Finallly, my online status changed from "Initial review" -> "Document production" and also got email from Senator's office that my case is approved.
I think I got it....but not 100% sure yet...no approval emails yet... or no other proof.

I sent 20 posters today by smail mail and now I have already called 12 member's offices. Please call them and make them hear only about 5882 till this is cleared. I am telling them " I am so n so, calling from x, and this is to request Mr. to support the Visa recapture bill for LEGAL IMMIGRANTS, HR 5882. Please call. More voices can only be heard loud. Lets join hands.. Together we can make it..

What stops USCIS is the per country cap. They can only issue so many visas to EB-3 I.

Please consider the after effects of filing bankruptcy and foreclosure. Your credit has a lot of things to do, its not just the credit cards or loans. It may affect even your ability to get another job. Getting another apt will be a big problem as this remains in the credit file for along time. None of the good apt complex will offer the apt, and you may be forced to live in a crime-ridden area with your family. if you cannot make the payment or you feel that your home has lost its value, ( I hate to say this) default your payment for 60-90 days and you can file to get into the new federal program where your mortgage will be adjusted to pay a smaller amount.
I had bought a house 2 years back thinking that i will sell it after couple of years and make money. I know many people might have done that. I didnt knwo that having a house will become a burden for me wrt moving to a different place in search of a job. I do see jobs in cities outside my state and was thinking of applying for those jobs. My problem is that if i sell my house, i will have to pay from my own pocket.
Having a house in this market has become a pain as it has made me immobile with respect to good job offers.
I was thinking that incase i find a job in a different state and cannot travel back home frequently and also renting is not a good option then should i leave the house to the bank for foreclosure?
Will this affect my GC process. I have no plans of buying a house in coming years.

If Aman had worried about only himself then there would have been no IV. Start thinking for whole EB community. Change your "I" comes before "WE" attitude, help the whole community and help yourself. Anyway, good luck on your law suit.

I know two of my friends who's wifes were on H4 then converted to F1 and were working on OPT and then filed their I-485's and are now working on the EAD got from the AOS.
I dont think there is any problem in applying for your wifes I-485. In fact I think you would be foolish not to apply for her. More over you are the primary applicant. If your doubtful then take up a paid consultation with top lawyers like Murthy, Mathew Oh etc
The only problems if when you travel and say if you can apply I-485 then she has to just be patient till her AP comes and then she can travel on that

My priority date is current now. I read somewhere that I have to file I-485 between June 1st and June 30th. is this correct?? what if my medical exam results are not ready and I am not able to file before June 30th?? can I still file during following month, July?? Please help. Thanks

I have once again sent 6 letters by mail to 6 members, but I would like to send to more by email. Can somebody please direct me to how to get those or if you have, please paste it here so that we can start sending emails also.
We must bump up our efforts as much as we can before the Oct bulletin comes out, but EB3 needs to do better. There is not much difference between the two categories when it comes to skill EB2 or EB3. As all of you know, the system is broken. There are Masters degree holders in both categories and experienced categores in both. Not long back we saw Eb3 doing better. This is not right guys,. Lets work together.

I don't intent to sound rude, but why would this make your life "Suck", "no social life" , "no carreer life", "no nothing life".
Iam in the same position as everybody else, and am deeply dissapointed with the news (hence Iam here), but I just spend 2 hours in a nice pub, drinking nice micro brews, came home had a nice talk with my wife (H4), we are planning on going out for dinner and maybe watch Knocked up afterwords (heard its nice).
If this were to be true, it would delay our GC by another 2-3 years, but we are in this country on our own free will, making good money. Be dissapointed, but this is not the end of the world..Mantain the perspective...

First off, interesting thought. I thought about this a lot. A lot of my friends are citizens now. Most of them came at the same time I did or even after I came. They were at the right place at right time and did not languish in SWA & BEC like I did and did not wait in 485 queue for years like I am now.
It may be difficult to sell the idea of 10 year presence , but I believe the following may be palatable :
Consider the 140 approval date or I485 filing date towards calculation of the 5 years of residency requirement instead of GC approval date. You are technically approved to be a resident when 140 is approved. You are ONLY WAITING to be status adjusted for lack of numbers.
having said that I have NO expectation that we can achieve this. Think about it, we can't get simple things about GC done and aim for Citizenship :)
reminds me a famous quote about , some one who can't climb to the roof aiming for moon. (I sound pessimistic, but I am damn deserved to be one :)

I had the misfortune of travelling thru London in December on my way to Mumbai. After I purchased my tickets, I learnt that I need a transit visa (TV) for UK. (Who is going to tell them (UK) that they are no longer the center of attraction esp. if you have lived and worked in US). Anyway, as per the rules, you need a transit visa if you don’t have a valid US visa. (Note: If you have AP, and don’t have a valid visa, you still need a TV).
I went to their site and did all the research to get a TV. Good god Heavens! Has anyone filled out their painful form for a TV? Besides asking the usual details, they get extremely nosy. They want to know each and everything about you. Where you work, what money do you make, name of your wife, kids and their citizenship status, name of your father and mother and where they were born, their birth date, how much money you have and where the money is (stocks, bonds, CDS) etc. etc. While filling up the form I realized that, even my future father in law did not pose so many probing questions to me. (Please note: I don’t mind answering these silly questions for a regular visa, but for the damn TV, it is certainly overkill).
Anyway to cut the long story short. The regular cost of TV is/was $92. However, when I filled up the application form they were asking for $184. (The satisfaction of getting a good deal on the tickets was quickly evaporating). I assumed I must have made a mistake in thinking the cost to be $92 and reluctantly paid $184. Next it was time to fill the application for my wife and answer the idiotic questions again. You should have seen the “I will kill you right now” look on my wife’s face after I woke her up in the middle of night and asked details about her parents. After I filled up the form, to my surprise, now they were asking $274 for visa fees. It was already 2:00 am and I have no choice but to painfully enter my credit card details, hoping that they would realize the mistake in their recon process and would reimburse the difference. (Of course, I was only dreaming).
It is now almost the end of January and I have still now received any money from them. I have tried sending several email to the emb(ass)y, but none of their emails work. I get bounced email for all the emails that I have used. I have tried calling them and left messages and no one has called back. I have send emails to my credit card company and the people who processed the payment and none of them have been able to help me. There is a way to talk to someone in the emb(ass)y, but you need to dial a 900 number, which BTW costs $2.49 per minute. Throwing good money after bad is not an option.
I just wanted to share this experience with you and remind you of the pain ahead, if you are travelling thru UK and don’t have a valid US visa. Personally, even if they had charged me the regular $92, I will still use other options to travel next time. The amount of time wasted in filling the crappy application form, going to NY, (starting Dec doing your finger prints) is simply too much to handle. Visiting your motherland/fatherland is a very special occasion and all these intermediate steps certainly water down the “good feeling” that you experience during the days leading to your trip.
I haven’t given up my quest for a refund, but now, not only I want my money back I would like to bring back home the Koh-i-noor too.

Other incident, before boarding , a firang missed her baggage tag and when security lady asked for it, this firang was fuming and said it's their mistake. Now this lady cop, in her simple English said, Madam, please get out of this line, go to security check again, and get the tags, otherwise you won't be able to board the plane.
No one treats them as VIP any more back in India.

We got our GC cards on Friday.
It seems that USCIS is processing cases which have been pre-adjudicated very fast.
Good luck to all who have been waiting... there is definately light at the end of the tunnel

I had soft LUD's yesterday (9/19) on all I-485 applications in my family and on the (July 2007) EAD's for my spouse and me. My PD is May-30 2006, so I'm wondering if they are looking at low-hanging fruit for the next month (or to hang the fruit!)
Did anyone see any Soft LUDs on their 485 or old EADs before their approvals/RFEs?
My PD is June 7 2006, not current. Yesterday, I had a soft LUD on my 485 and my first EAD. These two haven't seen any activity since early 2009, and I'm wondering if this means anything or if I'm reading into this a little too much.

I have not seen any place where the change the rules of the Games inbetween..So for EB-3's of early 2000..we were expecting GC's in 2-4 years and EB-2 in 1-3 years..we didnt see any big difference here..ok we said we can apply in EB-3 and wait a year longer...
If we knew that DOL would suddenly change the rules..there was no reason for us to apply in EB-3..we could have looked for another job or convinced our manager to apply to apply in EB-2..if the situation could turn so dire as we know now..Now look at the new guys..they will never apply in EB-3..even the lawyers will advise thier clients to apply in EB-2..so the old intrepretation should remain for the older cases and new interpretation for cases when USCIS decided to change the interpretation...

There is no ambiguity in law. The law is clear. One law (and one rule) should yield one interpretation. If someone interperting the languge of law differently; then that is their mistake. Thats what DOS was doing in between 2001 and 2006. This could be possible for them because no one was going after DOS. Now somehow they realized (or some affected applicants notified DOS). If the old practice is a result of correct interpretation of law, why they should change now? This is very high sensitive area; DOS might have not changed their practice without risk analysis. They should not care about how much retrogression in India; They should only care about implementing the law correctly, as becuase they are executive branch of government not legislative branch to worry about retrogression.
