once bill becomes law, USCIS will have to implement it immediately, else they will be breaking the law. there probably is a way for them to go to court and ask for more time by citing administrative delays.

Yesterday, I felt proud to be part of a crowd that is so dedicated, selfless, hardworking, fearless, educated, discplined, understanding!!
Each one of you were an inspiration. I cannot thank you guys enough for all your effort.

Due to the economic downturn there aren't many companies sponsoring GCs for employees. I doubt it would be more than 20 to 30k per year from now. This leaves 100-110k visas available every year for retrogressed countries like india and china
if there 300-400k pending GC applications in all categories then shouldn't all of us get our GC in next 3-4 years?

I am getting married in the 1st week of Sep and am planning to get my spouse by mid Sep.
Can someone please suggest if I am fine, if I apply alone for I-485 around Jul30(and not for EAD and AP??) and add my spouse around sep20th. I-140 approval is pending and have a valid visa till '08.
How long does it take for the I-485 'approval' and is 2-3 months a safe window to add ones spouse?
Any suggestions and help with my planning are greatly appreciated. :)

Approved I140, EB3, PD Dec 2004, I485 filed on Jun 30, 2007, Got EAD and AP

Note: A# is same on both approved I140 and pending I485.

With the new rule on FBI name checks, a potential 47K with current PDs could get their GS's soon. I wonder how much of a shift we will see in the PD's from now, after the 47K is not taken into account. I would predict a minimum of atleast a year jump, or am I being optimistic. :confused:

We paid with one check for: two I-485�s, and two EAD�s. In little space on the check where it says �for� I wrote fees. So, just want to let you know from my experience that, obviously, it does not matter if you paid with one check for all forms and applicants (in our case total was $1,150) or with separate checks for each application.

PD � Aug., 2005
EB-3 ROW
I-485, EDA � reached TSC on Jul. 2nd
Check cashed � 08/22
Called Bank of America and got all 4 case numbers from the back of the check.
Checked INS website � applications were received on Aug. 21st and currently pending.
Receipts were mailed .
All applications were prepared and sent by lawyer, so I don�t know exact time when they reached INS or who signed for it.

Can I apply for her Green card and bring back to US ASAP w/o waiting for 5 years as I married before approval of my GC. I can get papers from my home country showing that I got married way before my GC approval.
I did not show at any stage in GC application that I was ever married. I thought the marriage is gone so why show it and now it could hurt me. I even dont remember if there was any question regarding marital status on 485 application.

Do not give up your green card. You must explore all options before doing that. Your best chance will be to get her here on a F-1 visa. If she is qualified, H1-B is appropriate but these days it's not easy to get H1-B. As far as i know, once your green card is approved you may not be able to add your spouse. Anyways, it would be best to consult an attorney like murthy and if possible use their services. They know the rules and most probably USCIS knows murthy too.

Applications were sent to NSC on July 19th' 2007. I got my receipt numbers today and all three numbers (I485, EAD & AP) start with WAC ### ### ####. The online status for the applications say that the 485 application was transfered to Texas Service Center and the EAD & AP applications were sent to Califorina Service Center.
Also just fyi, my I-140 app. is pending at NSC since Dec' 2006. So now I am all over the country :-) Don't know its good or bad. Any idea anyone?

I can understand the anxiety. I have similar concerns but you cannot do much when your luck is involved. No matter the amount of scrutiny or verification you do on your part, if your luck is not good, there may be rejection. But they will not reject, they will issue NOID. You have time to appeal etc etc.
So chill out. Enjoy AC21 (the bill was passed to provide relief, not give more tension).
Do not worry too much about what can happen tomorrow. Enjoy today. Enjoy this month. Enjoy this year.
You are a MI Chapter member and you have done the right thing (supporting IV). Have faith in IV and continue to support IV. I am sure the days of seeing the freedom is near.
