I talked to SR and he said that unless I have crossed 90 days , he can not open SR for 765 application. How did you convince him to open the SR for you ?
THe rep. herself offered. I asked her do i need to wait 90 days she said its ok, as they also take some time.

What is the advantage of claiming trader status on your tax return? I buy / sell shares on different days of the week (example: Buy on Monday, Sell on Friday). Does that make me a day trader?
I am doing this on H1B. I do have approved EAD.
while on H1-B status, one can do intra day trading in stocks, options, and/or futures, he/she can NOT claim trader status on federal tax return. Person on EAD can claim trader status and claim some trading related expenses to save tax on it.

This is not a bad idea. But having to wait 5 years for your citizenshipis is only a minor inconvenience compared to all the other more pressing problems we have right now with the retrogression. So I think we should be more concerned with issues like visa recapture, getting USCIS to be more efficient so the visas will not go to waste each year etc. If we can get all these things acheived then your suggestion would be a nice icing on the cake.
I was wondering if any one in the core or other members think about the next step towards getting citizenship after passing the hurdles of getting the green card. If a person is here for 10 years and then get his green card (average period), then he need to wait for another 5 years to get the citizenship. 15 years for this process in a person's life is too much.
IV Core can push or lobby for a law which can make the person a US citizen, if he is living in US for 10 years legally without any issues and paying taxes for the entire period. It is just my idea.

Agreed, It is very unfortunate for people stuck in backlogs and I feel your pain... But would you rather have seen USCIS waste over 40000 visas by the end of the year without any PD movement (as reported by some on this forum)? We would have had another thread here blasting the inefficiency and unfairness of USCIS.
Bottomline, I would not like to work in USCIS right now.. They are basically damned if they do, damned if they dont. That said, I do hope that BECs get their act together like USCIS is trying to and get everyones labor cleared by the deadline before the next retrogression hits.
I mean even if some of guys had their PD current, USCIS did not approve the I-485. They said that all the I-485's are preadjudicated but did we see flood of approvals....? NO... Hello,
My cousin H1-B has been selected in the lottery, so her H1-B is in process for this year, but her husband's H1-B was approved last year, so he is planning to get H1-B stamped and come here. If she waits for her H1-B to get approved and come then it will be sometime the end of this year. Is it possible that she can come here on H-4 visa while her H1-B is still in process? Need urgent help on this. She has never been to US.
She can come here on H4 while the H1 is in process, but when her H1 is approved, she must go back to her home country and get her stamping done to get the new I-94 at the port of entry.

I know some of you may have concerns about the distances at the three events we have picked so far. If you are new to walking/running, this would be a really good opportunity for you to start training with the support of Team IV members as well as two personal trainers who are going to give us support and feedback on a weekly basis. These trainers are doing this for Team IV for free, to help our Team. So we should really take advantage of such a bonus feature.
Starting your walking/running goals by attempting a 5K is a very good target to aim for. A 5K is 3.12 miles and you can walk this distance at a moderate pace, no not race walking, just a moderate pace in 45 mins. So this is quite a do-able distance. Also, you can train to jog or run the 5K in as little as a 6 or 8 weeks. Once you sign up with Team IV, we can provide you with more guidance. We have got the support of a couple of major names in the walking/running field.:)
So come on, join Team IV and lets get this ball running, or jogging, defintely walking.

Based on past experience i feel that people will cling to a false hope and make assumptions about getting their GC's. My primary concern is people will stop making efforts to push for recapture or any other relief. The spillover rules are such that EB3-I will not get any additional visas till 2012 (at the earliest). Who knows what the stituation will be then.
We should also be debating why the PD for Mexico EB3 is higher than India when they have more people in the queue before their PD. I would take the numbers with a grain of salt or at the least not forget the past... as someone said if we dont learn from our history, history will repeat itself.

Just checked USCIS.gov. Both mine and my wife's I-485 were approved.
"On May 5, 2011, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service at 1-800-375-5283."

Started new process with same employer in September 2010
Applied PERM in Jan 2011 and got approved in 10 days
Applied I-140 in April 2011 and got approved in one week
Priority date recaptured and I-140 has the old priority date (Sep 2004) and same A# as previous one
Opened SR with USCIS on May 6th 2011
Informed customer service that my Priority date is outside normal processing time
Received an e-mail after couple of days "There are no visas available to process your I-485 application. Your priority date is EB3 September 2004 which is later that the cut-off listed on the visa bulletin for your preference. Thank you for your time. This inquiry will be considered closed."
Replied to the USCIS e-mail(tsc.ncscfollowup) attaching the I-140 copy and asking them to upgrade my case from EB-3 to EB-2
Got the magic e-mail on May 17th 2011 and also reply for my e-mail

Called most of the listed numbers, most of them were aware of the phone campaign going on. Few of them insisted that they do not entertain calls from other states but the rest informed that they will convey the message to the representative.

I can tell you my experience. Back in 2003 when my company was applying for my LC from MD, I explored the possibility of filing my LC from other states where the backlog wasn't huge. I was turned down because the company was not willing to write a letter justifying why I was staying/working in one state but was applying for my LC from another state.
Maybe this isn't an apples-to-apples comparison with your situation, but if it helps...
