As a Primary Applicant my GC was approved (EB-1) but for my wife's application I got an RFE. RFE - USCIS is asking for a VALID wedding certificate showing proof of a hindu wedding under hindu act (dont ask what I was doing or what my lawyer was doing while submitting 485)
Now I have about 28 days (total is 30) to respond to it. I have not rcvd. my GC but it has been approved and has been sent to production. My lawyer told me that as my GC has been approved my VISA is not good anymore. My wife was on dependent visa and so is my kid.
Now as my GC got approved.......my visa got cancelled...........my wife's & kids visa is invalid.............and we did not file for Advance Parole so we cant travel. On top of all this we dont have a wedding certificate.
Any suggestion to address this situation? I cant get a certificate without going back to India and I cant leave the country as If I do so I wont get to enter the country again. Even if somehow (on some legal basis) I can re enter I dont think my wife and kid will be able to re enter US.
If I dont produce evidence then my wife's application will be rejected putting her out of status.............gosh what a mess.....
ANY SUGGESTIONS FROM ANYONE WILL BE HIGHLY APPRECIATED. Murali please respond with any possibility which I can explore upon.

Get an affidavit from relatives who were present for weeding....2 affidavits will be enough. No need to travel abroad.

I am really sad to see people questioning IV core members who have sacrificed so much for just a article in WSJ where legal immigration is not mentioned by lobbyist.I feel really bad that they have to prove themselves day in..day out.

you cannot say like that. One of my friend got RFE for i-140 ,but 3 others were approved who applied along with him from the same company . RFE is regarding the company details.. Since my I-140 got approved recently, my employer might not have lot of issues with IRS or INS. ??????????? what do you guys think.

this is also assuming that you have filed for your 485. you cannot apply portability with:
approved labor + approved I140
you can only move to another employer with:
approved labor + approved I140 + pending 485

Dont bother calculating this because by the time you become 65 SS will not be the same as it is today, it can be bankrupt or the retirement age would increase to 75..80 god knows. I dont think anyone can give you a solid answer to this particular question. the calculator does not include your specific situation

i applied for EAD on Dec 21st, got card ordered for production email on Jan 21, and got the card via USPS 2 days ago. My PD is just few months away from May 2006 (EB2), but I still got 2 years validity (on the EAD card).
I cannot possibly imagine the fact that PD wont move even a few months when spillover begins.

Is there any conflict between 'India being great' and your 'GC application'? Its really not a smart thing to say that you missed it on purpose when your name is 'PERMFILING', you have 'EB2 in process' and you appealed on your EB1 application. :D:D:D

You need to have your old I-140 approved to port PD to your new I-140. If the old 140 is not approved by the time you file you new 140...thats fine. At a later stage when your old 140 gets approved have your lawyer send a letter to the processing center with PD porting request for the new one. At that time your new 140 can be in processing stage.

The category of I-140 from my previous employer is EB2 and the new PERM i will apply from my new employer will also be in EB2. Just wanted to know if application for I-140 and date porting can go together or i have to wait for new I-140 to get approved inorder to port priority date.

I started the US immigration in 2006, PD-September 2006, by CP, EB3ROW. DS230 renewed 3 times since then... a couple of months ago I applied to Canadian PR, now I am waiting for my interview date. So I have two processes parallel - US GC & Canadian PR. My question is : How these two immigrations can jeopardise each other? :confused:
Logicaly I will attend the Canadian interview first, will they ask me about US immigration? should I tell the truth? Will they deny the PR because of the GC process?
Presume that I have successfuly done with canadians and have landed in Canada with my PR in 8-10 months from now, and suddenly, I,ve got an invitation to the GC interview... :eek: Does the fact that I have a Can. PR will kill my future GC and at the interview the will deny and cancell my case? :confused: Or The interview will be successful and I will have my GC, but somewere in the future there is a point where I should refuse one - GC or PR? :confused:
I should mention that the GC is the choise No1 , and PR is a plan "B"...
I believe that my situation is not unique, but now I am out side the US and in my country it is difficult to find a competent lawer. So I hope that somebody from this forum could answer my questions.

Change of states is trigeering RFE. If you have moved considerable distance from your previous location the RFE will ask for an updated EVL explaining that you still have the job. Which can be easily addressed by your employer & lawyer. So dont worry and wait for 5 working days to receive the RFE.

Prem : It is their will, they can issue it again, if they feel that considerable time has passed and they want to check if you are still employed on terms mentioned in your Labor.
No one can question USCIS, they can even deny an approved application. It is not a give and take exercise with them............. it's a one way street.:)

I had seen a similar thread for NSC->CSC->NSC filers, but can't seem to find it anymore---did anyone whose cases got transferred to CSC receive FP notice?
I am a July 2nd filer, EAD/AP approved from CSC, case transferred back to NSC back in early Sept--still waiting for FP notice for over 4 months now.
PS: I am not desperate for FP notice---and i know it's going to be several years wait--just want to get the FP done and move to an apartment with lesser rent :-)

It is known that many employers and their attorneys do not provide their employees with the 485 receipt number. To avoid unnecessary trauma and strain on the employer-employee relationship, we should request USCIS to send a copy to the applicant whether 485 was filed with or without G28.
