I140 at TSC is August 26th. Several others and I have their July apps pending. Gosh, this concurrent crap without current PD is playing havoc in several of our lives..
What a nightmare and sad state of affairs.
I am in the same state as you are. This just sucks. First I got stuck in the rotten BEC for years and then, this happens. USCIS should be sued for playing with our future.

Shouldn't one believe in each and every one of these things for the fear that they might be true since no one can really disprove their existence? Again it comes down to probability. I don't think you're following it too closely.. every year it creeps up a few early 2005 months, becomes unavailable the last quarter then in October jumps back to late 2003

gcbikari, the link that you have provided is great, I just looked up a company and saw that the company owner got arrested last week, whom I would have joined. Man, he was doing a sugar coated talk when I was looking for job, and through out his speech he was talking only in millions, like we bought this company ABC last month for 20 million, and in walks in the owner of ABC Company with ragged clothes, really! man who has 20 million.

But one thin I enjoy is problem solving and this is one of the hardest out there as it is dynamic.
With Eb3 India the Horizontal spillover methodology kills most hope as there is the large Eb2 India backlog. In 2007(I think) the vertical spillover methodology was followed and Eb3 India got 17000 or so visa numbers. So with Horizontal spillover and no number increase I am sorry to say movement is limited.

What are the implications for software industries - if dollar goes down againest rupee?
a. Lesser profit margins for Indian companies which might result in cost cuts and layoffs;
b. Lesser salary for Indian software employees in India;
c. BSE will crash down to adjust to the currency changes;
d. Indian real estate market will go down as the NRIs will not be able to afford land prices;
e. Indian farmers will be effected because imported agricultural products and food grains will be cheaper;
f. American companies will not be able to afford outsourcing in India and will be forced to bring more H1b employees from India to develop inhouse;

For upper middle class, OBC shouldn't matter much since you can afford to enroll your children in private schools and have them work in private sector once they reach an appropriate age. If they are US citizens, they can come back to the US anytime for education and/or employment.
Talking of reservation and discrimination, what legal immigrants are facing in this country is not much different in my opinion. You can't even get your driver's license easily, let alone permanent residence. Most of us are here by choice even though we face all these issues in our daily life.

Looking at the Labor cert , it says "Masters degree" and NOT "Masters or equivalent". that might be the caused the I140 denial .
Any one had this situation before ?

Looks like a few people at USCIS know that some kind of masters degree from india with a 3 years bachelors unrelated to ones profession cannot be used in place of US masters. Did not realize that USCIS has some people who know the rules and play by them. If all USCIS people who approve these cases know about this and if lawyers stop justifying that correspondence masters degree is equivalent of US masters, bogus initial eb2 applications as well as porting could be stopped.

With regards to the fact sheet, I wonder if it might be useful to include statistics on how much labor/money the US loses when high skilled workers immigrate to Canada or go back to their home country after being unsuccessful in obtaining their GC? Perhaps such stats are not available, but something along these lines that highlights losses to the US might be useful in bringing attention to what we contribute.

i am not a lawyer but i think that when you pay a processing fees to apply for a privilege (drivers license, business permit, visa, green card etc) from the appropriate statutory authority (DMV, USCIS, Dept of Commerce etc) - the payment of fees does not make you the customer of the statutory authority - so to the extent that USCIS has not broken a law to discriminate against a particular set of applicants (class) - a class action may indeed have no merit.
However, if it can be proved that there has indeed been gross negligence or that USCIS has not followed its own established procedures, made commitments but not honored those, lied or broken the law of the land - then there may be a case.......
another angle is that if the law itself violates the constitution - there is a separate procedure to appeal against such a law (like may suits going on in state courts on laws related to gay rights) - however USCIS would not be party to such a lawsuit since USCIS does not make laws. one would need not only a good immigration lawyer but also a constitutional expert for a venture like this.

You mean to say sell US real estate for GC/citizenship? I don't see this going very far. I can see anti immigrants waiting for this one. Best is to lobby using aides of big corporations, developing relationship with lobbyists who already have connections, hiring lawyers, developing strong case, donations in election campaigns etc. All of this needs loads and loads of money. Are we ready to donate to IV and build strong lobbying group for our cause? That is the only way to change our current situation.
Sending flowers, sending pizzas, sending all these proposals will only fall on deaf ears. Congress understands language of money to pass laws, Rest of the country/orgranizations understand language of laws/court.
For those who think assisting US economy by buy houses (for pending GC applicants) is like selling a GC are just plain dumb! No wonder why we dont have a resolution to the 10 yr waiting that's been killing EB immigrants, is because ppl like you, who love to take pain want others to live through this for the lifetime.
People have been waiting for 10+ years here waiting to get GC, waiting patiently, waiting so patiently that we are getting mentally sick waiting and waiting. How do u think the quota system is ..its not fair in the first place for EB immigrants when we are already here on H/L visas... .
