There should be a separate quota for Master's degree holders with existing jobs in their field of study. That would weed out people joining random schools for a Master's degree just to be part of that quota.

The approval of h1 will not invalidate H4 visa. The usage of h1 visa invalidates H4 visa.
if you have h1 approved and don't join the company, then your h4 remains intact. Once you join a company on h1, you will fill out i-9 form, which informs the concerend authorities about your status change.
All these are correct. But the main issue is tv25's spouse H1 is denied and the reason is "misrepresentation". So, its a serious charge. And if its on the company's side that put any bogus documentation then he is fine...but if its on his wife's documentation then he ought to be worried cause it may/may not(only an attorney can answer) affects his I-484 case...his credibility is at stake now.

Congrats to Goan2005.
For a lot of others it's a long wait. Unless you used substitution labor to jump the line, increasing the Visa numbers, elimination of country quotas is your only hope. IV is the only organization/movement working for it.
Be part of the movement to get those LUDs in your case. Real status is - 'Case Approved'. Rest all are passe. Work for the real thing.

Hello guys,
My frustration is increasing and patience going down. I am strongly considering moving back to India. When planning the move, a few questions popped in my head the answer to which I am not able to find (yet); hence putting it out here.
1. How can I inform SSN department or credit bureau that I am not longer in USA..hence no one can use my SSN even if it gets stolen? Is there a way to "lock" things down?
2. What happens to 401K? Is there a IRS tax law that says because this guy was on H1-B and leaving..don't charge him the 40% penalty?
2.1 After 40% in penalty and 30% in taxes...with the market beaten down...not much remains...wonder if it's even worth touching it. So if I decide to leave the money here in my 401K account, what happens when I want to withdraw it? Rather what is the best way to withdraw it?
3. Any estimates on how much it costs to ship things back to India? I live in 2 bedroom apt..so have the usual stuff.....couch, bed, tv, clothes of many sizes, lots of kitchen utensils. Just an average...I understand things can vary a lot.
4. PIO card has the passport number of my son on it...the passport will expire when he is five year old. So do I get a new passport number? If so what happens to the PIO card? Do I need to get a new one?

I dont think there will 40% penality after 30% tax on 401K when you withdraw funds. it will be total 40-45% from 401K if you withdraw before your retirement.

I am stuck in EB3 and want to apply for EB2. How does one find companies willing to do EB2? With desi consulting companies you can ask upfront to the recruiter but with american companies can you do the same?
Can users suggest some companies who are currently doing EB2?

This may be affecting a lot of IV members so I thought I bring it up and share the pain with everyone. Some universities in US, like Arizona State University, consider the folks on H1-B or L-1 or EAD non-resident for tuition purposes and charge much higher tuition fee despite the fact that you pay all your taxes, have permanent home in the state, and have been living in the state for years. As far the State is considered, you are a resident but the university chooses not to accept that definition and purposely define you non-resident so that you could be charged much higher tuition fee.
If you are an international student, came to whatever state to study only, have never lived in that state before, and have never paid a dime in taxes in that state then it makes sense to classify you as a non-resident but it doesn’t make any sense to call you non-resident if you have been paying your taxes, made the state your permanent home, and have been living there for years.
Have any of you been in similar situation? If so, did you do anything to address the issue other than just paying the damn high fee? Does this discriminatory university policy violate any federal law?
Any suggestion and discussion would be very much appreciated.

Noone is forcing them to be ehre - you are saying. And I am saying: nobody should be forcing them out, either. They are ehre because they want to be here and because they want to discuss something with other people who are here - administrative problems or philosohpical issues.
'You should trust the organization in what they do' - you are saying. The organization should not be perceived as an abstract, 'know-it-all' deity that we, tiny humans have to blidnly follow. The organization is us collectively and we should not be following it, but leading it or at least taking it somewhere. Sometimes the road is straight and goes forward, sometimes there seem to be multiple roads that need exploring which may or may not coverge again. Sometimes the journey is not continuous and you need to stop, consult a map or a compass and realing yourself. There is nothing wrong with that. There should never be blind trust because that will sooner or later drive us all down the cliffs.
'If you have ideas talk to the core and discuss with them in person' - that is exactly what we are doing. Throwing around ideas and discussing them amongst ourselves. Sometimes the discussion is easy and disciplined and constructive and sometimes it is hard and confrontational and destructive. I think that if it is too confrontational or too destrcutive that indicates that not all is well within the group - I would refrain from calling it an organization just yet - and the ideas are not mature or ready yet and/or the group is not really cohesive and it is really not one group. Both of which are problems that need to be addressed and dealt with. By stifling discussion and censoring out ideas that you do not like, you are doing a disservice to the entire group because the group has to discover what is the cause of the destructive confrontation otherwise it cannot successfully function and fulfill its objectives.
For those who dont agree with what IV is doing, no one's forcing them to follow what IV does and certainly no ones forcing them to be here, but if you are here then you should at least trust the organization in what they do.

Actions speak louder than words... Lou Dobbs says Microsoft has waged war against the American middleclass by taking the company to Canada. How can you say that its not legal? When you sign that contract or piece of paper, it means you are acknowledging to all that is in there. Whether you like it or not, when you sign a paper you essentially are saying, "hay! i read this and I agree, here is my signature"...correct me if I am wrong...

I'm sorry if this question sounds trivial, what is LUD? My FP was done on Sep 19 and I checked the uscis website today using my i-485 receipt #. I don't see any update. Please let me know.
You have to create an online account to get updates on you application. You will see LUD and there is the date everybody is looking for. You can also receive email if take the option.
You will not see LUD if you just put in your recipt number to check status of the case.
