I applied for FOIA on my 140/485 petitions and I have got scanned copies of the file. It took more than an year to get the copies.
To my surprise and disappointment, 140 approval notice was not included in the copies they have sent.
When you file FOIA, that what you are supposed to get. If you want the approval notice you should have I-864. FOIA, request only gets you the documents in file.

How can ur case be preadjudicated, yet not assigned to an officer. For my wife's case wea re told several times that her case is not preadjudicated but is with an officer. My case is approved and the officer I talked to said that it seems that her case is with the same officer who approved my case...and that her case is pending possibly becoz of biom issues on my and her case...she said she is sending a request to upload the biom again...wait for 2 weeks...not sure if there will be any positive result but what can we do other that WAIT

Ours was filed in NSC - July 2nd (hand delivered is what lawyers say.)
I had 1 question.
How long should we wait for receipt to be issued? I am concerned if USCIS misplaces package or something happens, we would miss window of opportunity to file.
Also since lawyers say its personally delivered, how do we track/keep proof that ur package was delivered?
Should we just go ahead and re-file if we dotn hear from CIS in 10 days?

Kaka you really have a win-win situation. If somehow something gets passed in lame duck then you will be happy with your GC. if nothing happens and priority dates don't move forward then you can always tell others " I told you it is scam and you did not believe it".

Once it is I40 is appoved it will go to national visa processing .. .Once the pd is current NVC will send a mail to you to pay the fees. Once they receive the fees they will send all the documents to consulate . Usually i think it is 45 days to 3 months depending upon your luck. After that consulate will call you for interview.

my labor has to be pending 365 days or have an 140 approved to extend. so if pp goes away for 140 then my only option to stay in status is EAD. Also I am not in IT so patni,tcs etc...is out of question.

I don't know if IV is already doing it...but we need to meet all these lawmakers who are considering immigration reform....get the details of the bills they are proposing....see what the common benefits are...and help them to converge toward a unified bill that will help all.

Invoking AC21 is easy, but you need to know what you can expect and how to resolve it
(1) If you decided to change to new employer using EAD - there is nothing you need to do. Just join and work.
(2) As employer is asking what they need to do - tell them they need to provide an AC21 letter of support - you can find various formats on the web.
(3) Your new job must be in same or similar category.
(4) Call customer service to verify your address on file - also hire a personal attorney and make sure they file g 28 and have them on file too for USCIS communication
(5) Your AC21 letter may/may not reach your file depending on the service center, officer and a lot of other factors.
(6) Usually most AC21 cases go through just fine unless your ex employer requests a revoke on i 140 - in such a situation you may get an RFE, NOID or a straight denial on 485 - nothing to worry about - you can resolve all these and you will find yourself back on track.

You need to understand why your company is paying only 85K. Your base compensation is 85K, then you have another 10% on top of that as bonus. Also your Health/Dental/vision Insurance will be close to 15K payed by the employer. Also they pay Social Security at 8% base pay + Your H1B and other legal Expense for you and family. This will put your total rewards/compensation well above 100K.
I am not trying to say that your present company is perfect, but these are the common expenses for a company , Thats the reason even if you get hired by the direct client your salary will not increase very much. Companies pay 180$ to the consulting companies for the following reason
1) You are not their employee, so $180 per hour is all they pay ( No benefits, No H1b Legal hassles etc)
2) They Hire consultants for a particular project for a set period of time. After the project is over, they can have the consultant "released" from the project.
3) They dont want to hire independent contractors, cos, if the guy leaves in between the project, its the responsibility of the consulting company to replace your position with another qualified person.In your case, they need to find another candidate with your technical expertise, which is not very easy.Very few Companies wants to take that risk.
You need to look at the total compensation rather than your base pay

Yes, my Bachelor and Master's are in same/related discipline. I think you can use any education evaluator but make sure that are aware of Indian Education System. We have responded to the RFE. I will post the outcome for the benefit for all.

I am in EB3, just applied for Labor. And would like to see EB3 moving fast. But I am too not comfortable with the statements written in starting of thread. I think, responsible dept. has limited no. of visas to issue every year & when lot of people are applying in EB3, it would definitely take time to process applications.
And I read something about, EB1 spill over, and natural beneficial (first preference) is EB2 for that. So I do not understand where the point of discrimination is.
Some people say intention behind post is to divide EB2 / EB3 people; I am not sure what the intension behind the post is. But definitely person has ONLY made the statements & NOT given logic for that statement. Since most of us see everything (due to nature of job) logically & try to find out reason, this post won't be able to convince even a single member forget the lawyer & law makers.

Bailouts from Arabian princes & Chinese govt. didnt do much squat to push the economy. A few immigrants buying houses (which again is gonna be tough to get loans approved in the 1st place) is gonna do much less good.
The US economy needs a deep cleanse. Which means all the bad news has to come out once & for all. No more Congress sanctioned hush ups for irregularities at Fannie Mae etc etc.
The US as a whole needs to rebuild the faith of the rest of the world, both politically & economically. It has now been clearly established that US is not a political & economical superpower that it once was.
