    that the years for Citzenship count the day you apply for I-485...not actually recieving the GC..that was his lawyers opinion..

    Incorrect - you should wait for 5 years after your GC is approved.


    we are struggling to get greencard, even Multi year EAD/AP is a issue and you guys are talking about citizenship..

    If you really contributed $2400 as you say in your post and if you are really EB3 with PD 2003, then you wouldnt be asking others or me the questions. You didnt list a single action item that makes obvious sense to most people here.

    Do you want me also to write below " I contributed $8000 so far".. Do you think it will make anyone to even contribute a $ here unless they see a point. Wake up and come up with a better plan.

    Thank you for your efforts - really appreciate it.

    This request is regarding workers on H-1B:
    Problem: H-1B status ends the moment a foreigner worker looses his/her job, and s/he is effectively out of status. The foreign worker has only 10 days to wrap up his/her affairs and leave the US. 10 days is just not enough time to wrap up five or six years of living and move.

    Solution: The foreign worker's status must automatically be extended by 90 days in the event of job loss.This gives the worker enough time to get his/her affairs in order -finances, car, house/apt, kids in school, etc.

    I'm all for this. This is very close to my heart. I probably care more about this than I do, my 485 approval.(can't have one without the other, I know I know. But still.).

    I don't know when I'll get my 485 approved, hopefully within the next year. But I'm willing to work on this, whatever it takes - contributions, lawmaker meetings, DC.

    I'm in.

    This has got to be simple too. When the citizenship law was first drafted, immigrants got their green cards within months of entering the country. Start to End of the greencard process took under a year, if not less.

    The intention of the law was to have them learn the language, the ways of the country, and assimilate, which was expected to take about 5 years, before applying for citizenship.

    These days the green card process itself take over 5 years for a lot of people. Most Indians and Chinese in the EB2 category, and pretty much the entire EB3 category have lived here longer than 5 years. In those 5 years they have gone to school here, paid income taxes, bought homes, and learned the language (well they had to, in order to qualify for an employment based green card!). What more "assimilation" do they need to do?

    I definitely think that the following should be the criteria for eligibility to apply for citizenship,

    - An approved green card
    - 5 years of continuous U.S. residence starting from the date the 485 application was received.

    Let's do this.

    Excuse me, but what's 485 got to do with assimilation? It would be perfectly legitimate for people who are waiting for their dates to be current, following the exact same logic as above

    People sometimes draw the line just where they themselves have just crossed it

    The first step you should get your employer to do is to file a job order in the state job bank or americas job bank. You have to keep this ad for 30 days and then wait another 30 days to file PERM. This is the longest time. All other forms of recruitment needs to wait only 30 days and you can file PERM on the 31st day. There is no mention of working days or weekends, it is 30 continuous days. As you know in addition to this job bank order, and two Sunday newspaper ads, there has to be three other forms of recruitment before you can file PERM. If your employer and lawyer are really proactive it will only take 60 days to file PERM from start to finish. You also have to get a prevailing wage determination and post it at your job site for 10 days not including holidays and weekends. Hope this helps. Please contribute and incrase the membership of IV for the good of all of us.


    My employer posted the job order around June 18th.Sunday newspapaer ads and all other work is completed. Technically speaking Iam eligible for applying for labor on Aug 18th. Is there a way that i can apply for labor and check my luck now with the changes that took place yesterday on July 17th regarding USCIS making all employment categories current?
    Can i do this? I really appreciate if somebody can respond me on their thoughts and ideas how i can utilize this chance..

    I am manily concerned as USICS rejected the 485 petitions for "Other Worker s" last june ,they can also do the same now if they received huge number of applications ( 40K) in the first few days .

    It is pretty obvious they will surely receive more than 40K petitions. Who knows, they must have already got the same in June when they advanced the dates in June VB. Visa numbers are allocated at the time of approval and not at the time the petition is made. Even if they get million petition in July, that does not mean all the Visa numbers are consumed. It is an indicator they have enough petitons to meet the demand to use all the available numbers and alter the VB Cutoff dates for PD in future months. It depends on the approvals too and it is not likely the petitions made in June/july will get approved now... So we must be okay.. but you never know with USCIS/DOL/DOS... Any thing can happen... for instance like the VB is Current for all categories in July.

    My dauther is 22 years and 8 month old.
    We have not received an official notification from CIS yet, but she is aged-out according to the way the formula is applied.
    I started my case (EB-3) with DOL in Sep.08,05 when she was 20 and a half years old; My I-140 was approved on Aug.02,05. I had to wait almost 1 year for a visa. On Jul.2,07 I sent I-485s and I-765s. We have received the Work Permits and the apointment notices for the biometrics for each member of my family, including my daughter.
    I live in Falls Church, Virginia, so I went to Jim Moran's office (my House representative) to explain my case, how the CSPA fails and ask him to request CIS to apply the law in a different way (I would say in the right way). I talked to one of his staffers but he said that the law is very clear about the time the case is considered in process (only considers the time the I-140 was in process). As you know, CSPA does not consider the time in DOL nor the time waintg for a visa (retrogression).
    Also my daughter has talked to Senator Webb and he wanted to know how many cases are beeing affected, particularly in Virginia, to see if there are several cases, then something can be done.
    I was wondering if any one has heard about any change on CSPA and if someone know where can I find how many cases are being affected by this nightmare or if someone has started something to have this law be doing the right thing: to protect children and families.

    you can send separately. On other forums I read that somebody receiving emails... but it emails doesn't arrive in 24hrs.... as the form mentions...
    I guess you can just wait for checks to cash and then get RN from back of it.....

    The instructions listed says that G1145 is for one of the three lockbox facilities and Dallas is not listed as one of them. However there is one for Lewisville, TX.

    Did anyone actually get a email/text message from Dallas lockbox (or for that matter any other lockbox)?
    Please let us know

    I'm just curious to know why Zoe Lofgen's website does not show this letter in press releases like her previous letters. The letter is awesome and has all aspects of a legal notice. Looks like she is going to sue USCIS herself on our behalf! :D

    We need more people like Zoe who understand the situation better.

    Congratulations to all who got their approvals in Sept.

    I really need your advise , it seems my case is frozen and no one is looking at it.

    My priority date is Aug , 2003 ,
    And RD = Jun 17 2007
    and ND = Jun 18 2098

    My dates were within processing dates for 3 months in 2007, 9 months in 2008 and 3+ months in 2009 but still no one is adjudicating my case.

    I tried following

    - Enquiry thru Aila
    - Service request their toll free number.
    - Enquiry thru office of local senator
    - Enquiry thru Ombudusman's office.
    - Enquiry using info pass

    All of these enquiries just send very standard formatted response suggesting we are working on your case get back in 6 months.

    Any suggestions?

    Please advise.

    I have contributed $320/- so far and just now signed up for $20/- per month. But I would definitely raise that amount very soon. Though I have contributed through other ways also besides financial contribution, at this moment this is the least I can do for myself and I am doing it.
