From a Constitution standpoint, Obama believes the Congress should pass the law and his executive branch will implement it.
Unfortunately, thanks to the filibuster, the senate is broken and nothing important has gotten passed. The Health care bill was watered down to make it almost useless.
He seems to forget that he also has a role of a leader to move the country in the right direction even if it may be unpopular.
There are issues that have over 60% support (eg. Don't ask Don't tell, Legal immigration issues, Energy tax credit, etc.) that he can support via executive orders but refuses to do so from a standpoint of the Constitution.
So, we are at

My lawyer says "If we file the I-140 based on the LC-PERM, we would interfile it into your pending AOS, so your AOS would be pending based on the pending I-140 (NOT the withdrawn LC Sub)."
Is it possible to interfile if the PD is not current? My pending LC SUB and the PERM LC PD, both are not current. Please confirm whether it is true or not. This will help me make my case.

I used to be client of Gowda couple of years back and I did not like the experience at all.
My situation was little different. Gowda's firm was the de-facto firm used by my employer although I used to pay all attorney fees out of my pocket. In spite of me paying for his fees the firm always put my employer's interests ahead of mine. My employer then was a typical blood sucking desi consultancy shop and used pending GC as one of their leverage to make employees stuck with them in spite of poor pay scale. As far as my own experience goes Gowda's firm happily played along with my employer in the grand scheme. They denied me any update regarding whether my labor was cleared as well as didn't send me any original approval notices/receipts etc. at my employer's request. When I raised lot of noise I was finally told I can no longer have direct access to the attorneys and have to route my requests through my employer! I wised up, cut short my losses and ditched both of them to join a big respectable company loosing my earlier PD and approved labor in the process (which I'm sure my employer must have sold back when LC substitution was legal). I finally received my GC in September.
Your experience maybe different if you directly retain Gowda without involving your employer. Competency is not an issue here, conflict of interest is.
This is a news RK charging for suggestions.
I spoke to him couple of times prior to becoming his client and he never charged me anything.
He was very polite and replied all my questions. He even responded to my emails. This was in 2006.

IV team, please consider the following:
1. IV can post free ads in classifieds like sulekha, indiainfo, craigslist, free ad newspaper, etc.
2. also IV can contact all indian/asian associations and Asian student association in US to place an free ad in their websites/magazine/email newsletter (some have annual magazine, some has monthly newsletter). tell them how IV helps its members in visa/gc related issues including free legal advise.
3. IV can place free ad/info on notice boards in indian/pak/chinese restaurants, indian/pak/chinese groceries, temples, conference halls, etc...
4. increase IV site listing in search engine results. any combination of keywords in gc or visa should bring IV site in top 10 like when searching any US visa (like H1/H4/H1B/F1/J1 etc.), gc related keywords (like I-485, PERM, labor, I-140, immigrant, FingerPrinting, etc). This can be achieved for a little money and this can be done by contacting yahoo/msn and other SEO (Search Engine Optimization) companies. Our members can help us in this regard.
5. Send newsletter email to all IV members atleast ONCE a month and ask them to contact their friends/coworkers/their company employees to join IV.
This newsletter will request members to contact indian/asian association in their local area for membership drive.

Since this is part of your income you will have to pay taxes on it. Your employer would have already deducted some or all of the taxes due via withholding.

While no doubt, getting PERM approved is difficult at this time, it's not impossible (I have a few close friends who got them approved recently in EB2 though they had to wait a long time for it) and giving it a shot is well worth it if things work out in OPs favor.
I think ur friends PERM got approved becuase they filed before this economic depression. meaning, when the recruitments efforts were made for your friends case there is not much unemployment and might not have received any resumes. And I believe DOL check when the labor filed.. not current time.. while approving or denying it. So as some one mentioned now its not the case.

I aske my attorney's office and they say "document mailed" means its approved. I dont know what to make of it, guess I'll just wait to see something in mail.

I have a very good friend who is French. He live is Paris. He tells me his view is different than yours.
Beppenyc, could it be because France did not control the number of immigrants and ended up bringing more pople than what they should and made assimilation harder there ? Some believe that the US is heading to a path similar than the France one. Just look at the US. This is a country known for its immigration tradition. Look at what is happening now. Americans - unfortunately - are starting to become bitter towards immigration. Why ? It is because as everything in life, you need to have a balance. If you start letting too many people in, people may feel immigration becomes an invasion. Like France, this is a democracy. When you have the majority of your citizens pissed off at illegal immigration or even rate of legal immigration, honestly I would listen to the people otherwise the relationship between newcomers and citizens may look a rough road ahead.
Just to give you an idea, today I have a lunch with folks from my church - some are here illegally - and they acknowledged that there are too many Latinos in Orlando and therefore they do not want to live there anymore. Just to give you an idea how serious the situation is. Even the illegal folks themselves admit that an unbalanced number of immigrants may not be advantageous.
The problem in French is different. They bring the immigrants from Africa and North Africa to work to build the subway, La Defense (ask yourfriends),Eurostar ect ect. French has a controll of the number of immigrants, is not so difficult. The problem is that they put the immigrants living in the ghetto (Banlieu) and to not give any hope of future. When all the big project were done, they forced to sent the immigrants home, but without success. If you are really interest to see what is the reality in France, get this movie made in 1997, LA HAINE.
Communique, the problem is different: Illegal immigratin is like poverty , you will never defeat it. The US economy have an enormous advantage with the Illegal immigration, in particulary in Agricolture, they were more competitive in the international market. If you have 12 million of illegals, means that you have at least 6 million of American Citizen who give job to this people, making a HUGE PROFIT. Let`s analyze the restaurant business, how is possible that is cheaper to eat in USA than europe? The reason because here they can use a lot of illegal in the kitchen or as waitress. What about the house building? What about it? About the legal, the difference is that of course we are playing with the rules, but the reality is that we are in the same condition: we are slave, we can not look for another job because of the sponsorship and 4 have this green card we will wait for ever.That`s give an enormous advantage to the company, butis not fair, because the company is really exploit us. You are talking about invasion, it`s funny, I have the same discussion with another american kid. If the American citizens are really angry about that, how is possible that they continue to hire illegal? . YOur economy is growing but US don`t have the capacity to answer to all the needs. Period. Your immigration law was wrong from the beginning, because did not undestand the really needs of the economy. The real challange is to make them integrated in the US society. With the new rule on FBI name checks, a potential 47K with current PDs could get their GS's soon. I wonder how much of a shift we will see in the PD's from now, after the 47K is not taken into account. I would predict a minimum of atleast a year jump, or am I being optimistic. :confused:
Some one pointed out in another thread, that the USCIS FAQ mentioned that only a 'subset' of the potential 47k cases have namecheck pending for more than 180 days. So may be not all of the 47k cases (even those with current PDs) may be eligible to qualify under 180 day FBI namecheck auto approval rule. Thus not all 47k cases will be approved by the mid March deadline that USCIS mentioned.

2000-2002 was worst. Who didnt do job search during that time have no idea how it felt like.
I just came out of school then and it felt like sky is falling on me. Becoming desparate to survive, i went to work in a gas station. The lady owner didnt pay me after i worked for a week saying i am not concentrating enough. Then out of no where i found a technology job that paid 17$ per hour to keep me going and they did my H1 a year later in 2002. It just made me more strong i guess. But, it is a hell of an experience. Most of my freinds went for second masters or PHD to Keep the status.
It was so hard to find a job those days. I was myself unemployed for so many months along with a lot of my friends and everyone of us was highly qualified and experienced. Since 2002 end onwards everyone of us has a good job without any breaks.
I hope we don't get to see the 2001 recession again and I am sure it won't be that bad this time.
It is the financial sector which is paying for its own mistakes. It might spill over to the other sectors of the economy but not to the degree it happened in 2001. Just my opinion.

What makes you think that everybody fakes theirs resumes? You are talking like its just a matter of fact that faking resume is the only way people get jobs (and what is this project business????). I now know that YOU got your job by faking your skills. And shame on you for doing that!
You conveniently missed out the 4th reason in your list
The employers filed for H-1Bs kowing very well they did not have a job to give to the candidate. The immigrants would come to the US, get "trained" to lie their way into a job, pratice more lying, fake reumes (like you have), then get into a project, get fired in 1 month or 2, go on bench, unpaind, find another project by practising more lying, and so on.
My friend, I take my statement back when I included you in the genuine candidate group. You are no better than the OP. You fakers deserve to end up in prison!
To answer your original question: not a single line on my resume is fake. And I'm not working on "projects". I have a full-time job and I'm with the same employer for the past 4 years!!!!!!!!!
Get out of your desi consultancy world for a change and see how the world outside of your little fakers club works. Not everybody is lying their way into "projects".

The reason the DESI body shop companies got raided and charged are because they
1. filed H1 from IOWA because they knew that the wait period was few weeks and then used those.
2. They used faked/forged documentation to do that, not one but probably hundreds of cases. You dont get charged with mail forgery etc for nothing
3. They used those H1's to employ the candidates in other areas which beats the LCA from IOWA since they got certified from IOWA DOL that jobs aspirants of that nature did not exist in that area for the salary they were getting paid..
You sound as if you want that guy to leave everything and go back to his home country because he has lost his job. I BET if you were in a similar situation you would do something like that and dont be pretentious about it and be a hypocrite. If it becomes untenable for the person to stay any longer here without the project he/she will leave anyway.
I have just pointed out a way to get a reprieve for few extra days and its not going to cause a 6 year backlog in your dates.. so chillout

I-140 PP is only available if you are within 60 days of your H-1 capout. So for most people who are porting PD from EB3 to EB2 , there is additional wait of six months to an year just for I-140.
Porting PD from EB3 to EB2 can easily take 1 year including new PERM application, I-140 and I-485 interfile.
What is interfile ? Is it changing the underlying I140 for the 485 application ?
Can we do that ?
