    Is there a system in place, for TSC ONLY, using which, an immigration attorney, who is an AILA member, can send an email, with LIN numbers (or A #, i am not sure which), to TSC, if the PD is current? Once this email is received, the system flags the case to be picked up by an IO?

    This system was put in place a couple of years ago, but I am not sure if it is still active, or if it is active, does TSC even bothers monitoring it.

    I had a friend who tried to register but the website wouldn't because he has yet to file his LC, can someone confirm this? otherwise I will personally help my friend if he is making any mistake.

    He is forwarding to his Chinese friends to spread the word..

    What your friend can do is enter the tentative month he thinks his LC is going to be filed. He can always update his user profile once the LC is actually filed. I would however request all members who are introducing others to request them to enter a valid email that they access frequently. IV is not in the business of selling emails or sending junk mail. But valid and regularly accessed emails are a vital tool in getting members involved when a significant push is needed.

    American Families united is an orgalization that is trying to bring legislative changes to family related issue including the Age out issue. This is their website.

    But that is only for USC who marry and for the spouse's dependent children not to protect all children aging out and yes I am speaking with Randell Emery, the site owner.

    Its all about money, to get our voices heard thats what we need to employ a lobbyist, unless we happen to know a congressman or his aides

    Have been speaking with Connie Mack's office who has a copy of my law suite also Adam Putman's office, seem interested.

    We all need to write to our congress people to raise awareness.

    Actually I saw an improvement for 03/20. 6 approvals for that day then it's back to no approvals.

    Looks like approvals has slowed down further.
    This is why at the end of the year there are unused visas. All due to inefficiencies of USCIS.
    We are doomed.

    I've heard one successful case who's CSPA age was 3 days over, but eventually his lawyer helped him got the visa. I'm hoping I can get some feedback or information on more similar cases. If anyone has ever heard about a similar situation (petition filed before Sep. 11, 2001, aged-out by CSPA, but benefited from Patriot Act 45-days extension), please let me know. Thanks!

    When filing 485, do you know what kind of job letter we need to ask our employer to sign?

    Does anyone know the content?

    My HR manager recently quit and I am scared to death if I may scare the new HR with the job letter to sign to file for 485.

    That was informative.
    The wild cards are still the LC substitutions and EB2 to EB3 conversions. Even if a lot of people had to go back to India, is there any estimate on how many of these LC approvals were later sold by the bodyshoppers? Depending on the extent of LC substitution frauds (from what I hear it was rampant) all the calculations and estimates could get completely thrown off. I agree that we should wait for another 2-3 months for the dust to settle. Even the USCIS/DOS should have a good idea of how many cases there are and that will help them control the flow better and that should reflect in the visa bulletins.

    Perfect linear logic. Infact if you think linearly this should have been the case.But, in my opinion you have missed 2 important events. First, when BECs were created, before moving cases to BECs, INS somehow took a stand of rapid labor approval for those who already cleared "State" process and were waiting in Regional. Many of cases were approved during those 3 to 4 months and most of them were of EB2 categories. Those who were stuck in "State" , most were transferred to BECs directly. Second thing happened was many EB2 people also changed jobs as economy started to improve from 2005 and many left for India. Now one can argue, that happened with EB3 as well. I tell you one thing. My file was Eb3 NON-RIR...Stuck in PBEC. I decided to convert into RIR. My final conversion package sent to PBEC, around second week of January 2007. At that moment there were almost 350000 cased were of NON-RIR and 70000 cases were of RIR. EB2 load was of around 30 % only of these total cases. See here the difference lies in volume. EB3 load is considerably high. One more thing to remember is Most of those EB2 filings were of 2002 or pre 2002. In year 2003, generally most filing were done in EB3 NON-RIR only as RIR denial ratio was high and that with particular EB2 category. And adding all this makes my assumption base that 80% of pre 2004 EB2 lot is already out of this black hole. Let's watch next bulletins. It will be clear within 2 to 3 months how USCIS is taking turns.

    Hi folks, good to see great moment in IV with regards to advocacy efforts. I still remember the day I attended the rally in DC conducted by IV. I cant forget the crowd. Amazing.

    Update on me - r2id in feb. Joined the new job. Enjoying every bit of it. Initial challenges as expected in settling down. But slowly things are moving. Got admission in school for kids, took an apt for rent etc. Just wanted to stop by and congratulate everyone in IV on the advocacy efforts.

    GO IV..ians..This is the year we got the world cup. This could be the year where we get through to the lawmakers and make them understand the agony of so many families waiting in limbo in the GC queue. All the best.



    Chaya, We are going back to India on personal choice. My manager here knows very clearly that I cannot take up promotions and the HR does not want to do eb3-->eb2 conversion. So, I took up this crap for a while, and decided to put an end to this misery once and for all. And fortunately the same company is offering me a job in India at a good designation with good compensation. Also, we were missing out (esp my kids) were missing out lot of things happening in India, which they want to be a part of. Original idea was to stay in US for 10 years and go, only difference is now, we did spend that 10 years but still dont have our GC. Another important thing that we considered was , it becomes more difficult to take this decision when we have GC in hand because, as much as it helps to stay in US, it avoids us from leaving US too, and to wait for citizenship is another 5 years from that point, which could all take easily 6 years to the minimum from today. Thats why we wanted to make it easy on us, and do this now.

    Looking back, would I re-do this GC process one more time - no, but am I happy to be a part of IV - you bet I am. Thats the bottom line.

    I honestly feel there is no good way to get traction on this issue with the American government. The common masses are against immigration reform and even more so than usual right now because of the recession.

    One possible solution is to really prove to the them that we have a choice. I don't know if there is a way to petition our companies to create offices in Canada. Say 1000 people at Microsoft in Seattle or Intel in Portland move to Vancouver. Canadians would love our income, sales and property taxes. And companies would truly like to save money on health benefits, while keeping employees happy and in the same timezone. Employees get green cards quickly. The only downside for the company is that employees are less tied down to their jobs.

    Does this make sense?

    WHich service center did you file to.
    I have efiled to TSC and also did you get the biormtric appointment last time.
    Getting EAD approval in 11 days is faaastt.I need to see how fast mine will be.

    Mine is TSC and yes I got the biometric appointment last time. Also good thing is that this time they have given the start date of from the expiration date of the current EAD.
    However as I said im still waiting for my wife's EAD (efiled on the same day)

    IV is non-profit organisation. If IV hires a H1B holder, it wont fall under the cap. ( Provided IV qualifies as non-profit for the sake of H1Bs )
