The AP is truly an amazing conundrum. I will try to clarify.
1. When AP is filed, you need to be in the US. No if's and but's about that.
2. If AP is used at the border for entry, it DOES NOT invalidate your H1. Only using EAD to switch jobs does that.
3. Lets assume you have an AP valid till Jan 1. You apply for new AP on Oct 1. However, you need to travel on Dec 25. Now there are two scenarios:
3a) you return on Dec 30 - you can use your old AP as it is still valid. The fact that you have applied for a new AP and left the country DOES NOT abandon your new AP because your old AP is still valid.
3b) You return on Jan 3 - You need to have the new AP in hand.

Cause i had asked this question on this forum and i was informed that when she is travelling to India she must get the new AP approved, i cannot send it to her via mail

Well, they knew very well that they need to honor the DOS visa bulletin and accept cases filed in July. What did they do instead?

I got your point and that of logiclife's and I agree....there is no need for them to mention the illegals (a cheap attempt on the part of WSJ). I was merely pointing out that WSJ technically does not say that we (high tech workers) are illegal.

1) should I invoke Ac 21 ??-- I am worried that the EVL may not meet USCIS needs as it may not be fully detailed
2) The other option I have is to take a leave of absence from my present company for one year and start working for the new company? IN this case what happens if I get RFE for EVL ? Which company should I say I am working for present or the future ? Also If I do take a leave of absence should I send in AC 21 paperwork or no?
PLEASE HELP I am very confused--- I strongly feel that the leave of absence might be an insurance policy but I don't know how to approach it !!
There is no such thing as "invoking" AC21. Its a law. Most important thing is, your I-140 must have been approved and I-485 is pending for more then 180 days....you are Free to sail in the same or similar field.

Two of my friends relocated to India since the beginning of this year after spending 8-9 years and they had green cards too from 2004.
These guys had good jobs with a good pay but options in India were just much better to ignore.
Just food for thought for people who think that only in US can we make or break our life and careers. There are other places on Earth too where people live and be happy.

contacted congresman's office when PD become current for more than a year but no approval. Got responce that it is pending in extended review.
Left Company B to move South side because of health issue ( winter) .
Company B understood the situation and left in good terms with them.

I did not change attorney in file from company B for I485 .
Called companyB attorney on 2/5/10 and they did not even know that I left companyB .
They said they have not received any communication about I485 and they can deal with me for my 485 directly . they said they will call me once they receive the original letter (not suer wheter attorney get it or myself get it ).
So this is where I am standing .
So if my original sponser ( company A ) revoked 140 , should it not say the status denied/cancelled etc at that time ( 2-3 years ago) ?
If I had known that I would have shifted from companyB or would have looked for a H1 transfer. ( Just my lack of knowledge) .
Hopefully it is a string Ac21 mis-understanding issue. otherwise I may have to look for a H1 tranfer ( pain again)

EB migration was a added almost as an after thought to the family based immigration bill. Current or future considerations were not taken into account when they wrote the bill, the prime focus was (is and will be) the family based immigration as they get the most votes, they have the most 'heartbreaking' stories. I understand your point. I also dont want to argue about how USCIS distributes overflow. I have been dealt a hand i am dealing with it.
I do want to say that nothing will happen unless you make efforts to make it happen. We need to talk to the lawmakers about our problems. Half of them still think we are talking about H1 and launch into a spin about outsourcing. The H1 lobby has major companies backing them, anti immigration groups are flush with cash and are very vocal. Hispanic caucus is a big group. What about us, do we just keep discussing issues or try to educate people on our problems...if we dont we will stay a minority with no voice, simply pawns used and abused by others.
As I see, most of you are missing the point. Instead of trying to understand, you showing the maturity of mind. The whole purpose of EB immigration is to meet the Demand(Job opportunities) vs the supply(immediately available candidates).
When there are a lot of opportunities exists for EB3 level(skilled profession) and less opportunities exists for EB1(Ph.D/Executive Director), USCIS should give more no. of Visas to EB3, then EB1.
A country cannot be built with only the kings, and not even a home can be built with only Ph.Ds(Nobody do the dishes).

I first immigrated to Canada, got my citizenship and then came here to the US and am languishing in this stupid GC queue for the past 7 years..
Inspite of all the freedom to go back to Canada, I would now, rather move back to India than any other place...
Forget the little hardships in India..what matters is that India's IT economy is booming...booming like probably no where else in the world!
Why not, go back there, repay the country that gave me all the skills in the first place, and at the same time participate in that booming economy?

We are working really hard to get our amendments in. Please understand, we are not doing this for fun. We are into this just like you for our green cards. It would really help if we get support instead of having to answer the same questions over and over

But again, we are going full steam with this as it means as much to us as to you. And remember, we are a voluntary non-profit organization. Before you start doubting anyone here, remember, there is no gain for us doing this.
I am not sure if this satisfies everyone, but WE ARE WORKING ON THE AMENDMENTS CURRENTLY.

I ran across this article in one of the websites and read through all the links. I think, there is a strong message in this case, something I have personally faced in the past and do still face at at a smaller level. Though it is not an attempt to help raise money for her.
