What are the conditions required for processing the 485 application.
1. Are all applications which have a 485 RD within the processing date, are processed? or
2. Only applications which have a RD within the processing date and whose PD is current, are processed.
As per the uscis approvals it was all happening randomly,,sometimes they stick with rules and sometimes not..ofcourse PD should be current but ProcessingDates vs 485 RD its still stands a mystery.

If DOJ agress what is being done based on country of origin is unjust, in what way can they help?

as per the law u can switch employers after 180 days from recipt of ur 485 application...unless the CBP wants to give u a hard time...he should not jerk u around on that....

Bill rate? 70/30 basis?? Contract??? I would like the OP to report his employer to DoL. DoL and USCIS will kick both the OP and the employer. It is easy to get carried away saying that the employer is blood sucker etc. But very clearly, you should know that there can't be these kinds of contracts on H1. The employer knows that people who go to them are on thin ice, and so does the employee (employer is there to do business -- he is not running charity).
Maybe you guys want OP to go to DoL so that both the employer and OP get kicked out of this country (that is good for all of us) due to obvious immigration fraud.
To top it, OP goes on an offensive when people point of the bitter truth to him. This site should not promote illegal behavior, anybody seeking advise on these topics should be severely castigated, because they broke the law too (and they know it, just dont want to admit it). Or maybe we should encourage these people to report to DoL so that all of them can be punished for misusing the laws.
While I did not suggest him to go to DOL. Let me tell you that working on hourly wages is legal on H1. The best solution is to find the job quietly. How do you know how much is his employer making and what he has got? There could be very significant difference.

Oregon DMV is little lenient on this matter, but they see only the expiry date on Passport visa stamp. Oregon will issue license till one year after expiry date on the Visa stamped on passport in conjunction with the H1 extension approval notice. So all these original H1 extension approval will not be considered if passport visa stamp expired more than a year. We have to go to Vancouver, B.C to get visa stamped and come back.
California accepts the I-94 extensions in the H1 extension approval notices (That's 3 years back, but they keep on changing rules every month and the California DMV services are not fast enough). Also some times the information from USCIS will be hanging if you have extensions. But if you go out of country and come back with fresh I-94, the information is validated within 5 minutes electronically. DMV staff are more considerate in California.

I know a EB2 India application (obviously not mine) that was approved after this July fiasco and no where I could find his PD date current in those previous months (except July where everyone was current). After this guy got his GC, I am convinced there is no "system" in place. It is all random and you can't really predict anything. :mad:

The OP wanted an advise, so please give one , constructively. As far as consequences for anyone's actions they will suffer from it. There will be no escape whether in this issue or in any other issue in life.
I have noticed many posts in the recent past wherein the forum discussions degrade to personal battles real quick. The persons involved feel the need to respond to an irky post by upping the ante. Stop this game of one upmanship....

All of your Education (I am assuming you have four MS degrees, two PHd, as you have twice mine, and about 300K salary) is a total waste, if you stick up your head to support someone who does shop-lifting and have no qualms about it ( i have definitely not seen any statement to that effect from the OP, just seeking "immigration" advise). I can only think of a myriad number of reasons why you want to support this guy..maybe you yourself might have sticky hands my friend? Or maybe you are the same guy posting with two IDs and supporting your shop-lifting by such BS? I have no idea and am not interested either.

I think most important things you need to consider: (Considering the fact that PD will be pushed back to stone ages in September Bulletin)
a) Hope that your I-485 Application is not approved before your PD becomes current. If this happens, it's a royal screw up until your wife keep's her own status (F1, H1).
b) Earlier, it was predicatable when your PD would become current and it allowed most of the folks to add their spouses at later time.
c) Bigger question is whether they would process on the basis of PD or RD. I think it's unfair to do it on basis of RD as most of the people would be jumping lines. Currently it's done on the basis of RD, but USCIS might change their SOP because of this July VB Fiasco.
d) As others suggested, make sure to maintain your H1B status as long as possible without invoking your EAD. This way, you can continue to keep your wife on H4 status (Unless she can keep her own status for atleast another 2-3 years).
I am in the same boat with EB-2 PD of Aug 2005. My spouse is outside US to get her F1-H1B stamping as her OPT Expired few weeks back.
