The Schedule A Workers category has become oversubscribed for November and a cut-off date established to hold number use within the 50,000 numerical limit. It is expected that demand will bring allocations up to the program limit during November. Once the limit is reached no further allocations will be possible, and the category listing will be removed from future cut-off date tables.
A PD for Schedule A category is for those people filing under EB2 with exceptional skills in arts and sciences . We had a post recently. Nurses and PT's do not have PD's as they do not have to file Labor Cert in the first place.

DOJ does not ask congress to act. They directly give orders to executive branch that is USCIS in this case, based on their judgment..
Right on. DOJ can order the recapture.

The Employment Based Immigration section explains how they will make a task force to prevent illegal workers from being exploited. I don't see anything for legal EB workers other than this 5 year thing which will start counting after this law is passed.
It says 5 years preceding from the date this law is enacted. Does this not mean that they will look 5 years back from the date this law is enacted?
Also i do not see them say it is for illegals only...
I do not think they would make it easier for illegals than legal residents.
I am not very optimistic about this . But i would definately like to see this pass.

Popoye,
You have a little tricky situation at hand, but you'll be okay if what you wrote is true - Your employer will not revoke your pending I-140. Not only that, they have to be nice enough to respond to any RFEs that come for your case. they can state that the imimgration application they filed for you is for a future position.
Also, USCIS has a guideline about these cases. They are supposed to see if your I-140 was 'approvable' if it had been adjudicated within 180 days or before you leave the company, which I think it should be.
I understand there are some anxious days ahead for you, but If I had to bet, I would bet on successful result of your case in the end :).
Just make sure that your old employer doesn't revoke your I-140
BTW, when was your I-140 filed?
cheers
The following is copied directly from a USCIS memorandum:
"If the Form I-140 (immigrant petition) has been approved and the Form I-485
(adjustment application) has been filed and remained unadjudicated for 180 days or more (as measured from the Form I-485 receipt date), the approved Form I-140 will remain valid even if the alien changes jobs or employers as long as the new offer of employment is in the same or similar occupation.1 If the Form I-485 has been pending for less than 180 days, then the approved Form I-140 shall not remain valid with respect to a new offer of employment."
Looks like I-140 must be approved to use AC-21.

As visa bulletin is taking time, it suggests that somebody is putting some efforts in determining new cutoff dates. And they need to use up leftover visas. Hope to get a movement all across.

Hello,
i am lawful permanent resident. I want to bring my parents here permanently. I got nobody in India to take care of my parents.
When i was small, my parents took care of me. When i need them, they are their for me.
Now my parents need me. But i am not their for them. I feel very guilty and sad. I want to bring my parents in US. So i can take care of them.
How can i bring my parents permanently.
I know, i can bring them after i get citizenship, that is too long wait.
i just want to bring them now. So they can have good life with me. Anybody know, how can i bring them in US soon.
i saw some petition signed by many Indians for this request. Can somebody please go forward with this.
Current president will understand our request and help us. He is very nice and kind person. He loves family and his mother in law lives with his family. He knows values of grand parents.
Indians live with family, that makes Indian family stronger and less divorce. And Indian kids are well taken care by grand parents. So they are well behaved and best kids.
We need this permission. Please work together and get this permission.
I read this in a website. Is this possible? I want to explore all possible steps.
Please help.
God bless you.
Green Card for Parents - Sponsoring Parents for Green Card
Green Card Process for My Parents (Mother, Father)
An immigrant (also called a "lawful permanent resident" and Green Card holder) is a foreign national who has been granted the privilege of living and working permanently in the United States. Your parents (mother, father) must go through a multi-step process to obtain a Green Card and become an immigrant. First, the U.S. Citizenship and Immigration Services (USCIS) must approve an immigrant petition that you file for your parents. Second, the State Department must give your parents an immigrant visa number, even if they are already in the United States. Third, if your parents are already in the United States legally, they may apply to adjust to permanent resident status. If they are outside the United States, they will be notified to go to the local U.S. Consulate to complete the processing for an immigrant visa (Green Card).
you really want to take care of your parents or you are just looking for baby sitters.

Till 2007 that was how it was being interpretted and then suddenly DOS realised it should be by category and not by country of chargebility.
The earlier Eb1 ROW>Eb2 ROW>Eb3 ROW spillover is called vertical spillover
The current since 2008 spillover Eb1>Eb2>Eb3 regardless of country is called horizontal spillover.
However see in Horizontal spill over Eb2 India backlog takes of the numbers (14k in 2008)
In vertical spill over Eb3 India backlog takes the numbers(17k in 2007)
So either method wont help Eb3 ROW. Its a double whammy.
Thanks for the clarification. So under the horizontal spill over, how would they determine which category would get the visas first - EB1=>EB2=>EB3 : I or C or ROW?

Allowing people to file for 485, but not giving any GCs may be the plan.
Such a move do not bring much complaints from anti-immi groups. But this move will reduce the noise from people who have not yet filed for 485s. May be after getting EAD all those people will invest more in America.
This is maximum bang for the immigration buck from the USCIS/DOS point of view.
Ron says it will be current for a "brief" period. (similar to july 2007 fiasco ?)
It will be a good opportunity for people waiting to file 485. For people already in the queue, it may not make that much difference.

First of all learn to "conduct" yourself in public before working for the semi conductor industry. What is gulti mentality pls explain? Second of all you chose to come here with the constraints that were imposed on you, did you have the balls to question the immigration officer as to why your wife could not work? If you think this is hell my friend you are in for a rude surprise.
When you want answers for your question there is a method for asking it, pls follow that method and you will get your answers, there are more people willing to help here than you will find anywhere. Ranting about communities will get you no where, now apologize and ask your question, someone will answer.
Gulti mentality was something that guy(malibuguy) was talking about . Thats what i meant by Gulti mentality . I just started with a simple question "WHATS THE MOTIVATION FOR CONTRIBUTION(MONEY AS WELL AS TIME) FOR PEOPLE WHO HAVEN'T APPLIED FOR GC " !! Was that offensive ? I don't need answers for specific questions. I just need to know what IV is all about ? ? BTW, i have balls to ask anything to anybody if it makes sense(immigration officer is not making rules) .

Can you enlighten us what exactly is the so called mentality? oh well dont worry. We know what it is and it is your obtuse vision of certain community. Just because he does not think being on H4 is hell and just because he asked you to look around on the forums for an answer, you utter ethnic slurs and paint a whole community as one that lacks pride?? So much for your education and your work at the world's largest SC firm. If you read the mission or goal statement for a second on IV home page, you would have figured what IV is mainly working on. On the motivation Q, sitting at home itself is a motivation. What else do you need to get out there and work for a provision that will help your family and many others to come. you guys can work on the issue and get a provision that wil help your family and other families in the future from the inability to work or else you can continue bitching and moaning about how it is a loss of self esteem, which IMO is lack of self esteem. Choice is yours
Please stop hijacking the thread with useless ethnic slurs and equating H1 with slavery. Enough I guess you got the answer to your Q from the man himself and others too.

Zen, the point is very simple. If you believe in this organization and what it does then you will donate knowing that IV needs the money to lobby for you, me and everyone else who is part of the community.
Lobbying is a very sensitive issue and it is not always possible for the persons involved to give you daily updates. Rather disclosing too much before time can have the opposite effect with people interested in lobbying against our interest mobilizing more aggressively.
Also bills are introduced all the time and there is not always enough time to hold funding drives to lobby for and against those bills. Moreover lobbying with the congress and senate is an on going effort and will require resources anyways.
However if you feel you want to be in the thick of things and know everything that is going on, then I guess joining your state chapter and being an active member can help you get some additional info. I believe volunteering your time is a lot more useful for the community than only money and if you can do that, all the power to you. I for one try and make my contributions to help those guys who are taking the pains to do all the work which benefits all of us

Not sure why you would generalize all H1b holders as experiencing hell - I for one did not. Anyways if you take the time to browse the forums you will find the answer to your question.

Hi eager_immi, thank you for your reply. See here is the situation, let's say for very personal reasons, we cannot get married before Sept 2007, then, what are my options?
Thank you,
gc101.
As I understand it correctly, you have a very personal reason for not getting married before Sept 07. I have to say that in that case, go ahead and at least file for your green card, that way you create one more option of applying through family based, even if it means 6-7 years of waiting period. Ideally you would like her to come to states at least for 2-3 business days to get court marriage and filing of docs, but if thats not the case then this is your best option.
Thank you,
