Can you please let us know the procedure? I'm very much interested in filing a formal complaint with the CIS and Ombudsman. I'm not against genuine candidates getting their GC through MNC executive category, but would like to stop this malpractice.
You can email to Ombudsman at CISOmbudsman.Publicaffairs@dhs.gov providing all the detaisl. As a routine they ask to fill a form with your case particulars, explaining why something investigation should be done. Those forms are then sent to USCIS, who routinely give some absurd explanation.
In other words, it could help if there are lot of emails, or letters to Ombudsman (address and fax # can be found on their website - google for it). Emphasis should be on USCIS inefficiency, not following the sequence, PD's etc., if several example cases (via filling forms as they need those for privacy reasons). Give simple examples, such as in May 07, EB2-India cutoff was April 04, now in May 09, it is Feb 04, whereas in the meantime many with PD's in 2005 and 2006 have been granted visas. Why?
Note that PD's, a very important critieria for retrogressed country cases, are not anywhere other than the paper applications. Therefore, USCIS/DOS have no way to know who should or should not be processed next. They claim that they process cases in order they receive (paper filings). By processing, they mean they check all docs (birth certificates, medicals, photos) AND Priority Date currency. If at the moment your file is being looked at, your PD is not current, it is put aside. I thnk no. As I-140 is only fo ryou. not fo rhte dependants.
So as long as you are married and your spouse is in US before you file AOS you should be fine.

I think this bill is dead. All the below events are closing up events of the PROJECT CIR. You cannot just let a project die. You need some documents to support your decisions if at all you need to debate on this in future.
Politics is the combination of resource (people / money )management and process management.
Concentrate on SKIL bill for next two months.

Income from investment activities is okay on any visa status as long as appropriate taxes are paid.
If one has rental income, interest income and captial gains from the stock market while on H1-B, does it affect if the person transfers status to H4. Is income from above sources for a H4 person ok ?

Personally this is what I think: we should ask Mr. Gotcher to help us on a pro bono basis as a favor. At the same time, let him know that we will collect contributions from willing members and all will go to him to cover his expenses. I suggest this for a couple of reasons. First, raising money can take time. And we don’t know how many are willing to contribute. We may be stuck here posting “come on guys we have $3k we need another $2k before anything gets done”. Also, I think a lot more people will be happy to put in their money when they see some actions and movements. This way work can get started soon.

My children have grown up and are on the verge of aging out, while I am still fighting to find avenues for a new green card application. Jobs are not permanent in the US. Layoffs are a common thing. The immigration processes take much longer than the life of a job. Many people like me end up with unfinished and abandoned immigration process. At the end of 6 years we are able to obtain H1-B visas one year at a time. Provided there is a pending I-140 process. What happens if a I-140 application is denied because of some faulty representation or your employer decides to lay you off?
My question to the senate is. Is this fair? Was it foolish off me to have maintained a legal status and spent so much money for nothing? Perhaps if people like me would have remained in the United States illegally without paying taxes, I might have saved a lot of money and would have been able to apply for a non-immigrant status for a very small fee.
My suggestion to the Senate is:
1. Pass a legislation that protects Legal immigrants who have lived in the United States beyond 6 years, but have been unable to obtain an immigrant status for one thing or the other. Or an H1-B non-immigrant who have come to the country before �9/11� and have stayed in the country through the recession; paid taxes; but because of constant layoffs and half finished immigration processes should be rewarded in this bill. Proofs that immigration processes had been initiated but abandoned because of job changes.
2. Children of Legal non-immigrants who have finished 6 years of stay in the US and are aging out, should be protected, because the state has spent tax money on their education and they have adjusted to a life style and system which will benefit the country. They should not be penalized for no fault of theirs.
3. Children and spouses of H1 Non-immigrants who are educated and can work should be given the opportunity to do so. This way many will legally work and pay taxes. It is a great burden on a single H1-B non-immigrant to be the sole earning member in a family. Currently a dependent of a H1-B is not permitted to work.
4. An I-485 process of immigration should not be cancelled if a pending I-140 is denied. This should be made available once again to the applicant and his or her family if a I-140 process is re-applied within 6 months. It is unfair to make the family file for a I-1485 process once again with additional fees, medical tests, finger printing, work authorization and so on. If a I-1485 has to be reapplied, it means the family has to wait for endless years ahead to wait for their immigration numbers for their country to be available once again.
5. H1-B non-immigrants are educated people who are already here because there is a shortage of manpower in that category. I personally do not see the need for a Labor certification once again to see if there is a shortage in that particular area. H1-B employees go through these process initially before their H1-B�s are approved. These people who have been here for more than 6 years already know the system and can contribute to the country. They do not take away jobs of local people.
6. A Non-immigrant who has purchased a house in the United States has already taken the first step of naturalization. They put their money here. They do not take money out of the country. I believe they should be rewarded with a non-immigrant quota/status. This will bring a phenomenal real estate boom in the country and a welcome change to the economy.

I know your pain, Iam in the same boat, submitted everything on 06/26, hopefully everything will be filed after july 4th.
I have submitted all the documents to my laywer on 6/25 itself (including medical) but they are just heavily back logged and won't be filing my case till Jul 10. I am just frustated now. I even offered to pay extra to speed it up but no use. I am only worried if dates retrogress half way through?
To my real question.. Can we just file on our own with out the lawyer? I would hate to loose this window just coz my laywer couldn't do it. Not sure how I would break that kinda news to my wife, "I know the dates were current for 10 days in July but our lawyer didn't have time so now you will have to stay at home for 1 more year".

I did it for my wife and son, but thrugh an attorny, It costed me $375 total,
including the attorny fees. It is not required unless you leave the US.I had to do it to get an ID for my wife for DL purpose, as H4 approval notice was(I hope it is still) one of the accepted documents as 2nd id in VA.
Your wife may file for H4 without a lawyer. It costs $250 and I did it once. No issues at all, very simple and straight forward form / procedure.
Although not necessary to file H4 transfer )as this is not linked to employer directly but rather the H1 holder), it may become important when you leave US for visit home.

As of now the total number of members in IV are 13,959. I think we can get it to 14,000 by the end of the day.. we just need 41 members.
