1. Ball park figure is total of 218,000 visa wasted from previous years. How much of it will go to EBs (and others) will be based on how the recapture gets implemented. If we don't do anything and sit quiet, it may as well be ZERO. Nurses will walk away with the cake
2. President can pass an 'Executive Order' to pass interim relief. So it should be possible. It'll depend on the independent interpretation of the law by the White House, and it won't be based on whatever you read elsewhere.

I concur... I'm not flying BA ever again, my family members have had bad experiences with these folks. My $ is now reserved for more deserving airlines, even if the tickets are a couple of hundred bucks more expensive elsewhere. Guys do not feed the freeloaders by telling anything you are reading in the donor forum. Let these people help themselves by signing up for recurring contributions if they want helpful nformation about their EB2 PD movemement. We are still not meeting of our advocacy day amount. Now USCIS is on top of July 2nd and 3rd filers, especially for the applications that were transfered from NSC to TSC. You will certainly get your receipt notices with in a week.:)

I have a question regarding this whole idea of filing on your own:
Whats the reason for doing this? Is it because:
1. Attorneys will be busy during this time
2. Employer will not file 485
3. Bad Experience with Attorneys
4. Anything else please explain
If 2, whats the guarantee that he will not cancel your LC/140 once he knows that you are filing on your own?

I'm in this country since JAN 2000 but my actual Labor was filed in MAR 2005 because my 1st company SOLD my 1st labor ...... Its a PAIN you know - cycle of LC , 140, 485... Like cycle of birth and death...
Moreover Smitha is talking as if whoever "sent flower"/"stood in rally" made an assumption that a GREEN colored plastic card will be handed over straight off the Grill instantly !!!!!!

There are several people who has to re-file their labor for several reasons (employer greedy, company overtaken, laid-off, company gone bankrupt etc etc.). That does not mean that 2005-2006-2007 guys are asking that they should get GC before 2001-2004 people. What most of the people need is an ability to file for AOS so that they can indepenedent of the clutches of their employers.
I'm sure if you widen your horizon, you will be able to understand the plight of all your brothers and sisters stuck in this retrogression.

I am not sure if I am correct, but I have heard it is totally up to you what form to use when re-entering the U.S. If one posseses a valid H1 and AP, it is up to him what to use. Many people choose to use H1 to enter to safeguard status while I485 is pending. I may be wrong; but I could swear I read about this some time ago.....

This does not make sence at all. Why the USCIS would make visa number current then retrogress again? I do not think they make all visa current and not expect a flood of applications. .

3) Pay stubs for last six months
4) Tax returns
5) Letter of introduction from the employer
6) Latest Resume
7) 3 Recommendation letters
8) Family photo with Mother, Father, spouse, kids , siblings. While background, taken less than 6 months ago. Frontal view :)
Avoid them at all costs....
