Ganguteli, why do you keep on questioning everybody's intentions all the time. the other day, I had posted about L1 exploiting the loop to file GC in EB1 and your answer was plainly stupid and irritating - "I would have done the same thing if I had a chance"....
There is nothing wrong in exposing any kind of visa fraud...I came here on F1 10 years back and still in line for GC after getting masters from a decent school and working with major employers. What is wrong in making sure that it is FIFO....

Just a couple of comments about Heathrow. The mainland of Britain was plagued with the IRA bombing it periodically for decades which forced them to be diligent about security long before the USA knew what terrorism was. Being security conscious has become a way of life on that little island in the North Sea. Just try finding a garbage can on a railway station platform? There are none so the IRA could not plant bombs in them.
Now about the staff at Heathrow. Surely anyone with eyes that work can see most of them are not British at all but immigrants of some variety or another. A true Brit is a very friendly individual. The invasion of their island during the past fifty years has changed the face of the entire community, not all for the better that is for certain.
And finally, transit visas etc. If they are needed and that is the rule and you cannot find a different route then it is something that has be lived with. The US had them and still has them for certain nationalities, the UK is certainly not on its own. I have been living in the US for almost a decade now and have been stung by their immigration rules as all of the contributors to this forum probably have but we chose to come here so have to put up with the system.
We all have choices so if you do not want to get transit visas just choose a route that precludes the need for one. Ten pages bad mouthing the UK is not helping anyone it is just antagonizing those of us who originated there.
Just because the majority of immigration voice are Indian it is certainly not all and I think that gets missed on so many occasions. We are in the midst of the US immigration system together, or so I thought.

Called one more time using the POJ method to NSC... This was probably the most fruitful call to NSC in the last 7-8 odd times i have called them.
Someone called Terry answered the call... Hats off to this lady...If there is a way i would want to recommend this lady for a promotion and make her the project manager for all the rest of the IOs who answer the call!!!
My case PD is 1/15/05, filed at TSC, transferred to NSC in Mar 08, applied AC 21 in Aug 08 and did biometrics in Feb 09.
Information i received on my case from this call:
1. This lady got my receipt#, checked details and history on my case, let me know that the case is preadjudicated (she defined preadjudication before that)
2. and then, told me that the case is NOT in storage area.
3. She mentioned that preadjudicated cases are held in an area called exams area and my case is currently on its way from exams area back to the officer who had preadjudicated my case earlier in Oct 2008.
4. She then checked my wife's file to see if that is also with my case just to make sure that file is not lost etc and confirmed that both files are together.
5. She also mentioned that nothing else needs to be done right now for my case as it is already on its way back to IO.

I agree. Lets not start using negative terms. People have been contributing in ways they see fit (providing info, answering questions and one-time or recurring donations).

Hi,
I'm in trouble situation, maybe somebody can give advice.
I can file I-485(Eb3 March 2005). But my wife & daugther basically out of status. Their H4 visas were not extended.
Before june bulletin I was thinking to go back home with my daughter (she is under 18) and try to get visa in consulate. It was attorney advice. Also he suggest to file for an asylym for my wife.
Now I'm going to file I-485 for whole family regardless what attorney will tell me.
Is it good idea to go directly to uscis office and ask them (can I file)?
And what will happen if their apps gets denied?
Any ideas?

Its a little hard to understand how the issue of 'work authorization' cannot be raised during interview or hiring process.
The details escapes me... at some point in the long past I was looking into what kind of questions employers should and shouldn't ask. If I come across anything again then I will surely post.
As far as EAD is concerned, the employers shouldn't discriminate. Especially if more than 90 days are left on it since that's the time-frame govt promises to issue a new EAD. The employer might feel better to work with a citizen or GC or a person of certain ethnic background or national origin. However, thats the kind of decisions the employer is not allowed to make. Employer has to accept EAD, everything else being equal. When the law is not followed and it harms us, we have to fight it back.
I realize employers sometime end up asking questions that they shouldn't like the obvious ones such as age and marital status.

Your salary is not your personal choice, it is governed by market factors. Company makes the final decision whether they want to pay you what you ask for and whether they need your services. Your client can easily send your job to India if they can hire someone here for 3 months. Most likely that person is going to be back with the job after 3 months.
3. If you screw up , who is responsible? What can you do to mitigate damage? TCS/WIPRO can replace the whole team at free of cost to make project successful. - BS
I work for a major system integrator and I have seen client come to us and say, X did not perform well, give us the money back or provide Y number of free consulting days. I have seen clients come to us and say , we give you 2 more months, deliver this project or else lawsuit, and I have seen company agreeing to client demands. These are additional advantages for going to TCS/WIPRO. I have seen at one client place, they offered 10% of the resources free. So if client took 50 peopkle, they got 5 more for free. Can your company do that? Dont make hollow claims of BS if you are just a simple developer.
4. YOU guys want to leave companies at will but the companies should not replace you at will? - Not at all, they can replace us anytime they want.. I don't know why this point ???
Here we are discussing about a violation by companies using L-1B visa resources and we think reporting this to the agencies (ICE/USCIS) and making awareness amoung clients doesn't harm anyone who does their business within the legal frame work.
No we are discussing YOUR jobs loss due to L1 misuse. You were sleeping until it hit you and now you suddenly want sympathy. BTW, I feel sorry for you that any guy from India can come and do your job. Most guys who come on L1 are freshers with not much skills. Thats what is needed for the job then.

Yes but on Monday morning it is NOT going to be current appantly. So, technically you did not send documents ( if you are getting it out on MONDAY) when they were current.
Just imagine, overnight bulletin was revised, what should we do? They did change it,if you know what I mean?
Guys this is a revision to the July Visa Bulletin. Meaning, even if the revision happens on July 29th to the July Visa Bulletin, it holds good for entire july.
This is not August bulletin.
Looks like people have misconception, that if their file goes to USCIS on July 2nd and visa bulletin is revised on July 3rd or later date, then they are safe. It is not so.
If at all if there is a change to the August bulletin it holds good for August and not to July bulletin.

Thanks L1fraud guy for bringing up the details to complain. I have contacted the local office and proceeding with the process as outlined by the ICE officer. I agree with you and other members on this thread who say this fraud has to be stopped before it becomes uncontrollable.

Remember: NumbersUSA faxed the senate offices one million times when CIR was being considered. We have to do more than them this time, as they are twisting the facts (Same way Mr. Dobbs of CNN does): Here is a quote from Numbers USA website:

India has less 500 cases in April 2001 yet its PD is Apr 15 2001
This along with CIS giving "bad/incorrect" data to IV is indication of someone's malicious intentions.
I appreciate IV's effort in getting FOIA executed and now working on aftermath of it.

We should support, as it puts end to consulting companies abuse.
I dont beleive this people are supporting this idea. This will put an end to H1B hiring by small tech startups.

I agree totally, this is a catch 22 situation for employment based immigration and agree that this will only divide more of us who are in different situations and are all waiting in line. I am not on L1 but to have introduce a bill that is protective in nature will only hurt immigration even more in the long run. Some of us may think this will eliminate lot more people from the line so that we who are working as permanent employees can get our green cards faster. Consulting companies are not just small companies, KPMG, Microsoft, Delliote, Oracle all of they offer some form of consulting to their clients. How will this law be implemented, what will happen to us who plan to change jobs after getting green cards and plan to consult if these companies don't exist. Every time a bill gets introduced, there is an intent but there is also the question of how it gets applied.
I think this will only hurt us as written from reading everything, this has all the language on discrimination against otherwise eligible workers, remember someday all of us who are permanent employees may be working as consultants, if you think today this is applied only to H1/L1, what will stop them from applying against EAD holders too? After all how many of us are on EAD, 300K? do you think that is a big enough group.
Stay together, stand together and read between the lines. Always fight for open legal immigration for employment, if you feel somebody is not qualified, so be it, its for the employer to make that call if he or she is qualified or not.
