Guysssssss N Gals , I got it (I-485 approval) 10 minutes ago!!!!!!!!!!! NO RFE. Recent Luds were on I-140 / I-129 / I-131 ( Luds occered on 10/29 & 11/4) . Been in USA (F1, H1) since Aug 1997.

I just don't understand one basic question.
Congress is trying to pardon 12 million illegals as a one time measure and give them Green Cards. (OK - Very good)
On the other hand we are about half a million who entered the country legally and helping the U.S. economy and paying taxes. Why don't they consider giving all of us Green Cards as a one time measure too ?????

Got the approval notice today :) "Welcome to the United States of America" - ironically i have been in this country for a decade now! finally the "welcome" :)
It has been a very long journey!!! and a very frustrating one for the last few years... but the feeling that I now get is really liberating... first thing I did was thanked God for ending the seemingly endless wait that me and my wife (she didn't care as much) were in.
I'm already thinking of the things I want to do after this new found liberation... it includes showing the middle finger to those who have taken undue advantage of my status :cool: :D and i'm not taking it anymore... I'll be a new person starting Monday!
Just so there is no confusion... my PD was Feb 2003 EB3 but my wife's PD was EB2 April 2004... we got our freedom through her application. If anyone needs more info on how/what/when - i can share that (it had its up's and downs - mainly downs, but all's well that ends well)!
Lastly as a token of my real support to the cause of IV I will be donating a small amount. I have donated in the past... I have participated in conversations in the past... I was not so active on other fronts but I truly believe in this organizations effort to help the community. And God willing each one of you will get this freedom soon! God Bless!

This is a good point. I was not trying to scare you but telling you my perspective of things as you presented them. Even in India someone with mulitple "official" id documents is looked with suspicion. The issue is sensitive in this country in these kinds of times. What if one of your last names gets listed in some FBI database for some reason? You would be stranded for no meaningful purpose in one of the back rooms by the departure gates...
Look at the bright side: with your current documents, you can choose a good combination of names and change/finalize your name with Indian embassy/consulate here in USA. Before that you could consult an attorney to streamline things you need to do .
After you do the name change or finalization, your lawyer would file a suitable amendment papers to your approved petitions. I believe with all good intentions that failing to do any or some of these will a recipe for future trouble.
Have a look at some of hte other forums: even with one set of names, there are people stuck at FBI namechecks; if you dont take the pains now to
decide on one name, everytime you do a paperwork with USCIS, you are adding to your problem portfolio.
Good luck, and remember that none of the members ( at least most of them) are legal professionals. IV anyway allows you to ask questions to lawyers every week (?) and maybe that could be a good startpoint.

Dude - think practically. If the billing rate that the company is going to get from the client is $70/hr and they keep only $5/hr then they have to give him $65/hr. If they have to keep him on the payroll, they will have to pay 7.45% in payroll tax, which is employer's portion of Social Security Tax and Medicare (reducing their rate from $70 to $65.1575). This means they will be making 15.75 cents/ hr (translates to $315 for a year assuming that you work for 2000 hrs - the remaining 80 hrs go in holidays - for which they may or may not pay). Even if they are outsourcing payroll, do you think that it will cost them less than $315 a year to pay him? even if it costs $0 - who would be willing to keep you on their payroll to make only $315 a year? Would you? and if you take unemployment insurance and liability insurance into account, the company would make a loss. If you owned a company would you follow this business model? If you are - you might as well just give your money for free to all your employees.
The only way you can get a company to keep $5/ hr and give you the rest is if you agree to a 1099 (and you cannot do that on a H1B - you need to use EAD for that). On a 1099 - there are other tax implications - now you have to pay both your share and the employer share of payroll tax (14.9%). And now since you are an independent consultant (which is what a 1099 is), you have to get your own Liability Insurance. To prevent people from suing you, you will need to form a LLC or some other type of corporation. You might want to get a good CPA to setup your company so that you can setup the right kind of company to benefit from the right tax deductions.
There is nothing wrong in making more money - just like you want more money, the corporations are out there to make money too. No one is in the business for charity. As long as the relationship between employee and employer is symbiotic, all is good. Once the equation changes, it is either time for the employee to say good bye to the employer or for the employer to off-load the employee from the corporate bus.
I have seen many posts in this forum complaining of "blood-sucking" employers and how they exploit employees. To me, that is the same as:
- programmer's guild complaining about us stealing their jobs or
- people losing their home and blaming the banks "for not disclosing terms"
- anyone who is blaming anyone else for their troubles
If you are being exploited, it is because you are willing to be exploited. Don't blame the employer. Blame yourself. If you don't want to pack your bags and go home when you lose a job and cannot get another one, don't blame the employer and tell others that they are "sucking your blood". Everyone is here to make money.

i hope we wake up and realize that we are all in this together. When i met with my congressmans assistant, i had boasted that we were 25+ members and had more than 300 in his district... The guy was suitably impressed. When the action item to call the congressman was launched i was told that only a handful called his office. The sad part is that while people posted on the forums to get a green dot, i know some didnt call because i had followed up with the office. EB3 Vs EB2 battle had the biggest fallout on the group, those rabid discussion brought out the worst amongst us and many volunteers (including myself) stopped. We had a great opportunity during the letter writing campaign, it was the best change to resolve some of the painful issues... we all know what happened.
Most of us talk about unity till it suits us ( and i dont mean walking_dude, i am aware of the great service has done, including the fight to ammend the drivers license issue).
Instead of asking for more bread, we are fighting ferociously for the scraps like dogs!
It was estimated by Compete America that if the last CIR had passed there would have been more than 500,000 visa numbers recaptured ( don't ask me for the math, I didn't come up with this number). Assuming that the Nurses took away a chunk of it, we still would have a big chunk to statify Eb3, Eb3, ROW, India, China etc. etc. And the nurses are going to walk away with a big chunk folks - whether we like it or not - because we are fighting each other like dogs for the scraps of the spillover, while they will come up well organized and walk away with the cake.
Our disunity, lack of long-term vision, lack of action is our biggest weakness. We will not win unless we fight this together.

Once you used EAD your status is AOS. You can't go back to H4/H1 unless some bad thing happened like 485 is denied.
once started usign EAD you can't go and come on H4/H1 status...
you have to use AP for travelling. If you have a doubt talk to the atternoy that filed your 485.

I know Immigration voice is not for profit organization and it is doing a great job.
My intention is not to belittle IV, my intention is just to express my opinion as a user, most of the problem will be solved if the links are not shown to non members if they are not allowed to see the content.
I just saw your post in YouTube, it is very informative.
All the time and effort that IV volunteers put in and the lobbying efforts don't come free. There is a cost associated with it. As tonyHK12, I'd rather trust IV and risk $25 a month than leave everything up to chance and hope. Just my 2 cents.

Sometimes I think that rather than writing to these politicians ,we should write to USCIS.This retrogression is caused by them.They didn't wait for any bill to be passed for this retrogression.There is no use of talking to politicians,they don't care.
I know that USCIS will not care either but USCIS did it out of nowhere ,till sep2005,everything was fine for them and suddenly in oct 2005,they put us in backward direction.Now after a year and a half ,we are at the same spot,waiting for the visa bulletin and staying depressed for a day or two after seeing it.
I don't know .I am so mad at everybody.

Btw,i have already sent emails to USCIS and chicago tribune regarding this .
