4.1) you can support your spouse also even after using AP (i.e H4 support)
I doubt it. When a person uses his AP, his status changes to PAROLE, hence he can't have dependents on H4 status.

I tend to think a point system is better than what we have now. One thing though is that the points should be allocated "properly". For example, more points should be given to people with higher education, who earned a US degree, who have worked in the US for more years, who have paid more taxes, etc.
Someone mentioned a good point is about the visa number limits. If the per country limits are not eliminated, the points system won't solve the problem. Of course, they should also give more points to people who have passed Labor and I140 and allow them to adjust status right away. Otherwise, we will further get stuck in all the backlogs. Poor us. :(
I think if all the above issues are solved/cleared, probably a point system is good for us (i.e., EB based immigrants who are now stuck due to backlogs and retrogression). :p

Thanks for your suggestion! Buddy.
We will try to request a court interpreter.
I am sure the jury will say that you are not guilty if your wife supports your side of the story. Remember, the verdict should be unanimous. So go for jury trial and request a court interpreter to make sure there is no language barrier.

We need to heavily bomb our senators by letters and phone calls. Although most of people here are busy filing all the documents, please take a time to call/write THREE senators:
Sen Cornyn, John. Thank and encourage him keep up the issue
Two senators in your state. Thank and encourage one(s) who support us. Ask for explanations for senator(s) who said "Nay" also ask them why they vote yes for CIS, but now for this bill.
Again,
If a broken system is not able to process a million applicants with full of immigration documents, how can it manage 12 million applicants without any paperwork even passports?
If a broken system is not able to process a million applicants in the US with temporary visas, how can it manage millions of applicants all of worlds who meet merit point requirements?
So if the existing broken system is not be fixed, CIR wont be feasilbe unless the government decides to abandon all the necessary evaluate procedures.

I respect all the holidays and I would like to celebrate with you guys, but what is the meaning of Diwali?
Diwali (or Deepawali) literally means the festival of lights. Traditionally it has symbolized the arrival of Ram (a Hindu mythological figure often perceived as God) back to his kingdom after completing a 14 yr exile.
However other religions in India (notably Jainism and Sikhism) have different reasons for celebrating the same day.
Notwithstanding the different reasons it is commonly perceived as a festival of lights and of the victory of good over evil.
Hope it helps.
Regards.

Another important question is: Will USCIS allow AC21 without an approved EAD?
When you send all the relevant documents to invoke AC21, there is every possibility for the officer to check whether you have an approved EAD or not. In that case there might be a problem. I may not be correct. But to switch to a new employer, you definitely need a EAD card. I switched employers. My new employer asked for work permit(EAD in this case)
Note : Please check with your attorney, I'm just one like you and this is my experience

One unconfirmed report indicates that NSC alone received 8000 by Fedex alone on July 2, 2007. It appears that people should be prepared for the potential delays in receipt notices for post-July 2 receipt notices.

FBI Namecheck status (not good news) (pg. 37 of the report)
As of May 2007, USCIS reported a staggering 329,160 FBI name check cases pending, with approximately 64 percent (211,341) of those cases pending more than 90 days and approximately 32 percent (106,738) pending more than one year.40 While the percentages of long-pending cases compared to last year are similar, the absolute numbers have increased. There are now 93,358 more cases pending the name check than last year. Perhaps most disturbing, there are 31,144 FBI name check cases pending more than 33 months as compared to 21,570 last year over a 44 percent increase in the number of cases pending more than 33 months.4

AFAIK, AP is considered only for emergency travel. That said, I think the officer was being over reactive.
As we all know, immigration laws are arcane. AP for emergency travel was ok when people used to get GC within 6 months of 485 filing. Now, when it can take anywhere from 1 to 3 years to get GC after 485 filing, does it make sense to have AP for only emergency?! Crap...

first of all with that Matloff paper u proved a point that i was trying to make and that is the fraud cases are way more than 20%
and secondly Matloff is only one person in the anti immi committee (if u can call it that) that opinion is his and doesn't necessarily dictate the whole bandwagon of anti-immis , the brand equity hit takes place at the grass-root level
check out that punk aka itgrunt
these turds brand every indian immigrant as being fraudulent beacuse of the fraud that takes place , all these organizations , numberusa , washtech etc thrive only because of the large number of grass-root supporters who call in the senators and tip them over
Matloff making the fraud issue i statement is hypocritical because it doesnt fit in *his* larger scheme of things at which are very easliy balanced out between the pro and anti immigrants in the *larger* aspect of things
but the "brand euquity" distrubance that is so tangible makes it a public issue
you need to use your own common sense and think for yourself instead of just quoting/cut pasting random people all the time .

This is the third time an Indian American has won the competition in a row.
BTW, the huge number of Indian American partcipants is not due to the fact that " Indian Americans" are brilliant... These children (at least most) are partcipating not becasue they have talent but they are being forced to by the aspirations of their parents.
All the Indian American children are crying, sitting on the lap of their parents etc... See any other kid who lost, they were cool.
How do you support your statement? and how many Bee contestants have you met/talked to?
in studies you can not force someone, you can only help them stay focused, having lived in NJ for 6-7 years i have met dozens of india american teenagers, very rarely have i heard them going to so caled "teenage clubs" where they do all the kinds of nasty stuff. teaching kids how to stay away from things that would hurt them in the long run, and spending enough time with them is what most immigrant(not just indians) parents do.
15 years from now when you see more than 50% neurosurgens are of indian origin, please stand at times square with a banner "these neurosurgens are not brilliant but they were forced by their parents" :p

Tell me about it. My wife didn't have a fancy law degree but she had a decent job before we got married and she came to US. She doesn't have any specific skills that will qualify her H1b but she has a MBA. So there isn't much she can do in terms of furthering her education. So she's been stuck at home for the last 4 years.
I have been now for 7 years and still waiting... my wife who graudated law with top honors in a top university in india and was pracicing with a leading corporate law firm joined me in US and to make it good we spent around $65K on her law school graduation here and then another 15K on bar exams preparations for NY and CA. She managed to pull through all this. we decided to have a baby and take care of her wihtout day care the 1st 2years. now my wife sits home since she cannot file a H1 though there are willing employers becuase she has stayed here for 6 years on h4 and my llabor filed 2001 was still in BEC.... what can i do... i left a Director job in fortune 50 company and joined as consultant so that i can make use of a pre-approved labor, then another regression happend and i am still waiting to file 485. I just want to let my wife to work for a couple of year and make use of the effort she spent in her US law school and bar exams and want to return back to India.... but when can i get that 2 years.....

Sledge_hammer, sanju and hpandey appear to be the only voices of reason here. Anything bad happens to anyone in this country who happens to be an immigrant and here come the conspiracy theorists. Don't be so paranoid, people. The burglars in this country believe in equal opportunity victimization. They rob everybody equally regardless of race or color.
