"Well Established Visa Requirement"....are you kidding me? It's not only about the visa requirement but the treatment that you get from those morons at their airport. Read the heathrow experience which people have posted and we are not making this up.
Tell me this...You are going to your home country via london where your plane is only going to land and probably refuel and you can easily be asked to remain in a cordonned area where you cannot go out of the country. How in the heck can you think that person is going to step outside of the airport and sneak into their country. Don't you think that asking for transit visa from the passengers of the plane which is only going to touch that sacred land to just too much. Ok...we don't mind that...but atleast be courteous. What is the reason can you think of another stupid security checks plus asking passengers to stuff their personal hand bag in their cabin baggage where clearly this is allowed for the passengers.
This does not make any sense unless you reason out that with other possible reasons like race, color etc etc.

It is not confirmed yet whether they would consider all of the 12k towards the decision for the May Bulletin or not.
They might want to disperse the 12k numbers in the subsequent months, if they try to be a little conservative.
This is a very simple calculation. Following are the numbers before Oct -2006. These total to ~ 12K.
EB2-C - 3521
EB2-I - 9345
The dates will move further if more than 12K numbers are infused into the system. I would say that the dates should be in Oct - Nov 2006 range with these 12K numbers, having Nov as buffer as they may issue RFE's to folks.

People go by "how the wind flows" - when they just see a few of us stressing out they think they must not do anything - simply because they think wind is not blowing. Unless people believe in themselves and have the capabilities to make right choices and independent decisions, they will always be influenced by "negative flow". This is something we have always been facing in the community.

Yes, I do agree that we should have some sense of personal responsibility and that is why the middle way is to rent out the house (probably at a bit lower price than your monthly mortgage) and pay the difference from your pocket - if you have to absolutely move out from the house. But, can somebody answer my question above..........why is the same house (not even a brick changed) being appraised at around 100k lower than it was done 2 years back, by the same bank??

The very people tossing aside ethics are the ones who used good faith based credit system. Now suddenly it is all Capitalism, Greed, Bank's and Lender's fault. Whatever happen to personal responsibility ?
All those suggesting foreclosure are forgetting one thing: The pendulum has shifted and the same capitalism that supported the reckless credit is now going to choke it off. You don't want to be on the wrong side twice !!!! The thing about free markets is they adjust to new realities long before people do.Before you know it the easy walking away (or foreclosure) might become the biggest mistake while buying house might be distant second.
In the meanwhile please don't shoot the messenger aka sledge_hammer. If you read his posts he has given the best advice with a good dose of much needed reality and sound language. If you are hostile towards him you are simply in denial. The longer you stay there the harder it will be to cope with the new realities.

You will earn it back but you can't undo foreclosure and whatever comes with it in terms of personal memory, your credit and things in future that you can't foresee now. Do the right thing it will only make you stronger and someday you will be able to tell your kid that you did the right thing in the face of adversity and eventually not only survived it but thrived out of it.

Hi
I have a approved i140 with priority date of Dec 2004 EB2. My spouse has approved i140 with priority date Mar 2006 EB2.
Since it is not recomended to apply 2-1485's we decided to settle on mine. But then, since we both have our H1's for next 3 years, we don't want to use EAD and AP till the final process of GC is done.
My question is should we apply for EAD and AP or not. This question exists in the questionaire given by my employer.
Please advice.

yes, that is our line of logic and understanding. But seeing the number of experiences what we are having in real world, this does not seem to be applying. You are rightaway asked about your work status and they insist till you give them "specific" word - either "GC" or "Citizenship" or "EAD"... If this would have been the real way ( I and all of us wishes that) the these recruiting guys may not dare to insist till you spit the speific word out and that is before interviewing. In my experience, I always had verbal conversation. I have never been sent an email or letter by any company yet regarding their refusal not to even interview me based on EAD. Verbally 5 companies have starightaway told me "they are not considering me as I do not have green card yet - EAD is not enough". My thinking is that they do this because somehow some law may be covering them, we do not know that but they know that, perhaps..:confused:

Are you just assuming or have you actually tried to find out if there is indeed some law which allows employers to not consider a candidate solely based on the fact that he/she has an EAD as opposed to a green card? I can certainly understand that you don't want to get involved in a lawsuit and pay lawyer fees when you can easily find another job. But its not that difficult to contact OSC.
Having said that, I do understand that the employer can find a number of reasons to not hire somebody and all that would be legal. But here we have a case where you have 5 companies who have refused to consider you solely based on your immigration status. Somebody earlier has this in writing from Capital One.
I urge you and anybody else who has gone through this to find out more about this by calling the OSC's hotline. (http://www.usdoj.gov/crt/osc/htm/engperliwdiss.htm) If I were in your situation, I would at least want to find out what my rights are, what is discriminatory and what is allowed by law. Call them and simply explain that you believe that you were not considered eligible for a job because you have an EAD card as opposed to a Green Card.

I doubt the USCIS has any rules regarding processing queue. Some people are waiting 10+ years, others receive approvals in 2 months.
My understanding on this is - after I-485 uscis works on RD and if your FP/NC is cleared PD is looked at for preference in each category but uscis won't wait guy stuck in nc for 10 yr to make way for your gc. If you are lucky you may get it sooner than you expect

I am an ex British Airways employee, and I spent one year in 1997 living in London city. Please understand that the level of customer service one gets in USA, is just a dream in UK. Mishandling customers, showing a complete arrogant behavior, and a total disregard for their basic customer rights are just a few business traits in UK. I witnessed couple of BA strikes at Heathrow, and beleive me after what I saw, I will never travel with any british airline in future. You are lucky that you just saw a tip of the iceberg and came to your conclusions. It starts from their embassy, and continues throught the airlines, security checks, baggage handling, staff etc.
I like your comments about Koh-i-noor. If it was any other country, they would have happily returned it to the country where it genuinly belong. Oh by the way, during my stay at UK, I had to remind their couple of citizens about what exactly the phrase "Be British" means.

You are absolutely right. We visit Mr Oh's website several times a day to get the latest on immigration. We should credit him for being the first in alerting us about everything. If in fact USCIS comes up with a statement rejecting all aplpications filed after a certain date, I'm sure there would be thousands who would be saved by Mr. Oh's timely warning.
I dont know why everybody started to spit on ohio law firm. They just pointed out some news that they got from AILA, right? Lets hope its just a rumor and USCIS doesn't proceed with this revised thing. I am pretty sure that wont happen. Dont worry guys, but dont blame everything on ohio firm. I agree we might not always have hard evidence unlike the OP here. And lot of employers might be doing this. I have never faced this, yet. However, we have to act on it. The first step is to complain to the govt. Maybe if there are lot of complaints, govt will investigate and find the dirt, and fix it.
Another idea is to bring it to the attention of the job boards that discriminatory ads should not be posted. Lets give this a try.
To those effected, write to the govt if you are in a situation where you can.

work status, they do not communicate to have you spitted out specifics.
They call you. If you do not spit out, they would not go ahead. If you spit
out "EAD" smart ones do not even talk further and you find all
communication stopped. Now this is my own experience. Tell me how can
I convert this into "evidence of discrimination". Even if I have tape
recorded conversation, that guy did not utter any single word after I
spitted out "EAD"

We have plans of visiting Canada in November. My card had a data entry error because of which I have to apply for a replacement card. It can take 3 months for that.
As I have no other proof of permanent residency (as I have to return the card with error), alternative is to get the I-551 stamp on the passport that is valid for 1 year. It works as a short term replacement of the acutal card.
What is this I-551 stamp ? Is stamping that mandatory ? What kind of documents do you need while you go for this stamping ?
If one does not plan on travelling until we receive the physical Green Card - would we still have to do this stamping ?

Right now I am getting removed from my project as one of the top 3 Indian outsourcing firm is dumping their L1 resources at my client site and replacing all the citizens, GCs, EADs, H1 etc. These resources are used in projects managed and controlled by my client (most of them are consulting assignments) and these resources are used on java/.net/oracle projects, these two are violations of L1 visa restrictions set by USCIS, I want to know how and where to complain against this violation and we have all evidence to prove the same (project documents, time sheets, work assignments etc). Please let me know exactly and to which agencies we should complain.
