We are also part of this seemingly unending wait to file the I-485. We missed the July '07 window.
It is frustrating in many ways....
My husband cannot switch job, even though better opportunities come his way!
There are travel probs to India as these days there r all sorts of cases happenning when u go for 'stamping' in India.
Also, I am a qualified & experienced professional (worked in a respectable MNC in India)....but cannot work. I did MBA from a university in PA thinking that it will help me launch myself in the job market when the EAD/GC comes.........but the 485 dates never came out of the spiralling mess.
U might think that I can go the H1B way.......but that itself is going in a bigger mess & employers r not willing to do in any more
So, when I saw this "Advocacy Day".....I thought its the time to get up & do something for ourselves as there might not be a second chance!!

Hello!
My wife currently has a H4 stamped in her passport. She is India right now and is planning to travel in June 2007.
Now her H1 will most likely be approved. Does this mean she has to go for stamping her H1 VISA or can she travel on her H4 (valid till 2009)? Is it required to carry the approved I-797 for her H1?

You have to start all over if you find a EB2 qualified job and also if you qualify for that job,and your prospective employer couldn't find a qualified US Citizen or permanent resident for that job, you may port your current PD at the time of new I-140.

iv has not raised any security related issues as a policy. we have not denigrated uscis for working efficiently either. all we asked was to honor the july bulletin.

I know your pain, Iam in the same boat, submitted everything on 06/26, hopefully everything will be filed after july 4th.
I have submitted all the documents to my laywer on 6/25 itself (including medical) but they are just heavily back logged and won't be filing my case till Jul 10. I am just frustated now. I even offered to pay extra to speed it up but no use. I am only worried if dates retrogress half way through?
To my real question.. Can we just file on our own with out the lawyer? I would hate to loose this window just coz my laywer couldn't do it. Not sure how I would break that kinda news to my wife, "I know the dates were current for 10 days in July but our lawyer didn't have time so now you will have to stay at home for 1 more year".

People are loosing hope on CIR. For time being Pl. keep CIR aside. It is election year. we are not priority for congress in this election year. Why do not we ask for filing I485 even VISAs are not availble. If we get ability to file I485 tens of thousands of people will get relief.

You can move but are you changing employment? If yes, AC21 kicks in only after 180 days after filing 485, assuming 140 is approved.
2. We do have a PO address is Texas now and have an apartment in CA for next 5 months.

I've already signed up for monthly contribution...and sent LogicLife's mail as a wake up call for all the fence sitters and freeloaders.
I can relate with anurakt's feelings...it's amazing how penny wise pound foolish people can get!
Come on guys, I have introduced at least 8 friends to IV and (almost) forced then to contribute :) Let's all get 2-3 members and persuade them to contribute.

I did the same thing last couple of months, persuaded my friends like crazy and sat at their homes and got them registered and also got them to contribute. No. You got me wrong. I have friends filing through consulting firms. You got me wrong completly. Outsourcing/offshoring firms are completely different from Consulting firms. Consulting firms files new h1s and get the people here to work for their clients. This is good to new prople who wants to come here legally, to US busincsses and to everybody (except for anti-immigrants). But Outsourcing/offshoring firms file lot of H1s and do not use them. Thats the problem. If they use, it is not going to be a problem.
Second guess: You have a US degree or you are not working for a conslting firm.
This is also wrong. I don't have any US degree. Also, I am working as Consultant from past 3 years. I worked with different big clients as a conultant. This is how it works in US. Again, Consultancy is different from Outsourcing/offshoring.
Why do you think the spouses on H4 do no deserve H1? If they want to work, why do you think that they should not compete in the job market?

BTW, the companies you are cursing, TCS, Wipro, Satyam etc., it is possible that soon the H1s applied by these companies will be exempt from numercial limit. Yes, you heard me right. Here is a bill that would make companies providing scholarships to undergrad and grad programs to be exempt from H1 numerical count. This is not a joke, read for yourself: :p
I am not agaist the consulting or competition or anybody who wants to work here legally. I am againt the wastage of H1s. Applying them and not using them is a problem. By the way, where was the law to excempt those so called outsourcing firms from numerical H1 cap? Can you please provide the link? If there is one, then there is no chance of reaching cap so fast. No firm is going to waste the money by filing H1 and not allowing them to work is US after getting it except for Outsourcing firms. It is a fact, agree it or not.

Samethng might happen even now if Congress increases it to 200K. Since we have less visas, everybody tries to grab a slot, But if we have enough visas (200K cap), then nobody is in a hurry to apply like the one happened this year.

Im still waiting too. e-filed may 23rd. fp done on June 17th.
Expedite request denied, have an infopass appointment on August 14th. I will see what they will say
Getting too worried as my current ead is going to expire on Sep 19th.
Looking at the tracking it looks like TSC has started to work on all these pending cases. Hopefully our petitions get approved soon too

I recently renewed my PP from Houston and it was a great experience. Ideally we all write in forums to complaint but I think we all should appreciate the offices/persons/departments who give good services especially the govt since none is expected from them.
I sent my passport via FedEx and few days after that I got a call from the consulate saying that my passport still have enough time left on it and is not up for renewal. I explained her that I need to travel to India for 15 days in June and will also be renewing my visa and around that time I will only have six months of PP validity which may be an issue for the US Embassy.
She asked me to send this statement via Fax which I did and within, I guess 2 weeks, the new passport was delivered at my house.
Excellent service.

For me the agony is endless. My deshi employer did not provide me the EVL in time though I was able to file in JUNE. They gave it to me after JULY 20th when I stopped sending timesheets.
I am personally not a big supporter of elimination of country quota. Don’t get me wrong. I fully share and understand the endless pain is being gone through by EB3 Indians/Chinese community. Increasing # of EB visa will ease some of their pain.
For an example there are 1000 IT processionals from India wants to come to US with H1/L1/B1. There are ample companies (say 50) owned by Indian and those 1000 IT professionals have enough opportunities to come to US.
On the other hand, for an example, from Ukraine, there are 100 IT professionals are trying to migrate to US with H1/L1/B1 but there are few to none companies (say 1 ) owned by Ukrainians and those 100 IT professionals have few to none opportunity to come to US.
My point is, there are more IT Indians in US do not validate removal of country quota.
Others should get a fair chance – NO MONOPOLY is desirable.
Also New Jersey has too may Indians living, may be one day, there can be revolution, and they might ask for a separate country. I am kidding here.

Then again what's fair about indian born in india being retrogressed while indian born in kuwait is not.. We all acceped to start applications within certain rules, saying "not fair" and adjusting the rules at others' expense should only apply to future applications.

Today, the law states that:
Give 7% of 140,000 visas(annual quota) to each country. After that, if there is leftover visas, it can go to countries that need more than 7% of 140,000. Today, India and China are only 2 countries that need more than 7% of 140,000. Eventually, each year, India and China get a lot more than 7% of 140,000.
If you change the law to remove the clause that says "you can allocate leftover visas to over-subscribed countries", then India and China would be severly affected and the leftover cannot be used by them. It would either be unused (wasted) or flow downwards to EB5 or family based.
last year, the hard cap gave a big headache to us for 2 months. Then thru Immigration Voice's efforts, Sen Brownback proposed an amendment to remove the country cap and allow 485 filing when visa numbers are not available.
Brownback's amendment was folded into the last minute manager's amendment(Sen Specter was manager of Senate CIR by the virtue of him being the chairman of Sen Judiciary committee). And we got rid of the hard country cap that would have been created by CIR.
