Reverting back to the original interpretation for allocating unused visa from other category and to oversubscribed country from the current new interpretation seems to be the only possible quick relief to EB3, though EB2 gets affected it is not going to be that severe.

If we can approach the USCIS /DOS for Admin fix in this area, this should be possible, given that IV already has some success in the Admin Fix area. Chintu: Explain Wash sale rules too... taxes are a pain with day trading.
Also, ppl on H1B have to be really careful about not getting classified as "active traders." That IMHO could jeopardize status. All who want to get into day trading, do your research. Make sure you know what you are getting yourself into.
Investments are not reflected on W2. If you use a broker such as TDAmeritrade etc they will issue you a 1099
You will receive an IRS Consolidated Form 1099 - an all-inclusive document showing your reportable income and transactions for the entire tax year - if your brokerage account received at least $10 in either dividends, interest or original issue discount (OID) income, or had an equity sale, in the 2008 tax year.
- You will not receive a Consolidated Form 1099 for a retirement account, tax-exempt account, corporate account or foreign account.
- In addition, you may receive a corrected Consolidated Form 1099 if you held an investment trust that reclassified income after this form was sent to you.

yeah, because in that foreign country, people design some stupid GUI for that router, which obviously doesn't need assembly level programming for packet processing, so why waste money on teaching it?
(not to be taken in a literal sense, no offense to GUI developers, they have their own level of complexity and skill set).
So why do you abhor ALP so much?
If you written any firmware, you will know, for some devices, it looks and feels like an assembly level code only.

Finally, it is my turn to get the approval email. At 2.30 pm MST, I received the approval email, but still no emails for my two dependants. The waiting-game is not yet over:-)

I had an Infopass appointment this morning with a very helpful and informative IO, and he confirmed that my dependants' cases were also approved on 09/01. Looks like TSC email system doesn't work properly as there were no emails for my dependants. I belive that some of you folks may have already been approved with no status change and CPO emails. Good luck again for all you who are current and have been waiting for approvals.

From last two days I am also getting the Payment Processing error when i use the credit card option and called the Customer service, they informed send an email to E-filing.support@dhs.gov and sent an email yesterday and still didn't receive any response back. Today When i try to goto login page, now i am getting "Server is currently unavailable or down for maintenance".
Same here, I think, it took two days for USCIS E-filing support team that payment server is not working. I interpret the message "Server is currently unavailable or down for maintenance" as now the problem would be fixed.

Congrats. Where was you application filed? TSC/NSC and your receipt dates?
NSC. 485 filed during the july'07 and rcvd date was in aug'07, notice date was in sept'07. For me start to end time was 5yrs. First job, single LC, i140, 485 appln...Kind of straight-forward (boring ;) ) case.

Its nice to do a poll when there is something going on in the immigration area (CIR discussion in senate, a VB screwup etc); thats when traffic to IV is high and we'll get a decent sample size. Hopefully the House will introduce some legislation soon... come on lawmakers, I am waiting with my poll here, do something! :p

this whole thread is a nonsense, it belevies that people are not aware of the tricks placed by desi consulting companies. how come people do not take jobs
in foutune 500 companies if they are so good at their skills, why do people go to
desi consulting companies for training, after MS degree every body is asking for
the list of consulting companies( why do they do that ).
there are people who ask is it valid to be without payslips on H1B ( how much
more ignorent can u be ) , bottom line they could not find the project and they want to blame the desi company for not paying them ( trash ).

Wastage of H1 visas is criminal.There should be a quota on H1 visas per company-no more than 500-1000 per company,plus percentage limits of h-1 visas to total employees in a company.Along with this if there is a simple provision as there is in other countries like england,where the spouse can work too it will solve a lot of issues.

well I would like to add, I do know details of how a Bill gets created, is reviewed, gets to the Floor of the house, Senate and becomes law.
I do know that once a member of either house presents a Bill, it has to be sponsored, supported by others and go to a sub-committee first. sometimes gets added to other bills.
lets assume by luck or other means it somehow makes it to the floor.
Lets get educated first on the process before we start assuming anything - How a bill becomes a law (http://immigrationvoice.org/wiki/images/7/7c/How_a_bill_becomes_a_law.pdf). We will then understand how to advocate for the changes we are seeking...

PD cutoff date moved by 9 months. this is great news for PERM applications with PDs in late 2005. this also tells us that the state dept will move cutoff dates significantly in the last few months of the year so visas will not go to waste.

We will file our CSPA lawsuit on Monday. We have another plaintiff thanks to Atty. Andrew Knapp.
We hope that the USCIS, DHS and the Department of State will follow Matter of Garcia and apply the law not only to our plaintiffs but across the board.
Thousands of immigrants would benefit. We will post a copy of our complaint on our website later this weekend, and will discuss the lawsuit at the AILA convention next week, and in the upcoming issue of our free, e-mail newsletter.
