A top national reporter wants to speak with someone in EB
community who may have recently lost his/her job due to current
economic situation. I think it would be best for our cause for someone
who was offered a new job possibly in the 'same or similar' area
immediately after losing their job. It would help to highlight that
the highly-skilled immigrants are in demand because of their skills
even when the economic situation is not doing well, but, there is no
reason to keep us in limbo for over a decade, merely to test our skill

Current Status: Document mailed to applicant.
On September 20, 2007 we mailed the document to the address we have on file. You should receive the new document within 30 days. If you do not, or if you move before you get it, call customer service.

Hi,
My parents will be here for more than 184 days this year (on visitors vis) and I want to claim them as dependats on my tax return for next year.I searched through some old threads, but the info seems to be outdated.
* Can I claim them as dependants on my tax return?
* Has anybody done this successfuly before?
* What is the deduction amount per person/dependant?
* What is the process? I know they will need an ITIN etc.

You should be able to claim them as dependents in your 2007 taxes if they pass the "substantial presence" test. You can get 2 additional "exemptions" for them in your return. IRS looks to issue new ITINs only during tax filing (so when you mail your return next year, you attach their W7s with your filing). Or your parents can open a savings bank account and if they have any "income" in the US, they are entitled to an ITIN any time of the year.
I have just applied for ITINs for my parents who spend 6 months every year with me. They pass the substantial presence test and I plan to file amended returns as soon as I obtain their ITINs. Hope this helps. Good luck!

I have a total of 15+ yrs exp in the IT industry out of which 8 yrs in USA. I am also an EB3 :) BTW I have a 4 yr engg degree from a small college in india :p

I am totally pissed off with this system. The only wrong step which i took was applying in EB3 when i had three years of experience. Now i have a total almost 10 years experience in IT and still waiting like an illegal immigrant for GC.

Unemployment is everywhere, the worst is in california. It does not matter whether its IT or any job. Some of the employers layoff the most talented and hardworking person.
I was thinking is there anyway for those having canadian permanent would reside, search for any jobs till the recession is over and come back to US. In that case one can accumlate the time in canada.

One in the East Coast, One in the west coast and one in between.
For the West coast I would pick the SanFrancisco Marathon (Just to be sure that gsc999 participates :p) on August 03'rd. The participants of this event can choose either a 5k, half marathon or a full marathon. This event should be fun to be part of. We have lot of committed members in our No.Cal chapter.
I would love to take the lead with this project. I have done a fund raising initiative for Arthritis Foundation of America when I ran the Mardi Gras Marathon in honor of my mom. I raised $1,100 in a 6 month period for the AFA. The idea I have is that Team IV members will participate at their local events and we should pick 3 national events such as the Chicago Marathon/Half Marathon, the Breakers 10K (is that San Diego?) and even the Crescent City Classic 10K right here in my hometown. Team IV should be well represented at these 3 national events.
Team IV members can set up an e-mail support group when training for any events. There are numerous on-line training guides which we can use. And I can also look into the idea of an on-line training coach.
I already have the committment from 4 friends, all of whom are US Citizens, to join this Team because they support our cause.

I am not sure when the CIR will pass...its not on Nancy Pelosi aganda in forseeable future... and several people already mentioned that if it didnt pass by MAY07 then you are looking at Jan 09 to get immigration stuff to happen...
I think we need to work on an interm EB relief bill ...which is absolutely non contraversial and try to pass it....not worring about piggy backing the CIR...
Issues such as h1 increase or adding more numbers need not be in it...we can include things like EAD after I-140...spouse/childer not considered for EB quota...etc...
Unless we act desissively now...its going to be a long way to 2009..

I had my GC approved out of line last year in aug [was current (pd march 2006), but processing time wasn't current for texas at that time]. EADs for both me and my spouse had been approved like 1 week before this happened. Hers was for 2 yrs and mine for 1 yr. What happens to her application if I loose my job or leave my job ? I am the primary.
Since that I-485 is a derivative application, your job change should not impact her pending I-485 application.

Unconfirmed sources indicate that because of the order, the Texas Service Center is not returning the EB-485 applications which have been received since July 2, 2007. However, there is no evidence that the decision is necessarily related to its potential decision to withdraw the rejection decision. At this point, its reasons are completion unknown. I guess you can either come back or reschedule you FP appt...
Try your best not to miss the FP appointment. There is certainly a way to reschedule, but with so much backlog, your next date can be very far away. Missing a FP will also impact your processing time.

yes, my I-140 is approved. If your old employer revokes the I-140, as part of the processing of that revocation the USCIS *might* issue an RFE or NOID asking you for an updated employment verification letter. Per my attorney its more likely that USCIS wont do anything to the 485 right now, but will check the status of the I-140 while processing my 485. As part of preadjudication it might happen earlier, but also possible that it will only happen when my PD is current or almost current (July-2006/EB2/India). At that point we should get an RFE, and thats when my attorney plans to inform USCIS about the AC-21 change of employer.
Just a quick question:
My employer had legal dept and lawer filed G28 form for me when applied for I-485. Do we really need to hire a lawyer to represent us? I am planning to move to client under similar job description this month end and would like to see if I have to file AC21 and change the lawer representation.
I appreciate any response.
