I don't see the difference between being laid off and leaving yourself. In case of being laid off, your employer has to show intent of employing you forever. If any document will surface, that he had plans to lay you off before applying for I-140 or without you invoking AC21 at moment of AOS, then you are in the same trouble.
These issues are raised not to start freaking out, but just to know them and not to do some silly things.

But the thing is how i am gonna prove that i am paying money every month $500 for my H1. In my Pay stub they are saying "CASH ADVANCE DEDUCTION" = $500
When you "joined" them what was your situation? Were you previously on H1? When did you learn the fact that employer is not supposed to ask for money from the employees? If you knew these facts before you joined, and you joined them because of your situational needs, you may be considered a party to the fraud yourself. So if you did know about these situations beforehand, it is in your best interests to stick around till the contracted period and then decide on your next course of action.
Your recourse to the law will be only when you are without guilt, from most of my understanding of how "desi blood suckers" work, they are not the only one taking advantage of you. In most, if not all, cases, people joining them do so because of their weak situation.

Thanks for all the inputs. I still have not received the letter ( probably because of winter strom - delay with traffic) .
Now if the Deniel is because of AC21 and 140 revoke , when we reply with MTR, should I sent copy of the AC21 letter we sent before or do we need to sent a fresh one ( employment verification letter ) ? The reason I ask this is when we originaly filed AC21 docs ( in Feb 2008) I was with Company2 . Now I am with company 3 ( just 2 months ). And good part of is company3 is well aware about the "same or similar " letter and is ready to issue the letter .

I am in CP and I am writing to them to allow CP filers who are already working here in the US to file for AOS (even if the PD is not current) anticipating a very long delay for EB3 I. That way we could get atleast the minimal benefits like EAD, AP.
If any CP filers from EB3 I wanna join me, more than welcome!

The PD current for EB1 in the month of Oct.
I have filed my I-140,I-485 on Oct10 2007 in the category of EB1.
But until now i did not receive any confirmation notice..
Can anyone say what should i do now or have to wait for some more weeks?

Give them some time.
It has only been 15 days since you applied. They can take upto 2 months to send you the 485 receipt notice due to the huge influx of 485 applications they received over the past 2 months.

IT and BPO outsourcing is also leading to Americanization of Indian youth and Indian youth are spending their high salaries on American products. In no time you will see American fast food chains, groceries, and many American MNCs cashing on a Americanized Indian crowd and neutralize ( and will eventually exceed the investments they make).
This is the beginning of Americanization. Most of you will not understand what I say because you are here in US for a long time and being first generation immigrants (on a limbo) keep up with your tradition. Americanization is like a slow bleed. IT and BPO is investment. Returns will come in form of MNCs and businesses and finally benefit American economy.
Just go back to India and look into the ITand BPO companies and lifestyles of people there. it will be 5 times higher than what we follow here as the Americanization is already induced.
Bottomline, do not underestimate America. They know what they do.
I share your thoughts. There are a multitude of sectors/issues that are mimicking the American style. With the advent of ICICI, any body can pretty much walk in and get a loan with a 30 yr EMI. Imagine the number of people losing jobs in India, both at Multinational and local companies providing services if the economy tanks here. What are people gonna do with home loans they signed up for 30 yrs or what ever? Fore closures on a grand scale?? Indian economy has been going up.. up and up due to software services and BPO sector. With out any manufacturing, infrastructure building up it would be very difficult for Indian economy to sustain growth or level out gracefully when hit hard. IMHO, Just being the back office of the world will not get India on par with US.

I wouldn�t care about the nay Sayers about the Spelling bee...Yes, its lot more than that. Its the foundation and words do have power. You are basically training your brain for more logical thinking. These people are just jealous and making mockery of it. I challenge them to achieve the same...:D
snathan, dig up the history of these winers and lets see what they have accomplished or contributed to this world. Being the first would indicate that person (according to your definition of power) would be extrememly powerful, right? Now ask them to pen an essay on any issue and lets compare that to another class topper who just exels in creative thinking. Or lets just give these two candidates a project to work on and lets see who comes up with better ideas or greater problem solving skills. I personally know a kid who did not make it to the final round but just fell short (this year) and honestly I can tell you that the only skill (yes, the only skill) she has is this one. She is not involved in music lessons, does not participate in science olympiad, advance math or anything of that sort. Now I have to admit that this is the only one candidate I know personally for this year. Let me be honest from the depth of my heart that there is no issue of jealousiness or envy here. This is just a frank opinion and as we have already seen, there are an equal number of people who dont think this is a competition that is to be given the importance it is being given.

I guess country quota is root of all our green card related griefs. everybody else can dream of getting a green card someday, but EB-3/EB-2 India & China should stop dreaming about Green cards...I am sure this can be prooved illegal.
Yes true. This is the only angle that is viable in theory. All that can be done is challenge that the per country quota violates the constitution. Then the judge can strike that clause off.

1) Why has not USINPAC endorsed IV all this while on their website? Does not USINPAC know any thing about IV?
2) While I understand the importance of fund raisers for politicians, why USINPAC has not involved US citizens of American origin to contribute to the cause? What about grass roots efforts?
3) I dont have the exact statistics, but I am positive that every one out of 2/3 Indians living in the US is plagued by this problem of GC. How come Orgs like USINPAC are not pushing this by all means?

I personally am neither defending the outrage of some members nor appreciating it, but most of the Indian American citizen community does not want to be in sync with the plight of Indians immigrating to US.There are various reasons. Most important one as I have seen, Many in the Indian American citizen / Indian Permanent Resident community run consulting companies and they would hate to see these guys slip away from their hands by getting GC's. Fcuk, its like the damn door closes right behind you. I am positive most of those shops will come down to earth if Indian citzens start getting their GC's. May be its time, the Indian American Citizens/ Indian PR's ask themselves, what they really want. Robinder has been a very highly regarded ananlyst and a commentator of indo-us relationship. We needs friends with him and not make enemies. It is a different thing that he is associated with USINPAC and we do not agree with their agenda, approach or the way they misrepresent themselves to be the representatives of Indo community in USA. We have about 2.5 million Indians in USA of which about more than half a million are stuck in this green card mess. Any organization that claims to be a representative of Indian community should have this Green Card reform as a very top priority in their agenda, but it was extremely disappointing for the people fighting for this cause when they approached some of these organizations who could provide just lip service and press releases from their chambers and project that they are on the top of the issue and working hard to get the work done. IV has filled this void for a true grass roots level organization with a huge membership base which is truely global,not just Indian and working in an extremely organzied fashion. I am sure that many of the the organizations envy the way we have built the membership base ( we are not a paid membership org) and have individuals roll up their sleeves, go to the fields across the country and work for this noble cause unlike others who are limited to doing press releases, photo opportunities and advertizing to promote them selves.

If you deny facts, however, the facts do not change because of your opinion. People once believed that the Earth is flat.
You cannot deny that the American nation was found by those who where seeking religious freedom. Also read biographies of G. Washington, A. Lincoln, J. Adams and other founding fathers. They were sincere believers. I cannot explain America's greatness by simple luck. The founding fathers started builidng from scratch about 300 hundred years ago, far behind Europe and Asia. Now the US is the richest country in the world, despite the fact that it's neither the biggest nor the most populous.
As for your questions, I cannot prove that God exist, just like you cannot prove that He does not. Either way, it's a belief. I chose to believe in God.

If you deny facts, however, the facts do not change because of your opinion. People once believed that the Earth is flat.
You cannot deny that the American nation was found by those who where seeking religious freedom. Also read biographies of G. Washington, A. Lincoln, J. Adams and other founding fathers. They were sincere believers. I cannot explain America's greatness by simple luck. The founding fathers started builidng from scratch about 300 hundred years ago, far behind Europe and Asia. Now the US is the richest country in the world, despite the fact that it's neither the biggest nor the most populous.
As for your questions, I cannot prove that God exist, just like you cannot prove that He does not. Either way, it's a belief. I chose to believe in God.
