And for all of Logiclife's detractors, you should have heard him speak yesterday!:) He is simply 3 good!:) he could have energized you, motivated you and prompted you to do more for our cause, by the way he spoke and what he spoke.
We're still talking about it at home and how good both of us felt to be a part of this movement. Can't wait to see more pix and videos!:)

When I applied last year I got it for 9 months and for 1 yr when I applied in 2009, eventhough my priority date is not current. I called them on 90th day after my application was filed and that has triggered something and I got my EAD in a week. I assume they have plenty of work load and in order to clear EAD applications they are just approving with out any emphasis on priority dates and with whatever duration they like.
This erratic EAD approval process causes financial loss to all EAD applicants effected.

If President Bush believes that EB reform is in the National interest of US then it will be done.
For example the nuclear deal with India was pushed hard by Bush and inspite of all opposition by Non-Proliferation lobby the Congress overwhelmingly approved it just because it was perceived to be in the US national interest. Even though it completely undermined US position vis-a-vis Iran and North Korea, President Bush successfully convinced Congress to not only change domestic laws but literally forced the entire Nuclear Supplier Group consisting of 15 nations to bypass all international rules and norms just to make an exception for India�s case. Is EB Green Card reform in US National Interest?

Yes. my I-140 is Approved and 180 days has passed. How much time will i have to transfer H1B without loosing H1B status? Thanks for your response.
For H1B: use your vacation time to be associated with your current employer for as long as possible, try pay without leave if possible. No hard and fast rule how much gap is allowed. In principle, there can be no gap but lawyers claim 10days, 2weeks is okay. USCIS asks for recent pay stubs to check for gaps.
You are in much better shape with >180 days in AOS. Can work in EAD if needed.

Each of us have a decent and true story. It has been a struggle here in US for all of us.
I spent a life's fortune and emigrated to Canada with wife and 2 grown up kids. In early 1999, a large multinational from Netherlands (think of TVs, bulbs and fans) lured me and others into coming to US on H1. They promised they will apply for permanent residency in 6 months. The company couldn't survive the consultancy business and folded operations by end 2000 and my application evaporated into the air.
Post 9/11, and at the height of tech and internet bubble, I was laid off by that company in their operations closing in late 2001. I also lost my Canadian permanent residency (because I stayed away from that country form more that 180 days). I was lucky enough to get a decent job in late 2001. This large global company is a gem of its own; they also promised they will apply GC in 3 months. Thus my PD is EB3 Nov 2001.
I am always for writing one's experiences so that others know how to avoid them, if they are smart enough. That's all I have got.

And I do not think we should be ashamed of the fact that this great country screwed us and made more than half a million highly educated and trained people (spouses included) chasing for a decade a mirage called GC and looking like idiots.

Recently Vermont center processing time for H-1B extensions moved to Oct-1-2007. As per new USCIS reporting method of processing times, what this means is, they have COMPLETED processing applications received as of Oct-1-2007. This means, people who have applied for extension after Oct-1st should be getting their approvals these days.
I want to find out which dates currently they are at based on your feedback of your application date and whether you received approval or not as of today.

Isn't it a relief? if the officer calls you for interview, checks your documents and says approved but no GC till PD current? I can live happily with it for couple of years atleast without thinking of GC. The feeling of getting GC in future 100% is almost equal to having GC today. You can change jobs on AC21 without fear and use EAD and AP full force and forget about renewing H1b's

I am also in same situation. Two 140s (eb2 and 3) both have same PD. Have beed trying for interfile from last one year. I do not know if my case is eb2 or still in eb3. I enquired from Congressman and she told me that my case is assigned to a IO on 6th Aug so its in eb2. She is not listening to anything else after telling me this information. I have infopass on 2nd Sep. lets see ...

of IVs decision about I485 filing. Couple of core members already
file 485 and still they support it. Even I filed my I485 2 years ago.
There are 2 things here.
1) Think about people who file their labors 3 or 4 years ago and got I140 approved or in the filing process. If a lay off or something happens they will lose everything. All these years wait, frustration everything... whereas if you have file I485 you have a chance to shift jobs. Their only chance is to file I485.
2) 485 filed people think they will be affected. Thats why they are opposing it. But the point is that since the whole thing is going based on priority date,
it doesn't matter much. With present situations if a person has a PD older than you, he/she will get GC before you for sure (90%). Even if his /hers LC is still pending.( Because PD will move very slow. For EB3 to advance an year it would take 2 years. By the time all the old LCs will be cleared.) I dont see anything to be concerned here. Because we all are fucked up so badly :) :) :) :). Take a deep breath and think about it. The only way out is to collect a ton of money and lobby very hard.
So I request you to work actively, induct more members, contribute
more money to our cause. We will win soon man!!!!!
I made a one time contribution myself but I have a feeling that IV is going away from the goal of increasing EB visas and just focusing on the 485 filing.Many people that have contributed earlier feel that by prioritizing the 485 filing over increase of EB visas, IV has gone away from atleast some of stakeholders .The stakeholders were promised initially that increase of EB visas would be a top priority or atleast on a even keel with any other objectives, but now we are in phased approach.I have talked to lot of people and the feeling is same.

If one gets a US Masters, the 3 year undergrad is not a problem if you go for EB2 based on Masters.

I vaguely remember a discussion several months ago on the forum about people that have gone back to their home countries after having waited for their green cards.
We have a media interview opportunity and need to find such examples. I remember an instance about a person going back to Bombay after he had immigration issues. He had set up his company there. Such people who could have helped US economy and growth will make a compelling story.
Pls. let me know urgently of any such cases and I will follow it up. This is required today and we have a short time window.
I know a fellow countryman of mine who left but did not go back home. He is now in the UK on the HSMP (Highly Skilled Migrant Program). What information do you need? I may have to contact him for his approval, so let me know.

You have to stick to Software Engineer field in order to take advantage of PD recapture. If you move to Business Development using MBA than its hard to justify same or similar. Find a new job which requires EB2 and show BS+5 to qualify.

OTOH PD recapture does NOT require you to be in the same/similar job.You can file a new LC for the bizdev position, and when filing I-140 request older PD is ported over. Then 'interfile' this new I-140 into the old one on your existing I-485.

I don't know much about Canada PR, but the 2nd option sounds good to me. Make sure your new employer is willing to give you a Joining Letter with the similar job responsibilities, job title, etc upon which your 485 is based.
