It seems that they are scared as if as soon as they would dial the lawmaker�s phone number, the cops standing outside their office will simple arrest them to deport before tonight. It is our responsibility to tell lawmakers about what is �unfair�. 100+435 men/women in DC want to listen, the only problem is we don't want to speak to them. I am not sure when the CIR will pass...its not on Nancy Pelosi aganda in forseeable future... and several people already mentioned that if it didnt pass by MAY07 then you are looking at Jan 09 to get immigration stuff to happen...
I think we need to work on an interm EB relief bill ...which is absolutely non contraversial and try to pass it....not worring about piggy backing the CIR...
Issues such as h1 increase or adding more numbers need not be in it...we can include things like EAD after I-140...spouse/childer not considered for EB quota...etc...
Unless we act desissively now...its going to be a long way to 2009..

Senate majority leader and the bill sponsors have said before that they would like senate to take up this issue in March and a final vote sometime in April. Now whether you can trust these guys for what they say or if the political situation in March will allow this to happen, no one really knows. To some extent, it's like visa bulletin prediction where we almost never get it right. Just do your own research and by March 30th, we'll all know if it was taken up or not. If not, we'll predict that it will be taken up by April .. and the saga will continue. After few hundred posts, you'll learn not to ask these kind of questions which no one has any answer for. :D

USCIS will get their millions and sit on the files and get more millions through renewals. By that time your employer would have sucked the last drop of blood or keep finding new employers who will port your 485.
This is just a temporaray relief to feel good.
If they wanted you would automatically get a PR once you complete 5 years of legal work in US
Guys dont get trapped. Since USCIS is exposed now and forced to accept 1 million application for AOS, these things are coming up. USCIS and DHS are the pets of US Govt. Govt wont let them down under any circumstances.
Now that USCIS and DHS realized the moster coming on their head down the line in the name of GC / EAD / AP and they have maintained the lie with dis-honesty all these years that they could not process 485s because of the lack of resource, they have fallen flat on US Congress to bail them out. Whatever solutions they have had in their disposal all these years they are taking them out and discussing with congress. If they wanted to be really helpful to the highly skilled immigrants, they should have done this long back. All these days they all were anti-immigrants and the ex-director of USCIS was a active member of anti-immigrant community.

Before Sep 2009 it was two minutes time to take LCA. Now it takes 1 week time to approve LCA. We never heard about Employer-Employee relationship before 2010.

To claim as dependents, IRS requires that you pass two tests(many more but specific to your case)
Substantial Presence requirement, 184 days and may include previous years stay.
Income Requirement, I dont know the actual 2006 limit for income but it has to be less than $5000-$6000
If you can pass both then you can file but you will require a Tax Id(ITIN) from IRS prior to doing that.
What can happen at the maximum is that you might get audited and if you use a professional tax agent then you can easily rebut these. Also the IRS's auto auditing rules are unlikely to audit individual returns if the windfall is less than a certain amount. I guess the amount would be around $2000~$3000, as the cost for attorneys,staff and other resources will not make this audit viable.
I claimed my sister at that time on F1 about 5 years back and was successful. Your parents should be no different. The lack of communication(systematic) between IRS and USCIS is boon for us in this case. If it were truly streamlined, USCIS would have never let the 184 days be accumulated in the first place.

Assuming that you are in the 30% fed tax return bracket that would amount to around, $1.5K ~$1.8K net return. What if you have to leave the job before 180 days, about after 150 days? When I say you have to that means there is no alternative. Employer-Employee issues. Quite a few folks here might be aware of it. But anyway, I read that USCIS will consider 180 days based on the I-485 'Received Date' and I-140 'Revoked date' will be the date USCIS act on the letter they receive from Employer requesting to revoke I-140 not the date employer will send letter to USCIS. I'm aware that there is no specific guidelines of which date USCIS will consider as 'Revoked date', but I heard USCIS mentioned verbally in many conference that they consider I-140 'Revoked date' as when USCIS act on the letter they receive from employer. Any thoughts?

Please help me. There is no LUD on my status online. I had my finger printing done on sept 19. CODE 3. For both my husband and me!! I don't see any updates on the status online. Can someone tell me what I should do? FBI says they sent the prints the same day!!!!

Just back from a useless infopass. IO flashed 'urgent' memo (dated 8/21) circulated by uscis/dos and said effective 8/21 there is a freeze on AOS EB2i/c so wait till oct. BTW my EAD is expiring on 9/23 and renewal filed on 5/27 according to her is outside processing time (apr08). She said case is at TSC and can only sent e-mail, which may take 3-4 weeks for any response. SO all-in-all-a-waste-of-time.
No explanation for why Aug processing dates not yet out.

1. Too much workload (cannot afford to take even 1 day off)
2. Cannot afford flying into DC, accomodation, etc.
3. I didn't attend the SJ rally, what will they say if I attend the DC rally;)
4. DC Rally is a waste of time, I do not support it
5. I don't have to have a green card, I can live without it, for the next 10 years!
6. I am happy to eat the fruit of someone else's hardwork, I don't want to put in any hardwork myself
