Employee is responsible for the accuracy of the time sheet submitted for payroll. If Nathuram-daulathram-desi-Company pays you and we did not get the money from the client, he/she are responsible to reimburse Nathuram-daulathram-desi-Company all the amount that is under dispute within 5 business days. Employee is responsible for all the legal and administrative costs (attorney, collections etc) for enforcing the above terms. All disputes will be settled according to the laws of the sate of NJ.
Are you serious you want to sign something with that wording. If the employer and client have their own agreements (like delay of payment for 60 days or so), then you will be always struck with your employer until the end of this project.

One of my friends had an agreement like this and they threatened to cancel H1B if he did not sign. Make sure you have your transfer papers ready if they take that extreme step

6years( 4 years for labor , almost 2years for I-140) of waiting and $12000 gone to drain.:mad:
That's very sad to hear and its truly very very frustrating. Now is the time you should be thinking more positively and move ahead. Don't look back that would depress you. Its very hard...but you got to move on and don't lose hope.

A friend told me about the E category visa for Australian nationals. Is this true?
According to him, if you become an Australian national, you can use the E-visa.
Has anyone migrated to Australia and returned to US successfully on a E-visa?
Has anyone also applied successfully for a green card on a E-visa?

I think you can apply as Australina national but your priority date is dependent upon your birth country not the country of acquired citizenship. I have a friend who is an Australian citizen (born in India) and is stuck in retrogression.

Hi everyone, I have been approved on 9/6/7.
only 92 days after AOS filing.
My sponsor, I did work with them from 2002-2007. They agree to file i-485 in the hopes economy would get better. However house builders are doing very bad now and they cannot take me back after approval.
The question is, does this spoiled my chances for citizenship?

How long is it taking for renewing passport at San Francisco?

After deciding to buy the Nikon D70 I began to read a number of posts to the pReview forum that had D70 owners citing backfocusing problems with their new D70s. All resorted to sending their cameras to the Nikon Service Center for repair. All reported at least some measure of correction but some indicated they could not achieve precise focus within the DOF for each of the Nikon compatible lenses they owned and are useable with the D70.
I own two Sonys (the F707 and the V1). Both, in my view achieve remarkable clarity, color and brightness right out of the box. AF on both is, again in my view, is extraordinary. So, I would be very disappointed if I were to spend 1500 or more bucks (with some accessories) to arrive at inferior imagery.
It is possible what I am reading is the view of purists who are able to "see" focus flaws that the more casual, but still demanding, amateur photogs would dismiss?
Has anyone out there had experience with the backfocusing problem to which I refer?

I searched for my LC case in one of the DBs in this website. I could not find it, though there were lots of other cases from my employer. I have the case number and approval notice so I am sure about genuinity of my case. Is this possible that some of the cases might go missing here ?

Due to a slowdown in their business, my employer is laying me off in Dec '07. I'm still short of 1 month to complete my 180 days of I-485 filling. However, they said they will not withdraw my I-140 and, to help me, will in fact keep me on their payroll until Jan '08, with my Jan '08 salary as my severance and my official status as on "paid leave". So far, so good.
I also have a job offer, and my new employer wants me to join them in Dec '07, on EAD. My question is: Can I be officially on the payroll of two companies simultaneously on H-1B and/or EAD? If yes, do I need to inform the USCIS of my status (new employer; AC21)? My other option is to say No to the new (attractive) job offer (or to try to convince them to wait until Feb '08, which they'll likely not agree to), and and take up another job in Feb '08, on EAD / H-1B transfer, using AC21. Please advise whether I'm fine with using the first option!!
