Some states have the provision that instate tuition rates will only apply to permanent residents while others allow H1-B's to avail of instate tuition. I know for sure that Pennsylvania is in the permanent resident camp while Colorado allows instate to H1-B's. As mentioned previously it is the state legislature along with the commision on higher education which create the rules.
It would be interesting to compile a list of all 50 states to see where each state stands. To do that though it would help if folks residing in different states chime in. Otherwise it would be too difficult to sift through the higher education commission websites for each individual state.

It is good idea. I discussed this my lawyer and according to him, nowadays USCIS is very strict about it and trying to match the requirements of EB2 against the candidate's credentials. If it perfectly matches only they will approve. It will be an option for those guys with EB3 with PD past 2005 and with enough EB2 credentials, primarily a masters degree and if it from US, then great.
Please do not go into this option just by stating that I have 100 years experience with such and such company. I will say, if your are a masters degree holder (from US the best) and is employed with a major employer for more than 3-5 years, then only attempt this. Do not try it if you are employed with some Desi company. This is harm both the candidate and the employer.

Please do not quote from memory, if this has happened in specific cases,mention the details with the OES/SOC Code. In most cases, EB2-Job requirement: Bachelors+5 years.
Any EB3 pre 2008(post 485) should be able to use it.Please check with your attorneys and not 2 cents. And, especially, scared guys like the above, saying that it will harm you to go to EB2.
If you are pending 485, even if ur new I-140 gets revoked, does it matter if you have the older I-140.

I am sure others might have noticed that 485 processing dates at NSC (for example) have literally crawled from the beginning of the year to now. Here are the processing dates (per USCIS status).

Employer can ask for I140 to be withdrawn at any time. However after 6 months, the employee is safe and can invoke AC21.
But this seems to be untrue in the (sanz72 ) case quoted in my previous post on this thread. USCIS denied the I485 application of the applicant and he had to file MTR and wait for a long time to have it opened. One can only imagine the frustration and anxiety he must have suffered during that time.
MTRs do not work all the time as per the experience of some people.
Moral of the story-- GC journey for legal high skilled people is very tough and luck plays an important role in getting a GC.

Yes, You can use EAD and start working on it before I-140 approval BUT you can not change employer using AC21 without an approved I-140 even if your I-485 is pending for more than 180 days.

Today, I filed an official complaint with IRS about this employer. They told, they are going to send a notice asking the employer to reply to the tax bearer within 10 days from the receipt of the letter. I don't know how the employer is going to react and if they would still provide a corrected W2. Hoping, they would provide, otherwise I would have to call IRS again after another 2 weeks time. I had to be on the phone line for almost 30 mins to reach the IRS customer representative. It is a real pain.
Employer will send the W-2. They will in big trouble if they don't. Also, there could be possible more scrutiny/audits of their accounts.

Prediction is as good as the data available. From previous discussions (EB2-EB3 predictions) - it was predicted to see movement based on the data available - well, I am guessing the data was incorrect and therefore predictions can never be close to being correct.
Sincerely hope that the efforts of this community is to seek for data that is largely correct. I guess, may be IV can ask for the inclusion of advising USCIS to release the correct data frequently in the CIR draft.

To add to that, keep following up with your lawyer. Dont assume that lawyers know everything. My lawyer destroyed my case and made me loose my 2001 labor. I have now refiled and have a 2004, a loss of 3 years, but in reality, I could have had my green card nearly 8 years ago if it had not been for the mess up. There was nothing that I could do as the company was running the show. All i could get them to do was to refile again.
In addition to the letters from co-workers, send as many paystubs that you can get, W2 forms and tax returns (or the indian version), bank statements, etc. Also include a letter along with proof that you requested a letter from your old employer.
