting Premium Processing Service and seeking labor certification substitution prior to July 16, 2007. The volume of such petitions filed requesting Premium Process Service is expected to exceed USCIS� capacity to provide the Premium Process Service according to the program guidelines.     Thanks for the excellent analysis. One question, your analysis assumes category excess visas goto next category on a per country basis, is this correct ?

    Example, EB-1 china number goto EB-2 China ? I thought all EB-1 China numbers are added to the excess pool and then given to most retrogressed EB2 category ?

    Thanks for anyone who clarifies this.

    No matter how the data is sliced and diced, being EB3-I certainly means a loo...ong wait time ... :)

    When you started the process, you might have authorized your attoreny to represent you. I am not sure what the form you signed, but it should be similar to G28. Revoke this authrorization in writing with anothor from( Dunno what itis called)

    Otherwise, he could revoke your 140 or labor etc as he represents on your behalf. I read this somewhere.

    I doubt that the lawyer would purposely hurt a former client. Its not just unethical, its really malpractice. And its not like lawyers done get fired and they cant handle getting fired.

    However, please do make sure that you have all documents that you need to do your own 485 filing. If there are some documents like 140 approval or other stuff that only he has, then you will have to get it out of him, which he just might delay (a little) in case if he is an absolute nut job.

    For me, I dont care what the lawyer thinks of immigrants as long as the job is done in a TIMELY manner without mistakes. If he hates immigrants and votes for Jeff Sessions, I dont care about it. All I want is TIMELINESS and ERROR FREE job. After that, he can hate anyone he wants and stick pins in voodoo dolls of immigrants.

    Just a couple of comments about Heathrow. The mainland of Britain was plagued with the IRA bombing it periodically for decades which forced them to be diligent about security long before the USA knew what terrorism was. Being security conscious has become a way of life on that little island in the North Sea. Just try finding a garbage can on a railway station platform? There are none so the IRA could not plant bombs in them.

    Now about the staff at Heathrow. Surely anyone with eyes that work can see most of them are not British at all but immigrants of some variety or another. A true Brit is a very friendly individual. The invasion of their island during the past fifty years has changed the face of the entire community, not all for the better that is for certain.

    And finally, transit visas etc. If they are needed and that is the rule and you cannot find a different route then it is something that has be lived with. The US had them and still has them for certain nationalities, the UK is certainly not on its own. I have been living in the US for almost a decade now and have been stung by their immigration rules as all of the contributors to this forum probably have but we chose to come here so have to put up with the system.

    We all have choices so if you do not want to get transit visas just choose a route that precludes the need for one. Ten pages bad mouthing the UK is not helping anyone it is just antagonizing those of us who originated there.

    Just because the majority of immigration voice are Indian it is certainly not all and I think that gets missed on so many occasions. We are in the midst of the US immigration system together, or so I thought.

    Every country has its own rules, some will be in our favor some will not but if we choose to go there we have to live by them. It is entirely NOT appropriate to expect countries we visit to bow to us on any level!!!!!!!

    Here is the book that I am trying to read - 'Flight of the Creative Class' by Dr. Richard Florida. Here is the extract from this book -

    Chapter 4 – The Closing of America? - Page 112
    The rejection rate of H-1B visas (also called “high-skilled visas”), which allow professionals who are not U.S. citizens to work in the country for up to six years, increased from 9.5 to 17.8 percent between 2001 and 2003.

    By 2003, antiterrorism measures began to catch up not just with visa applications but also with requests for more permanent U.S. residence. Thanks to delays in the processing of green-card applications, only 705,827 people became legal permanent residents that year, down from 1.06 million in 2002. This decline is the steepest since 1953, when Joseph McCarthy stoked fears that Communists were invading the government and general population. Nearly half of those affected by the government slowdown in 2003 were foreign students, workers, and others already residing in the U.S. and hoping to become permanent residents.     I agree I too have never seen H1B only ad's anywhere even body shoppers never post this kind of ad which is blatant discrimination. I guess the best way to say H1B only is to post ultra low wages (something close to state minimum's) that way only H1B show interest. SO the best way to tackle it is by either raising state minimum wages to make it fair playing field for all or auditing present companies to check for misuse of H1B with folks on bench, non pay, false documentation etc.

    I am in the US for 7 years now, and frankly, I am yet to see a H1B ONLY job posting...
    Hmm... me thinks, I was hibernating in the h1b golden years :(

    can you please let everyone know when was your H1 approved? (that will help decide the pattern for passport delay due to PIMS..)

    My H1 extension and transfer to a new employer was approved around Feb 2007 and validity is between mar 2007 and feb 2010.

    So did you guys notice a pattern here ?

    To xyz2009:
    Congratulations on getting approved. My wife traveleved to India in a similar situation. She left 2 days after the GC approval email. She returned yesterday on her H1B. I think the systems at the POE take time to reflect the new status. She was planning to inform the IO in case he/she asks about the GC approval - but they did not ask anything. Before she left, she spoke to a second level IO who said it was OK to travel and just to explain to the IO at POE in case it comes up. D-155 stamp is not done at POE.
    Your wife can either use AP or H4.

    to be precise, since your wife used H1B, officer may have just verified H1B(same with H4 ).

    But if you use AP, they will send you to a different room, where they seem to be able access much more information. There they will see your entire information (like when 485 applied etc)..so at that point, officer will give you a welcome message and stamp the passport most likely.

    So, I guess it all boils down to what is the legal status of somebody who has 485 pending, EAD, and AP? At that point you are no longer on H-1B. Is this status covered in the definition of a "U.S. worker"? ... Anybody?

    As per Ron Gotcher, "Anyone with I-140 portability and an EAD is a "US worker" as that term is defined by the Department of Labor.".

    US is made by immigrants and the immigrants should feel great about this country since this country gave us opportunity. Look at the things that is happening to us since last few months.

    1. CIR bill introduce with lots of provision for Legal immigrants such as reduction of visa numbers to 90k, some people need to apply under new points system, and higher fees for renewing H1b visa. (Supporting US government)

    2. Amendments introduce for legal immigrants coming to US on H1B visa or who are on H1B visa. No renewal of your H1B visa since AC21 was removed from the original bill. (Immigrants can go back to thier home country quickly).

    3. VB came out with all the dates current. Majority of the people spent approx. $4000-$5000, and time so that they are their family can have better life. On July 2 2007 VB dates will show 'U'. (Supporting US economy)

    Chairwoman Zoe Lofgren one tough letter bring us to this point Or You may be correct but I will prefer USCIS say standard text to congress rather pretending nothing wrong happening. In this process, I get a case# and person to follow. She said if you are not able to get RN in 30 days contact me. She will make efforts so I get RN in 30 days(dreaming for RN, never thought, i will come to this point). Anyway, It's a process and better than lame excuses from USCIS. Atleast my 30 days counter started with painful wait. Last but not the least, even if didn't get any success with process, atleast I have satisfaction I tried and failed. :)

    What action do we expect on our letters/faxes to Congressmen, besides a routine reply USCIS is used to. This is not the first time that somebody is bothering them in their leizurely work. If they have tons of filings all over their offices, how do you expect them to find your case out of them.

    USCIS continue to say that they have loads and loads of filings yet to be entered.

    Bush deems guest workers key for economy

    President Bush last night called for 'stronger immigration enforcement and border protection' even as he told Congress to move forward with his plan to create a guest-worker program to fill jobs that no Americans want.

    He also seemed to challenge those in his party who oppose a guest-worker program, saying the nation needs immigrants.

    'We hear claims that immigrants are somehow bad for the economy -- even though this economy could not function without them,' Mr. Bush said in his State of the Union address.

    The only way to keep the United States competitive is to create an immigration system that 'upholds our laws, reflects our values and serves the interests of our economy,' he said.

    'Our nation needs orderly and secure borders. To meet this goal, we must have stronger immigration enforcement and border protection,' Mr. Bush said. 'And we must have a rational, humane guest-worker program that rejects amnesty, allows temporary jobs for people who seek them legally and reduces smuggling and crime at the border.'

    The president pushed for his guest-worker plan in his past two State of the Union addresses as a way to help employers, but this year his focus on border security and immigration enforcement was much clearer.

    'There has been continual movement on his part because he recognizes the Congress and the American people aren't with him, and we're going to fight him,' said Rep. Tom Tancredo, Colorado Republican.

    He and other Republicans took issue with Mr. Bush for not differentiating between legal immigrants and illegal aliens when he said the economy could not work without immigrants.

    Rep. Lamar Smith, Texas Republican, said U.S. workers would be hurt by a guest-worker program.

    'Studies show that competition from cheap foreign labor depresses wages and takes jobs away from American citizens and legal immigrants alike,' Mr. Smith said.

    He also said Mr. Bush's plan is unenforceable, because those here illegally cannot be expected to return to their home countries voluntarily.

    In the official Democratic response to the State of the Union, Virginia Gov. Timothy M. Kaine said Mr. Bush does not have a rational immigration policy and that the result is a 'confusing patchwork' for states and localities to handle.

    He shied away from a specific call for a path to citizenship for illegal aliens, even though most party leaders in Washington have endorsed that.

    'We should welcome those who seek to lawfully join and contribute to our American family,' Mr. Kaine said. 'At the same time, we must ensure that our homeland-defense efforts begin with consistent federal action to protect our borders.'

    In the Spanish-language Democratic response, Los Angeles Mayor Antonio Villaraigosa specifically called for 'comprehensive immigration reform' and for giving 'hardworking people who play by the rules a greater opportunity to realize the American dream.'

    Sen. John Cornyn, Texas Republican, said Mr. Bush was right to call for action on the border and for his guest-worker plan.

    'The bill I've introduced strengthens our border enforcement and comprehensively reforms our immigration system,' Mr. Cornyn said. 'We need both stronger enforcement and reasonable reform of our immigration laws.'
