Good to hear that 01, 02 & 03 ppl r getting approved. Atleast they are following FIFO and the line is getting shorter. Not that I am not happy abut the 06 folks who got GC but it should realistic 'First In First Out'.
The only problem with this is as follows. You are either FIFO all the way or you are not. When you are FIFO by convenience, then the result is multi year old 485s, and volatile PD movements that make the stock market gyrations seem minuscule, which is clearly not the intent of the system. Where was FIFO this summer when they were shooting random approvals from the hip? How can you say FIFO for come and luck of the draw for others?
I am especially glad to see the older cases getting their due, but they have most certainly screwed some ie those with 2004/5 PDs, especially those at the NSC by their policy this summer.

One big missing piece in your analysis - Country quota.
As per your analysis, there are around 125K pending cases. If there is no spill over (that is the case this year and that will be the case for the coming years as per State dept.), then EB3-I or EB2-I gets only 2700 visas per year.
Now, please redo your math and you can easily see that the current retrogress might look like there is hardly any retrogression.
This is my thought process (also referred by Ron G):
July 2007 brought in approximately 500K 485 cases.
We do not know how many cases were pending as of June 2007.
Fiscal year 2007-2008 USCIS used over 140K EB VISA numbers (I think it was around 155K).
Fiscal year 2008-2009 USCIS will use atleast 140K EB VISA numbers
so, 500K - 300K = 200K.
Assuming USICS approval rate is 85%; 75K of 500K are denied.
200K - 75K = 125K EB cases pending from the July 2007 cases.
Additions: from all current categories - may be 25 K in 2 years?

They both told us how much they feel for us and how much they will support us! Either they lied or it's the Democratic agenda to block everything if the illegals are not included. Very disappointing.

I have a trading account with IB, which I opened about 3 years ago. But now they need all trading account holders to provide their PAN information. They can not sell or purchase without that. My account is also in a suspended state becaus eof that(Good that I could not sell them,,, they are all about 3 times now :) )
I've applied for PAN and asked IB to provide info on what I need to do to convert my regular account to an NRI account.
Thanks but were you able to trade in Indian shares using that account after you came to USA ? I heard it's illegal to trade using the normal demat account in you are NRI from USA.

What was really pathetic - dependents of L1 visa holders were allowed to work, whereas dependents of H1 visas - the H4s, were not!
All they're left to do - if they don't qualify or have any interest in a high-tech field - is to listen to frustrations of their H1-holder spouses about this whole immigration mess!

I totally agree with Arunmohan- We H4's are not considered basic human beings here, we are not allowed to work ,may of us experience difficulty in getting a drivers license, we cannot have an independent bank account- literally we are considered as without life. I do wish I came in here illegally, at least i see hope for illegals in these bills - what do H4 Visa holders have to wait for !!!

Hi everyone.
I was part of the San Jose rally .. where there were about 300 odd people.
My neighbors had been to the immigration rally in Washington(flew from San Jose) and they said that there were about 1000 people there.
I have been following the immigration issues for sometime .. and I'm not very convinced that such small numbers can make the difference.
I'm not being a pessimist .. appreciate all the efforts that IV core undertakes .. but am totally unconvinced of major immigration changes. Looking at something like CIR being struck down .. after being on television for long and being debated .. I think we should get real.

Spartan King Leonidas and 300 Spartans fought to the last man against Persian King Xerxes and his army of over one million soldiers. Aren't these stories that inspire us and generate admiration about those brave few.
Now, the 300 number at San Jose is incorrect. There were around 400 to 450 people there.
When flower campaign started it was just a few people. They never waited for a large number of people before starting. Others were inspired by their leadership. This effort became huge, even skeptics joined in, smitten by the contagious enthusiasm of rest of the members. Same with San Jose rally. We just had five days to do it, 450 people showed up, that is amazing.
These two small successful events were instrumental in change of July visa bulletin fiasco. This clearly demonstrates that your argument about small numbers can't make a difference is incorrect. We have a past precedent of successful outcome based on a small grassroot effort.
As Andrew Jackson said, "One man with courage makes a majority"
Lets be leaders rather than followers.
On the other hand if you still want larger numbers than join us, we need your help. We have a Nor. Cal yahoo group where you will meet a lot of motivated people. Your neighbor was part of a 35 or so people who flew from California.

As I see, most of you are missing the point. Instead of trying to understand, you showing the maturity of mind. The whole purpose of EB immigration is to meet the Demand(Job opportunities) vs the supply(immediately available candidates).
When there are a lot of opportunities exists for EB3 level(skilled profession) and less opportunities exists for EB1(Ph.D/Executive Director), USCIS should give more no. of Visas to EB3, then EB1.
A country cannot be built with only the kings, and not even a home can be built with only Ph.Ds(Nobody do the dishes).
Unfortunately, Americans will claim that there are lot of Americans who can build homes and therefore no immigrants are needed to do that. They are less willing to do PhD so there is a demand for immigrants.

Hello everyone,
Three people from CA team went to Livermore temple today. We have distributed approximately (650 + 250 = 900) today at livermore temple. At around 1.45 p.m. we were told to stop distributing the flyer since it is against the temple policy.
One of the individual had his whole family working on distributing the flyers. After he left, two people did the same thing and there was not a single person or the car in the Temple who had not IV flyers.
We have found following things:
1. Not too many people are aware of IV.
2. Not too many people care about the Retrogression problem because they do not know what retrogression is and how it would affect them.
3. No body knows about the comprehensive immigration refrom bill.
4. No body know how the bills are introduce in the senate and house.
It is very important to spread the word about the IV and tell them to support us by contributing money.
People wake up. It's show time.

It's a well documented point that face-to-face meetings have the best chance of influencing lawmaker decisions [based on survey of Congressmen offices]. Letters come next and E-mails with addresses come the last. E-mail by anonymous senders are ignored. Hence the insistence on more face-to-face meetings.
If you don't know it already (which I doubt), sending a large number of anonymous E-mails, and making a large number anonymous posts in any forum is considered SPAMMING. IV will never participate or encourage such SPAMMING activities which will harm it's reputation (and don't help the cause too!)
If you think President is too busy to read our letters, why do you assume Bernanke is having all the time in the world to read anonymous E-mails and letters? He should be super-busy monitoring the BAD economic situation.
Regarding, "EB2 (I) and world advancing" if the trend continues its a good news for many, and lesser wait times for others. However, keep in mind that the swing will reverse soon, and dates will move back once we reach the end of the year (oct). PDs will be swinging wildly back and forth , like a pendulum, from now on. But don't count on it helping you. It's like a lottery. You may get it, or miss it. Until visa numbers are increased ,a large number of us, unfortunately, will continue to be stuck in the backlog and will be motivated to participate (once we have missed it for 2-3 years, we definitely will be more appreciative and more active).
No need to make melodramatic statements like these "people who oppose an idea(and take extra effort to shoot it down) are much worse than those who do nothing ". Nobody here is stopping you or others from doing what you deem right. We are just "suggesting" that it's not a good idea. You are free to ignore our suggestions, and do whatever you like. We too have the "freedom of expression" to make suggestions. Don't we?

as of now (and in my knowledge) IV is only sending letters to the President - who is obviously a busy man and maybe the letters dont even reach him.
and hence maybe IV should start campaigns to send emails / letters to other important people (Ben, Paulson, Realtors association etc etc ) and hope that the word reaches important people.
there is bit of urgency too ..as EB2 (I) and world start to advance ..you will get less volunteers (who take the effort to write and email)... let alone people who will take a day off to meet congressmen.
maybe people can just send emails or post messages related to legal immigration on websites which have articles on housing, economy etc ..what is needed is leadership at top to direct people (rather than concentrating on one campaign only)

In which case, USCIS can revoke an approved I-140 without any notice on the basis of fraud, which would automatically lead to your I-485 denial. I-140 online status may or may not change in such cases. Your case being in extended review is raising some flags. Do you know anything about the kind of extended review that was going on. Your lawyer on file, as well as you should get a copy of the notice. Make sure no communication was sent to the lawyer from Company A. Sometimes USCIS does not update the lawyer information even though a new G-28 is submitted. You will have to just wait for the denial notice. We are planning to visit India in Nov 08 after three years. I would be using my AP to return after 4 weeks. My wife is planning to stay there for seven months and plans to return using AP. Based on what I see on this thread, seems like it would be very risky for my wife to use AP to re-enter after a seven month period.
I'm still working on H1B and my wife on H4 ( although she has an EAD, she doesnt work). We have H1B approval valid till March 09. My wife would be re-entering in June 09. I'm in the process of renewing my H1 and H4.
If my wife gets her H4 stamping then she can re-enter in June 09 using H4 visa. I plan to re-enter using AP in Nov 08.
I am also planning to consult my lawyer. Would this work out? Gurus, pls. help
No need to use AP to travel when you are in valid H1 status, and are continuing to work with the GC sponsoring employer. You can use the valid h1 stamp to reenter without any risk to the pending 485

it depends on the individual hospital... your downside is only your wife getting fired... which might not really happen unless your wife supplies 100 A grade nurses to the directly competing hospital across the street... if she does that, anyway she wont care for the job.... :-) all the best... let us know how it goes...

The people who wants to be a part of American Society should first definately be a very open minded towards all cultures and social trends.
Other thing to be Indian or representing Indian traditions is not a crime but certainly every time barking against anything Indian may certainly be a crime as it is a clear indication of closed door or prejudicial mind towards one particular country and culture. Americans do not mind if one shows that he is Indian now and want to become in American future. Although they prefer that AND that is why they label Jindal as Indian-American although he born in USA. If there are majority Indians on IV board, it is not a crime but it is obvious. Some of my chienese friends on IV board may start thread for wishing chienese festival, I bet most Indians on this board will welcome and same goes with Muslim friends on IV board. Starting and wishing EID MUBARAK thread (By the way that is also a Indian tradition..And I am proud of that too) is not a crime and by now if nobody started it does not mean other people may not welcome it. If you are a Muslim, start the thread for EID Mubarak, I will be the first to welcome that step. You want to be American,, right? Then first start learning open mind and start respecting the culture of majority IV memebers first. If you would not start that now how will you settle yourself in cultural pot of the world?
If you are an Indian citizen right now take control over your inferiority complex and get over it because if you do not respect your culture or your tradition what guaranty would be there for Americans that you would respect American traditions in future. Even Americans are not fool. And how dare you pretend that people form China and other countries just stop supporting IV as they just see few threads celebrating Indian culture? So stop this bullshit now otherwise I may have to request moderators to ban you.

The people who wants to be a part of American Society should first definately be a very open minded towards all cultures and social trends.
Other thing to be Indian or representing Indian traditions is not a crime but certainly every time barking against anything Indian may certainly be a crime as it is a clear indication of closed door or prejudicial mind towards one particular country and culture. Americans do not mind if one shows that he is Indian now and want to become in American future. Although they prefer that AND that is why they label Jindal as Indian-American although he born in USA. If there are majority Indians on IV board, it is not a crime but it is obvious. Some of my chienese friends on IV board may start thread for wishing chienese festival, I bet most Indians on this board will welcome and same goes with Muslim friends on IV board. Thanx for sharing ur experience. Could u pls lemme know the documents that u mailed along with the I-765 renewal form? As per the instructions form what we need to mail to the Service center is:
1. Filled I-765 form (latest)
2. Copy of existing EAD card(front and back)
3. Check for $ 340 (for ppl who filed for EAD b4 July 30 -2007) in favour of US Dept of homeland security
4. Copy of I-485 receipt
5. 2 Photos with specifications as mentioned in the instructions form
***If one is self-paper filing its not necessary to do FP***
Am I missing something? If so, pls let us know.
I'm about to file my EAD extension and will be filling up the form in a day or two. I'll email u if I have any questions on what to fill. But in the mean time, pls confirm if the required documentation is correct :).

You are absolutely correct, u did not miss anything.
- fill the complete i765 form, dont forget to sign
- copy of 485 receipt
- front and back of current EAD card
- 2 photos (make sure to write A# and name at the back using a pencil)
- check payable to US department of homeland security
- file it correctly to the right service center (dont worry if the address is different than what u filed last time)
- nothing else (since its a adjustment of status case, there is even NO need of i94)
- Just make sure A numbers are written properly everywhere.

You can use paypal now. The problem is fixed.
Even if you dont have paypal account, paypal site provides facility to receive funds using a credit/debit card without having to open a paypal account.
You can also mail the check to the address shown in "Why Contribute" and under "Contributions" menu.
