feels like the last day of the annual exam at school. All the hard work for the whole year..going through a lot and finally writing exams..You just want to get over that "last day" of the academic year. ...But hey..we all went through it and went past that day....Our such day is around the corner and we can hardly wait ....

I agree there is lot of injustice to applicants stuck in pre perm system. But with elimination of LC substitution and a timeline of 45 days between LC and 140,
tons of pre perm applications after approved will go nuts becoz the candidates have already left the employers .
I am sure that dates will remain current in August also. I believe INS will give EAD and will let all wait for GC therefore needs to go to Parole. Once you are in AP, that means, you all are golden eggs laying ducks to INS everyyear.
One +ve plus for is , DESI companies are gone and we can change jobs but its premium price for lot of guys for years to pay .

I have a slightly complicated situation. All your suggestions are welcome.
I am on H1B with 485 filed. My wife is on H4, without 485 filed. My H1B and her H4 expires around end of March. She has an approved 797 (she will either need to apply COS or go out and enter on H1B visa) and her employer will begin her H1B proceedings hopefully before end of January.
I am thinking of applying for my H1 extension next week, without applying for her H4 extension at this time. If, in the next few weeks her H1B COS is not filed, I am planning to then file her H4 renewal.
Do you see any problems with this approach? Do you have a better idea?

You can just take the 5-10 lines from the report which shows wasted visa numbers from the past years and send it to all lawmakers from all states asking for visa number recapture legislation
I think its just one small paragraph the lawmakers have to insert - They can attach it to any major upcoming bill - This does not create additional numbers or change the existing laws in a big way.

Can i file it myself ? i did talk to a lawyer and she said we need a document from a company saying that the position is still open before we can file I485 by myself.

Well I responded in Oct 2008 and it had RFE status. It didnt change for the past 2 years and it changed to "RFE Review" yesterday. Is this just a coincidence or something to extract out of it ?
For RFE rebuttal, it will remain in the same status until it is approved. You should have contacted them after 60 days of your rebuttal. But as of now, it is fine I guess.
My friend had very similar situation. His status remained as REVIEW until it was finally approved. So no need to worry.

It is good to see lot of peopel of EB2 India are greened in the last 48 hours. However there is no single approval of people having PD earlier to 2004.
What it means?
Either one of the following should be true.
a) IV Tracker data of 65 pages ( 65*50=3250 approx) is wrong or Not updated
(Filtered by EB2 India Pending)
or
b) USCIS is processing I-485 randomly as usual , ignoring earlier PDs
IV Gurus / Seniors / Experts / Critical thinkers can comment on this.

you should definately not get a ear/headache . That is not good. We should talk about this. Are you walking at a moderate pace?. Did you start out too fast?. you should always start out slow. you can start at the same pace you walk from your car to your office. That was what I did 7 years ago. See if you can walk for 30 mins at the same pace you normally walk from your car to your office or even try for just 20 mins. Do not worry about speed at this time. We will gradually build you up from walking 20 mins to walking 45 minutes at a Moderate pace. I can work with you personally on this if it is ok with you. I have helped a few people with their health and wellness goals over the past 5 years. That is my favorite hobby actually
guys.. 30 minutes is a LOT.. I think I walked a little more than a mile. Feels good, but I think I'm getting a ear/head ache because of all that blood pounding in there.

GC is a future job offer - and at the time of adjucation of 485, u must have a valid job offer. till that date u can stay in the US even without working for any employer but at the time of adjucation u must be employed in a similar position.

Hello,
They may have done the prevailing wage (DOL website has this info) and LCA online. Employer can do their LCA online and get answer/approval within minutes. Once the approval is signed, I-129 can be filed on the same day. My employer did these things when they filed my H1B (I got it 5/6 months later).
