I am little confused here, do they take into account the reciept date or Notice Date ?.
My Application was sent on July 2, and ack on July2, however the application got transferred to Nebrska, CA and back to Nebraska, and I am told the Notice Date is Aug 30. (If I go to Online website it says On Aug 30 we recd your appln like that) But I am July 2 filer.
So if I want to move, should I think i am safe after 180 days which is jan 3 or is it March ?

In the mean while, my wife got a job. I asked my lawyer if it�s okay for my wife to start working and they said yes she can and there will not be any issue her visa status. My wife was on H 4.

There is no such thing as a cooperative employer in this economy. I will give you an example....
While I do agree with some points on how difficult it might be given the economic environment, we do not know OPs employer or OP himself to make a broad generalization. For all that we know, OP might have 10+ years of domain specific knowledge that might make him really valuable to his employer or he might be working for a desi consultant who is happily taking 60% of his biling rate making him very lucrative to his employer. That's why I used the word "cooperative" to refer to the type of employer.
While no doubt, getting PERM approved is difficult at this time, it's not impossible (I have a few close friends who got them approved recently in EB2 though they had to wait a long time for it) and giving it a shot is well worth it if things work out in OPs favor.
PS: And God knows why I got reds for my previous post. Funny!

I think we need to be careful these kind of conversations aren't detrimental to the current campaign and to IV. I am new here, but I do also feel the drive that chanduv23 has and you know, sometimes you do feel like posting it everywhere and on your forehead. This backlog situation sometimes gets the better of us! I am all for organizing too, we need that. But I do sympathize with those who feel desperate to reach as many visitors as possible. There are still folk out there who would like to send their letter, let's encourage them and still be organized. I promise to keep my posts to threads already existing from now on. Thanks :)

possible reason for mysterious rejections :
You are a mail room guy, you go home friday (06/29) and comeback on monday (06/02).
You start the monkey business of timestamping incoming mail, but half an hours into the day (around 8 or 9:00 am), you realize "sshhttt: i did not change the date on my stamp, its still read 06-29-2007". In the classical govt. fashion, you do not bother to go back and restamp the applications with the correct datetime. Not because you are evil, but because you simply don't understand the ramifications of early stamping. You think u are doing the guy a favor, putting him/her early in line.. but guess what... the guy's application is gonna get rejected.
Could this be the case with some apps mysteriously being rejected?
my application reached NSC at 7:55am on July 2nd and I got my physical receipt notice today, mine was signed for by R Williams. checks didnt get cashed yet.

Is it possible to file I-485 without I-693(Medical) ?
The reason I ask is that I cannot get a doctor's appointment in July. For some reason, if we are able to file in July, can I submit the 485 first and submit teh I-693 later.
Please advise
As per the bulletin I read, USCIS has indicated they will reject the application without I-693 period. Hence search across whole of US; if need be. Remember another thing, the appointment with Dr. is always two times; first time they take your blood (for AIDS test); then they will call second time after the blood analysis is done; if everything is fine, they would sign the I-693 and put that in a sealed envolpe.

Ignore the Receipt Date on transfer notices. I have the same situation, receipt date on transfer notices was Sep 19, but the receipt date is Jul 23. I checked the receit notices, and they have the right receipt date. Only the receipt date on the receipt notices matters.
We received all four I-485 Transfer Notices today which says they transferred our cases to LIN. My I-140 was approved from LIN, so this is ok.
But the strange thing is both the Receipt Date and the Notice Date is September 26, 2007. Should I be worried?:confused:
I also applied EAD and AP. Would that means CSC is sill holding back my EAD and AP applications for adjudication?

you might also need a copy of your approved Labour application.
I am not sure if you can get the documents directly from the UCIS becuase the documents belong to your employer and not you.
you can try through Freedom of Information Act(foia.com). but it might take a while to get the documents.
All that is required is only I-140 Approval Notice. Labor Cert is not required.

The company I work for in USA has a India Office.
That office paid the exact NEW fees through HDFC.
They then couriered the HDFC receipts to my home in India.
I arrived in my city.
Went to VFS office, submitted the required doc's.
They created the courier package which is used to send the passport back.
After few days I went to the US consulate as per my scheduled appointment.
I use the VFS lounge service which helps because I had luggage etc.
It was quite a smooth process in Mumbai, except that it took 2 hours of waiting.
My 9:30 appt actually happened at 11:45.....
But yes, there were many many people who had demand draft's in their hand, either of full fees or the difference.....

As per the current guidelines adjudicating officer makes the determination based on Department of Labor SOC/O*net code in the Labror Certification Application (ETA 9098) form. ( It's very critical to have a copy of LC application, before considering AC21. If you don't have it through employer, you can get a copy from DOL through FOIA request )

Thanks gcpool for your reply. My question though is that is it pretty much guaranteed that the green card will come through after the 140 clears? I ask because just today the USCIS website updated to say that they sent out a RFE for our 140.
The risk/reward matrix for my situation is as follows:
Stay in USA/green card comes = most assurance of good job and pay.
Go to Canada/green card denied= harder to find job and less pay, but at least not deported.
Go to Canada/green card comes = I'll survive, but there's the possibility that I'll be kicking myself for a long time.
Stay in USA/green card denied = I'll probably jump off a building. :D
So you see it pretty much all depends on how much assurance there is of getting the green card after 140 clears.
