    It would be good if more of you PhDs visiting here would post and share your ideas about what we should be doing to further the PACE amendments agenda. Regular posting by you and others will bring up new ideas and more importantly, keep up everyone�s motivation to see this thing through. Once postings and interactions reach a critical mass, things will pick up momentum which will see through the completion of our agenda. So please register with IV and post here, and also make yourself aware of the broader goals of IV and how you can contribute to it.
    Your ideas and posts need not be rocket science (although some of you might be rocket scientists : ) , but just a few words of encouragement or organizational ideas or just about anything- this will help and motivate others who come here. More postings will encourage still others to post and things will pick up momentum. This thread has had 654 page views but only 1 response!! Those of us who know about the S1932 bill and the campaign to get it passed in December know how effective a forum the internet and a site like this can be. Calling or e-mailing among ourselves cannot substitute the public reach and penetration of the internet, so its imperative that we keep this as the primary forum for information exchange.

    how is it determined how long the EAD will be renewed for? If there are no fees associated with filing the renewal, then it probably doesn't matter.
    Its the courtesy of USCIS and highlighting of our problems by IV made USCIS to issue cards for 2 years... there is no requirement that it should be as such... in general any EAD unless its L* is generally issued for 1 year with exception of C09-employment category where they are issued in looking at Priority date [ofcourse there are other exceptions like asylum... etc] if they dont get biometrics from their repository at the time of printing , they waive some of the features like fingerprint, signature etc.

    The time frame depends your infopass location. I went to DC USCIS Service center. I get appointment in 2 weeks.

    select option 2 (You are a new Permanent Resident and have not yet received your Permanent Resident Card)

    Infopass appointment letter, 485 approval notice and your passport is enough to get the stamp.

    It takes hardly 15 mts for me to get the stamping in the passport.

    Do you have your I-140 approved and if yes, have you passed 180 days since you filed your I-485? If answer to both the response is yes, then nothing to worry about as you can simply work on EAD.

    If you are still considering transfering H1-B, start looking for a company immediately. Small India companies who do H1 transfer can be little helpful in your scenario but watch out for crooks.

    Yes. my I-140 is Approved and 180 days has passed. How much time will i have to transfer H1B without loosing H1B status? Thanks for your response.

    Did anyone read the OP's post or the newsletter before they decided to bash him/her for "advertising" Ron Gotcher's newsletter?

    All the OP is trying to do is direct people to information that might prove helpful.

    And the newsletter has articles on issues besides visa bulletin predictions, so not everything coming out of Ron G's mouth is speculation.

    I read it, and I found the H1B vs EAD article particularly informative, better than any of the other EAD vs H1B articles I have read in the past.

    She says that only H1B expenses should be paid by employer. Period.
    I have written a check to USCIS for my H1B application fees.

    It may be possible that the rules changed after I wrote the check in 2002.

    Notwithstanding the good research below...

    Section 201 of the Immigration and Nationality Act (INA) sets an annual minimum family-sponsored preference limit of 226,000. The worldwide level for annual employment-based preference immigrants is 140,000. Section 202 prescribes that the per-country limit for preference immigrants is set at 7% of the total annual family-sponsored and employment-based preference limits, i.e., 25,620. The dependent area limit is set at 2%, or 7,320.

    Given this is legislation, I don't think rule changes can trump it. I don't believe per country limits will change. Besides, how is that a solution to anything? This is not an Indian or Chinese issue. It's a legal immigrant issue.

    past decade. Foremost is an exception for certain family-sponsored immigrants.

    as visas are available within the worldwide limit for employment-based preferences.

    Ok, so my PD got current (EB3 India). What next?

    1) I dont think I can expect that my PD remains current in the next Visa bulletin as well. The dates might retrogress again...right?

    2) When will they open my case for adjudication? Will it happen within the month of March? Will ALL cases eligble to be opened in a particular Visa bulletin month are GURANTEED to be opened atleast to determine the next step (like sending it to namecheck, FP etc ) for that case?
    (Dont tell me nothing is GUARANTEED with USCIS :) . I mean to a reasonable levels of the word 'GUARANTEE' ! )

    3) What further factors/queues/backlogs determine when a case will be opened for adjudication when the PD is current and I-140 is also already approved & FP done.

    4) Namecheck - The new rule of auto-approval/clearance past 180 days.....when does the 180 day count start from?

    --- Receipt date of I-485 application OR
    --- Date when the application is opened for adjudication following the PD becoming current for that person OR
    --- How can one find out what their namecheck status is? If we are past 180 days, is it safe to assume that we are cleared on Namecheck?

    5) Will anything at all happen in my case during the remaining of this month Feb? Like pre-adjudication of my case etc in anticipation of my PD becoming current in March (as you can see by my IV handle name....hihgly optimistic :) ) ....

    6)Should I be watching out for any LUDs this month or don't even bother until March


    I hope the other IV brethren who might have already got their GCs and other Gurus/experts on the forum can probably shed some light on these questions, the time lines/milestones involved etc

    I've been thru many jobs here, and none of the offer letters mentioned that the job would be "permanent" (whatever that means). It's especially not possible to have that written on job offer letters for contract/project-based jobs. In any case, UDCIS does *not* require you to mention that on your EVL.

    Why do you think that you are doing a favor to the country as a whole by buying a house. The fact is that you are really scared to get a mortgage and put money into a asset that may continue to its value in future. The reason you are not buying the house is weak heartiness to invest money and not the immigration scare, you were just looking around a excuse to let go the idea of not buying the house.

    Hello guys,

    My frustration is increasing and patience going down. I am strongly considering moving back to India. When planning the move, a few questions popped in my head the answer to which I am not able to find (yet); hence putting it out here.
    1. How can I inform SSN department or credit bureau that I am not longer in USA..hence no one can use my SSN even if it gets stolen? Is there a way to "lock" things down?
    2. What happens to 401K? Is there a IRS tax law that says because this guy was on H1-B and leaving..don't charge him the 40% penalty?
    2.1 After 40% in penalty and 30% in taxes...with the market beaten down...not much remains...wonder if it's even worth touching it. So if I decide to leave the money here in my 401K account, what happens when I want to withdraw it? Rather what is the best way to withdraw it?
    3. Any estimates on how much it costs to ship things back to India? I live in 2 bedroom apt..so have the usual stuff.....couch, bed, tv, clothes of many sizes, lots of kitchen utensils. Just an average...I understand things can vary a lot.
    4. PIO card has the passport number of my son on it...the passport will expire when he is five year old. So do I get a new passport number? If so what happens to the PIO card? Do I need to get a new one?

    If you are i US workign more than 10 years, then you are eligible to receive Social Security benefits when you retire no matter where you are.
    I dont think there will 40% penality after 30% tax on 401K when you withdraw funds. it will be total 40-45% from 401K if you withdraw before your retirement.
