Listen,
What difference does it make if it is EB@ or EB3, the point is, we should stand UNITED we all benefit. If the recapture visa bill passes, then we all will benefit.
Please don't post any more viewpoints stating " I wont fight"
It is your loss and everyone's . If you choose to step out of IV and fight all by yourself, I wish you all the best.
We senior members have been fighting for the greater cause, it for you junior members to carry this forward. The foundation of IV has to be strong, it has been strong.
IV has not patience for people who want to discriminate between EB2 or EB3, we need people who see a broader perspective of things, EB community as a whole.
If the recapture visa bill passes, think we all will benefit, will we still question about EB2 or EB3.
Please be wise and be patient, we need everyone to change this system

Pappu, thanks for the update. Mr.Kaplan's testimony was pretty assuring. Will the transcript of the Q&A be available in the electronic format as well?
IV Update:
IV had contacted Lance Kaplan, (speaker today ) as well as American Council on International Personnel he was representing. Here is the testimony of Lance Kaplan.

Friends,
Are we required to carry GC with us all the time ?
My attorney says we must. What if I lose it or damage it ? Can we carry a photocopy ?
Yes, the rule is to carry the original. If lost, apply for a new one. So, i preached.
I never carry it, one day one immigration officer is going to catch me and grill me.

I keep on hearing about cases of 2000 and before. Good luck to your friend. I am with PD Sep 2001 and I am too mentally prepared to wait for more years..:D
I recently came across an old friend of mine. I was shocked to hear his case. He is an original applicant EB3 India with PD of September 1998. Please note he is the original applicant and this is not labor substitution.
Here are the details
Sep 1998 : Applied with Texas Workforce Commision as regular Non RIR.
Oct 2001: TWC asked to do recruitment. No action was taken on submitting results.
October 2006 : Labor finally approved from Dallas BEC. Concurrently file I 140 and I 485.
Jan 2007 : I 140 approved.
Nov 2007: Took Infopass appointment. Was told case pending name check.
This case is absolutely amazing. My friend doesnt care anymore since he recently married US citizen (genuine case ABCD). He has worked at the same company since 1998 and stuck to stupid job (non IT). My PD is August 2001 and seeing his case I am getting mentally prepared for much much longer wait.
Thanks

Did you send photos
No I did not. The instructions said, I don't have to send photos.
That is the reason, they asked me to appear for bio-metrics which I did.

It is so pathetic that there are so much people waiting in EB3-I category.
This Guy just applied in Dec 2004 and got GC. His question is whether i need to carry ?
it is only karma.

Great..Thanks so much for your response. I will definitely consult an attorney as suggested by you, but your response gives me a ray of hope and clarifies quite a few things.
So, does this mean that same or similar job may not have any meaning? Because, now since I have an EAD, I can change my job in any field and then when my priority date becomes current, I will get my GC if no RFE occurs.
Also, does it also mean that once I have my I-140 approved and I-485 pending and also have my EAD, i don't need any kind of sponsoring or supporting documents from my new employer? I mean, can I apply to jobs that say Employer cannot sponsor a Visa or GC?
Thanks in advance.
I think "same or similar" job is common sense thing to keep in mind. You don't want to specialize in software architecture then switch to building construction architecture ;) Also remember that if you need an attorney to defend you, it will cost you more in money and peace of mind. So it is better to stick with what you know, if you know what I mean.
In answer to your question, no - you do not need any supporting documents from your new employer except in the case of filing an AC-21 letter which must come from your new employer. You also do not need to file an AC-21 right away. Taken another way, in other words, you can choose to have the AC-21 conversation with the new company after you have been with them for a few weeks and have a degree of comfort with them.
So you can apply to any jobs that say employers cannot sponsor visa or GC because you are not technically seeking their direct support for your pending I-485 adjustment. If they ask for proof of employability, present your EAD (formally called Form I-766) and you should be good to go. EAD Form I-766 is listed as a LIST A document on Form I-9. See item #4 on page 4 of this document:
http://www.uscis.gov/files/form/I-9.pdf
List A means you need only present this document for employment verification. You don't even need to show any other document such as passport, driver's license, old H1-B, etc.

Kondur, based on your signature, you have 3 active applications in the system. I understand EB1A, thats you sponsering yourself and no labor needed. EB2 with PD 02/08 is employer filed with PERM and I140 and whole nine yards. if I understand it right, EB2 NIW is also something an employer should sponser (or atleast help you with some documentation) and you file I-140 directly like EB1A. I know parallel applications are OK and EB2-NIW or EB1A are surely faster. but is there any reason behind that many applications at same time (other than increasing your probability of atleast one going thru?)..
There is a reason for multiple I 140s in my case. There are benefits to each of them:
1. EB2 PERM based: already have it approved.
Benefit: already approved. Lock the PD.
Disadvantage: Not current. Upon approval you have to work for the sponsoring employer.
2. EB2 NIW:
Benefit: No committment to work for a particular employer. Just work in the same field as NIW. Easier to get approved than EB1. Not sponsored by employer; self petition. Attorney files it with no extra charge with EB1 (only additional filing fees)
Disadvantage: not current.
3. EB1A (My best bet!)
Benefit: Current and will remain current. Upon approval no need to works for a particular employer; just stay in the same field. Not employer sponsored.
Disadvantage: Very difficult to get approved.
Hope this clarifies....
