Hi Friends,
Myself and spouse got the GC last month (09/05/2009) and my kid's case was still pending. Today I received CPO mail for my kid.
My kid's RD is July 2, 2007 and ND is November 19, 2007. Actually my kid's 485 was rejected and then reapplied during July 2007 due to old fee and new fee confusion, though I have provided actual fee. That's the reason for my kid's ND was nearly 5 months apart from the RD.
Here is what I did:
Took couple of infopass and numerous calls to Customer Service. Nothing did work properly... Getting same old replies - like, need to wait for 3 months etc... And last time when I took infopass, I requested the IO to expedite the process as this is a small kid's case and more over parents 485 approved. So IO got convinced somehow and expedited the case. After two weeks, got the magic mail.
Best of luck who are still waiting...

They did this to try to avoid the tide of cases expected in July. Each green card approval uses one visa number. If the numbers are all used for the year, then the DOS will issue a revised Visa Bulletin reflecting "unavailable" in the particular category or categories.

The most vulnerable categories, of course, are those that are typically the victims of retrogression: EB2 and EB3 for India, China, and (potentially) Mexico. Can anybody tell me what do i need to put on I-765 , Q11, as i am not able to rely on my company's attorney.
11.Have you ever applied for employment authorization from USCIS?

it says that you need to put yes and have to attach all the previous 797's.
But my attorney says that you need to put No. Only those who applied for EAD earlier have to put yes (Which i feel not correct).

Did it suggest lots of denial rate on 140 (especially Eb1s)? And it is deterring 140 filing since Jan.? I believe all those lawyers, and bodyshops realize it.
Neither the denial nor the approval rates are significantly changed. However, the receipts have fallen. Look at that as many universities and private companies not hiring teaching and research specialists. So it seems like the economy is the deterrent.

worst case? yes.. it's mine..
My H1 revalidation appointment was on the 12-Dec. Visa was approved immediatly but haven't received the passport yet. I receive the same response when I call.. that its under PIMS verification. No ETA of when I can expect it to be done..
I had a H1 transfer to a new employer and 3 year extension happen at the same time. I am not sure what the problem is and what I can do. I am totally stressed out and really depressed ..
If someone has done something thats helped their case move along.. please PM me or reply to this post.. Thanks !

DOS has publicly admitted that they made a mistake in the past interpretation and allowed visas to flow to EB3-ROW and EB3.
Do yo uguys seriously expect DOS to start making the same mistake they publicy apologized for a few months back?
We all talk about staying united.. but if EB3 folks are going to get together and start asking DOS to unfairly divert visa numbers away from EB2 (mostly to EB3-ROW... numbers will run out before EB3-I even sees it), how are EB2 folks expected to just sit and watch?
How can we stay united then?
What would you do if your blood brother was in EB2 while you are in EB3? Would you do the same?

When he was noting down all my info, I mentioned about LUD on my I-140 (approved) for 8-5-07 and he said.. it does mean anything since they still need to mail applicants receipts no matter what stage is your application is processed under.
Sent my application on Jul 2nd by 9:01 to NSC. Checks not cashed yet. No updates of any kind !!!! Want to find out if anyone else in the same situation. Thanks..

CADude and others... maybe your efforts are paying off. What I learned in this process is that have faith in your application filing. If everything is fine you'll definitely get the receipts. It may be either next week or in 2 weeks.

These 2 folks SunnySurya and Rolling_flood attacked me with RED points because i said the truth on the other thread of "Lawsuit for Porting/Interfiling". Though i least care if someone anonymous gives me Red points but i'm worried about them.....
This is what i wrote in that post which was attacked , what's wrong in it ... Try to digest the truth SunnySurya and Rolling_flood - you can't scare folks like by words of Lawsuit....

Lot of our case was exactly like that - i was eligible for EB2 when my Eb3 labor was filed. Employer took advantage of my compromising situation ( H was having 390 days juice left)
If Porting/Interfiling is taken off folks like me will be terribly victimized. I'm here for 9 years - my 1st labor was substituted , 2nd labor ( which should be Eb2 but filed in Eb3) took a round trip from Phily backlog elimination center and now i'm stuck in the Eb3-140 mess at NSC

I would like to think that by now DOS combined with CIS probably have a good estimate of the spillovers based on historical trends, current demand, pre-adjudicated cases, existing I-140's and porting cases. Assuming they have this data and the current availability of visas including spillover for 2011 as someone pointed out they might take the dates out towards 2008-2009 possibly since the CP cases are also coming to a close. Hence they could open a 2 year window so that the pipeline can move consistently instead of opening the pipeline by making EB2 India / China Current and flooding the system causing endless delays.
I think most of us ignore the CP cases which DOS/ CIS has to ensure has a full workload possibly explaining the NVC updates of fee requests-
I would bet that whatever they do they will work together with CIS is to ensure that workload with CIS and consulates all around the world is maintained and if anything a smooth consistent pipeline is also established for the future- this is just a guess- most of it is anyways.

Second: They will laugh at you (that's what is taking place. Instead of accepting the mistake and offering an apology, USCIS has only issued a statement about forwarding flowers to Army Medical Center)
Third: They fight with you (I guess that's what they are gonna do in the court)

"Anti-Discrimination Notice. I recently purchased Vonage. Had to call vonage customer service for installation. They gave very good service and I could connect all my phone and then called India too! Voice was excellent ( I have verizon DSL line).

OK....wait till next week for an outright refusal on EAD.
once that happens.....explore the option to file suit......
they first stated that they had instructions from their legal team that they have too much hassle with EADs causing problems, so they dont hire ppl with outside EAD. When I asked them to reconsider they said I dont know for sure, lets see what the legal team says.
It seem to me that this hr person did not make up the refusal on their own, but had previous precedents to go by or had been given explicit instructions.
My fear is that they will come back with a clearer explanation of why they cannot offer employment based on the EAD.
I am getting really really upset about this. If I had known about this EAD refusal thing I would not even have gotten out of H1 and would have continued to work...
