Sometimes I think that rather than writing to these politicians ,we should write to USCIS.This retrogression is caused by them.They didn't wait for any bill to be passed for this retrogression.There is no use of talking to politicians,they don't care.
I know that USCIS will not care either but USCIS did it out of nowhere ,till sep2005,everything was fine for them and suddenly in oct 2005,they put us in backward direction.Now after a year and a half ,we are at the same spot,waiting for the visa bulletin and staying depressed for a day or two after seeing it.
I don't know .I am so mad at everybody.

Btw,i have already sent emails to USCIS and chicago tribune regarding this .

yes, my I-140 is approved. If your old employer revokes the I-140, as part of the processing of that revocation the USCIS *might* issue an RFE or NOID asking you for an updated employment verification letter. Per my attorney its more likely that USCIS wont do anything to the 485 right now, but will check the status of the I-140 while processing my 485. As part of preadjudication it might happen earlier, but also possible that it will only happen when my PD is current or almost current (July-2006/EB2/India). At that point we should get an RFE, and thats when my attorney plans to inform USCIS about the AC-21 change of employer.
Just a quick question:
My employer had legal dept and lawer filed G28 form for me when applied for I-485. Do we really need to hire a lawyer to represent us? I am planning to move to client under similar job description this month end and would like to see if I have to file AC21 and change the lawer representation.

Yes. my I-140 is Approved and 180 days has passed. How much time will i have to transfer H1B without loosing H1B status? Thanks for your response.
For H1B: use your vacation time to be associated with your current employer for as long as possible, try pay without leave if possible. No hard and fast rule how much gap is allowed. In principle, there can be no gap but lawyers claim 10days, 2weeks is okay. USCIS asks for recent pay stubs to check for gaps.
You are in much better shape with >180 days in AOS. Can work in EAD if needed.

As per USCIS official report as of end-August, there were more than 500,000 pending AOS applications:

My apologies, I thought I was making a point. The point was trying to see and realize that if USCIS was behaving with us this way it is, what would happen if it was a product selling company ? Could it do the same to its customers ? Could customers tolerate it ? Could USCIS have survived ?

Hi,
I got an email saying "we mailed the document to the applicant" and it says the same thing on my uscis protfolio.
I would like to know if this means the case was approved or is it some other document being sent.
When they approved my EAD, it clearly said "Approval notice sent".
When they approve a case then status clearly says 'Case Approved'.
The email "we mailed the document to the applicant" may be anything or nothing, like if they transfer ur case to different service centre, they send a notice. Some time they don't send anything even though the email contradicts it. Keep checking the status, they might update it later if the case has been approved.
Also, for AP keep bugging ur attorney to see if they got it. For EAD, make sure your mail box has your name clearly, otherwise they won't deliver it.

I don't think there is any problem in EAD approval if you go out of country after filing it. I left USA the very next day of filing I-485. Still out of USA (in Canada). I already got my EAD and am waiting for AP. My attorney also said that for filing EAD, AP, 485 I must be physically present in USA.
Just to be safe maintain your H-1B status in case there is any issue with AP (because of what murthy's firm told). I can update on my AP status as soon as I hear something.

i dont think the congressional call will help us. all they will do - the congressman's office is just talk to them on our behalf and give us the information. that is what i gathered from them. but there is no harm in trying it out as long as we dont have a problem attributing our luck to the congressman's efficiency (god only knows if their calling might have helped or on second thoughts may be even god doesnt know - come on it is uscis - they always amaze any one and everyone)

A few days I called Comcast to disconnect CNN and CNN headlines from my cable. The Comcast representative was surprised as to why I want to cut CNN. She transferred me to her supervisor. The supervisor noted down my complaint and said that he will get back to me in 3 business days. Next day I got a call from Comcast that they will block CNN entirely from my cable. I thanked them as I will not have bigotry coming into my house anymore.

some one gave me red and said that " where were u when all the EB2 guys were united together against EB3" my answer is that moron EB2 guys were wrong too they were jumping when bulletin moved forward in their favour, now see the bulletin every one is there where they were before... so we have to be united in all the situation and fight for retrogession

While the USCIS may use the description of the job duties from the DOT or the O*NET to determine similarity in jobs, they have verbally agreed that they may be willing to consider a broader definition in the future. Besides job title and description, the salary from the new employer would at least need to satisfy concerns regarding the public charge provisions and should be as closed to the amount listed on the labor certification as possible.
Clearly, the law before AC21 was passed in October 2000 required that a person continue working with the employer that sponsored the green card for at least 6 months to 1 year after obtaining the green card. Although AC21 allows the changing of employers if the I-485 is not adjudicated within 180 days, there is no change in the law with respect to the intention of the employer to offer and the employee to undertake "permanent," full-time work with the sponsoring employer for the job advertised. Keep in mind that a green card job offer is legally considered a future job offer. Therefore, the employee must have a good-faith intention to work for the employer after the green card is approved, and the employer must have a good-faith intention to employ the employee after the green card is approved. Even if one worked for the sponsoring employer for several years while pursuing the green card process, that would not count as future intent. Generally, 6 months to 1 year after obtaining the green card is a safe time period to change employment. Failure to stay at the sponsoring employer may result in problems at the naturalization stage!

One of ways in which you can make the lawmakers realize the seriousness of the issue of EB relief is by telling them about it in person. They meet tons of other people every day and hear about many issues that are just as important to the others who meet them. So to convince them of the urgency, IMHO, we all must go to their offices and talk to them. That requires you to take some time off from your schedule. Many of us have already met lawmakers. Join your local chapter.
Can we have
1) links and pointers to background material and other things we could study, so that we are on the same page, and can educate ourselves on what to ask lawmakers/public
2) a presentation/paper, so that we have the same, the best, and the most presentable message.
If this already exists, and I just haven't found it yet, I apologize....

What you are advising her/him to do is lie to USCIS that he/she is sick when she is not. This is on the same lines as doing what those guys behind bars did, brining people on H-1B from India to the US without actually having a job for them.
Again, its people like you that is giving genuine legal immigrants a bad name, and putting us all (including yourself) in the LONG immigration queue!
I see that you have written letters and participated in other campaigns. None of those will materialize if you're teaching others to missuse the H-1B system. How hard is it for you to understand that these are the kinds of loopholes because of which we are stuck with no visa numbers?

The reason the DESI body shop companies got raided and charged are because they
1. filed H1 from IOWA because they knew that the wait period was few weeks and then used those.
2. They used faked/forged documentation to do that, not one but probably hundreds of cases. You dont get charged with mail forgery etc for nothing
3. They used those H1's to employ the candidates in other areas which beats the LCA from IOWA since they got certified from IOWA DOL that jobs aspirants of that nature did not exist in that area for the salary they were getting paid..
You sound as if you want that guy to leave everything and go back to his home country because he has lost his job. I BET if you were in a similar situation you would do something like that and dont be pretentious about it and be a hypocrite. If it becomes untenable for the person to stay any longer here without the project he/she will leave anyway.
I have just pointed out a way to get a reprieve for few extra days and its not going to cause a 6 year backlog in your dates.. so chillout

This news was actually long coming. Right after USCIS announced I140 Premium filing, they said they would consider to stop concurrent filing. This is U.S.; they are looking to mik out more $, so here you go....pay premium for I140 and feel "free" to file I485. I think that's the basic idea; lots of extra income for USCIS.
