Heard the same from my lawyer, she has changed her tune completely in 2 days. Now she says that she is hearing the same thing and is possible. They are working through the weekend and has asked me to keep my blackberry on me at all times as they will be providing emails updates every 4 hours or if and when the said bulletin is released.

Not all things done are perfect!!. But the point is that something is getting done. In retrospective everything is 20/20. Criticized are those who attempt something and who do not do anything never gets criticized.
IV is doing something which could benefit you. Atleast please do not complain if you do not agree. I will be with you without complaining if you try to do something.

I fully support this...
People who meet the conditions above can benefit the US Economy in a long run because...
1)Deficits are going to be high for a long time...in trillions, and if we are allowed to apply for naturalization directly, there is a better chance for us to pay taxes to reduce the burden.
2)If we are asked to leave now, the US is committed to Social Security payments(with the minimum 40 points) even if we are outside.
3)By now, we already have kids who are American citizens... which means that when they become 18, they can always sponsor us as citizens. All that we are asking is for the congress to do the same a few years earlier. It is better we are here in our earning years than when we are in our older years.
If this Bill is introduced in congress, people will listen because...
1)People waiting for 10 years... and done all the right things, no one can simply ignore. Also, there will be a sense of guilt on the US Government to have let the situation deteriorate. They will think of ways to make the transition smoother... remember they created a special green card category for Iraqis since there was a sense of guilt.
2) Whether this passes congress or not, there is a legitimate argument of asking for the congress to rectify the situation. That is the best we can do.
3) We need to give more and more options to the congress. Not everything sticks, but even if one or two get passed, it goes a long way to help all of us.
I personally will contribute bigtime if IV core want to take this up!

Our parents/relatives do not need a land phone in India. Send one VONAGE adaptor and they can call any number in India (long distance) and to USA and other 60 countries.
They can receive any calls in a Cell phone (prepaid) (in India - incoming is free).
So just take a broadband connection and Vonage. Bye BSNL/VSNL.........
Remember you are talking about INDIA which is not US. you need broadband connection and Electricity for VOIP and you know the availability and reliability of both in INDIA.

There is nothing wrong in reporting fraud.
However your argument that you are reporting it since you cannot tolerate fraud isn't that convincing.
If you were always against injustice/lawlessness, you will see a lot of it in your daily life. Do you report or take action against each of those ? I don't think so.
After living in India for long and seeing people put up with all injustice and sometimes doing it themselves, it is hard to believe your argument that you are doing it just for the sake of law.

Hope everything will turn out good for you. I don't know faith of our applications.
Im July 2nd filer application reached to NSC at 9.1 am and signed by R Mickle
Till date my checks have not been cashed. When I Called service center yesterday they gave me Receipt Number for I-485 (LINXXXXXX) but again she told me thats its Invalid then she put me on hold and checked something then see verified my address, Social security number also My Attorneys Name and address. After confirming this information she told me Receipt Number of I-485 is yours but its Void in our system let me check it online and online it shows case received and pending.
Now she said its weird its showing Valid in online system and in our internal system its Invalid. Then she asked me did you file 131 and 765 along with this I said yes then she said let me check it and found nothing.
She has created one service request for me and asked me to wait another 45 days.
Meanwhile I told this matter to my Attorney and he told me not getting receipt is normal and I could have asked you to wait till October 15th but you are there in the system and why they have stopped processing you applications looks strange to me also applications is not been rejected. So he told me that he will write letter to USCIS director to investigate this issue and assured me that as long as we are in their system so dont have to worry but he told me that if Director dont respond in one months time then we will go to court but he is optimistic that situation may not go to that.
If anyone of you in similar situation please let me know.

NewsFlash! DOS Expected to Revise July Visa Bulletin
Posted Jun 29, 2007
MurthyDotCom
We have received news from the American Immigration Lawyers Association (AILA) that they have reliable information that the July Visa Bulletin will be revised on Monday, July 2nd, or Tuesday, July 3rd. This Visa Bulletin is expected to retrogress many of the categories that were announced as being "Current" for July. It is expected that at least some of the categories will become completely "unavailable." The reason for this is that the USCIS apparently engaged in extraordinary efforts to approve cases in June, once there was some forward movement of the Visa Bulletin. They did this to try to avoid the tide of cases expected in July. Each green card approval uses one visa number. If the numbers are all used for the year, then the DOS will issue a revised Visa Bulletin reflecting "unavailable" in the particular category or categories.
MurthyDotCom
DOS Input
MurthyDotCom
While there is no 100 percent assurance about this matter, we at the Murthy Law Firm were given a 95-98 percent confirmation of the expectation regarding the Visa Bulletin by a very reliable source. The most vulnerable categories, of course, are those that are typically the victims of retrogression: EB2 and EB3 for India, China, and (potentially) Mexico. If this unprecedented action should occur, it will mean is that the USCIS will reject I-485 cases based upon the anticipated Visa Bulletin revision, if it should, in fact indicate that visa numbers are not available in a particular category.
MurthyDotCom
Legal Fight Brewing
MurthyDotCom
There is substantial legal wrangling ongoing because of the anticipation of this unprecedented occurrence. The American Immigration Law Foundation (AILF) has announced plans to file suit against the USCIS for any cases rejected due to a revised Visa Bulletin.
MurthyDotCom
Conclusion
MurthyDotCom
It is difficult to formulate words in reaction to this matter. So, for the time being, we will let our clients and readers know that our full sympathies are with them, as they face yet another potential disappointment. We also let them know that we have been long-time supporters and contributors to AILF and we will fully do our part to fight what comes.

If the job required a EB2 or EB3 but EB3 was filed earlier. Is that possible?
for the same job position it should not be possible. When the employer filed in EB3, the employer must have provided all documentation necessary to justify the EB3 status. If now, the employer has to go back and indicate that the job requirement matched EB2 status, then that indicates something was not done right during the earlier application. That could right away trigger a RFE.

Check this:
http://www.bibdaily.com/pdfs/Liang%2010-30-07.pdf
Defendants assert that the background check is a complex
process that must accommodate an extremely large volume of requests
from the USCIS. Given the backlog of name-check requests and the
FBIs limited resources, they maintain that the delay of two and a
half years in processing Mr. Liangs background check is not
unreasonable. There is some validity to these points, and the
Court appreciates that the name-check process is indeed complex and
resource-intensive. But limited resources or not, a common-sense
rule of reason dictates that if the FBI was performing background
checks with due diligence, it would not take two and a half years
to process Mr. Liangs name. While the Court is sympathetic to the
demands placed on the FBI and the limited ability of the USCIS to
control how the FBI allocates its resources, a lack of sufficient
resources devoted to name-check operations is a matter for the
agencies to take up between themselves or with Congress. The
executive branch must decide for itself how best to meet its
statutory duties; this Court can only decide whether or not those
duties have been met.
See Dong, 2007 WL 2601107 at *11 ([I]t is
not the place of the judicial branch to weigh a plaintiffs clear
right to administrative action against the agencys burdens in
complying.).
Moreover, although there is no Congressionally mandated
timetable for the processing of I-485 applications, Congress has by
statute expressed its view of what a reasonable amount of time is:
It is the sense of Congress that the processing of an immigration benefit application should be completed not later than 180 days
after the initial filing of the application. 8 U.S.C. 1571.
The Court recognizes that this statute was enacted prior to the
events of September 11, 2001, and that the burdens on agencies with
responsibility for immigration matters have since increased.
Nonetheless, Plaintiffs applications have been pending for five
times the length of the period identified by Congress.
Defendants argue that expediting Mr. Liangs name check will
prejudice other applicants who have been waiting longer than he -in some cases, since as long as December, 2002.
While this would
be unfortunate, Defendants failure to fulfill their statutory duty
to other applicants has no bearing on whether they have fulfilled
their statutory duty to Plaintiffs, and thus cannot serve as a
basis for denying Plaintiffs motion.
While Defendants worry that
granting Plaintiffs relief may reward the more litigious
applicants or encourage other applicants to file lawsuits,
perhaps recognizing this possibility will provide the defendants
with adequate incentive to begin processing [I-485] applications in
a lawful and timely fashion in order to obviate the applicants
need to resort to the courts for redress. Dong, 2007 WL 2601107

The more than half million highly-skilled legal immigrants already working productively in the United States find themselves trapped in a system that is taking years longer than intended.
It should read as, "There are more than half million highly-skilled legal immigrants already working productively in the United States who find themselves trapped in a system that is taking years longer than intended.

So per your theory 8008 people who filed in Eb3 should get approved which should bring it to 2003? for EB3-I by end of year?
EB3 india gets only 2803 per year with350 of those going to OW. How did you arrive at the figure.
