It's good that indian american is heading the bailout which is by far the largest government intervention of free markets in the history.
It's bad that 6 family members were died. He should have filed bankruptcy and head back to india atleast. MBA in Finance would definitely will get him a good job. May god rest their soles in peace.

Everybody has troubles, See people in somalia and other places. They don't have anything to eat also. They are surviving for their livelihood. If there is a legitimate cause for a suicide then it's OK. And even he doesn't have right to kill other members in the family. Period.
And i don't see any suspicious activity that outsider killed them as that person is out of job from 6 months.

Dude,
Take your company attorney & HR guy(al) out for a $250 lunch and first build a rapport with them. Tell them about what you need & do tell them politely that if they care about you as an employee, they need to get on with your immigration process.
Nothing unethical, illegal or embarrassing about push your point forward.
There are ppl who will tell you that sth like this would never work. time ot prove me wrong!

Haha. That is an accurate assessment at a 50-foot level. I was pretty disillusioned after a couple of years of working. A mixture of what the fuck am I doing, but not really knowing what to do, and all confused because I was at probably the biggest firm around and and a feeling of even if I switch, what's the point? And not having the balls to switch jobs, for the fear of throwing away what I had, mixed with personal struggles with life and not having the social life that I wanted.
In between all this, the desire to get the GC process kicked off came and went, esp. since I wanted to switch positions to a more people oriented role, and the feeling of gosh, do I want to stay in 6+ years in this job - maybe if I file, then I won't want to change jobs.
As you can see, even I am not sure what was going on there. But my personal life and acclimatizing has sorted itself out rather well of late, and I do want to stay here now that I have a really interesting life (and partly out of fear of throwing everything away and moving somewhere new).
Now, I know that IV is not a self-help trauma group, so I will cut short my story here, which has little to do with the raw facts of my immigration situation :)
And yes, I did not participate or know much about the visa process, or IV till recently, and am a recent need based participant, but I hope that does not stop anyone from contributing their ideas to help me out.
*** Also, to the previous poster (nojoke) who said that big companies usually hold off on perms, are you suggesting that I have a better chance at a smaller company then?
UPDATE: My company attorney suggested talking about this in April, and I am nervous about waiting till then in limbo - things are only going bad to worse, I might as well find a job at a place which will sponsor a PERM sooner rather than later.
I request you to PM me if you have any leads for such companies might still be a good bet for filing a PERM.

In Kansas there is a strangely different rule. They give in-state but show the balance amount between in-state and out of state as scholarship given to the individual in a separate 1098 T tax form. This increases your taxes slightly and the individual cannot claim education credits in the tax return.

Well, you have not pissed me at all. I did what IV had asked in one month back. I had sent my 2 letters (me and my wife) 17 days back and collected another 12 letters from friends and send them too. I had contributed what ever IV had asked until now, what ever it may be.
I am sorry, but just a note can baffle you guys and you put all the -ve comments to the post, then sorry to say you guys cannot take any constructive opinion from others. And I think I did no wrong in asking Chanduv to stop posting innumerable threads just for one cause.

Same happened to us. The checks were cashed and we have even received the appointment notices for biometrics. My lawyer told me that there have been several cases lake this one. He is going to submit proof of the checks being cashed and copy of the notices to the USCIS.

Prediction is as good as the data available. From previous discussions (EB2-EB3 predictions) - it was predicted to see movement based on the data available - well, I am guessing the data was incorrect and therefore predictions can never be close to being correct.
Sincerely hope that the efforts of this community is to seek for data that is largely correct. I guess, may be IV can ask for the inclusion of advising USCIS to release the correct data frequently in the CIR draft.

Hi,
I got an email saying "we mailed the document to the applicant" and it says the same thing on my uscis protfolio.
I would like to know if this means the case was approved or is it some other document being sent.
When they approved my EAD, it clearly said "Approval notice sent".
When they approve a case then status clearly says 'Case Approved'.
The email "we mailed the document to the applicant" may be anything or nothing, like if they transfer ur case to different service centre, they send a notice. Some time they don't send anything even though the email contradicts it. Keep checking the status, they might update it later if the case has been approved.
Also, for AP keep bugging ur attorney to see if they got it. For EAD, make sure your mail box has your name clearly, otherwise they won't deliver it.

I married to a gal in 2007 during my visit to my home country but it did not work out b/w her and me due to some family reasons. (Not divorced just separated)
I came back to US in 2008 and applied for 485. My green card got approved and now my wife is in my home country and I am in US.
Now my wife and I have reconciled and I want to bring her to US.
Can I apply for her Green card and bring back to US ASAP w/o waiting for 5 years as I married before approval of my GC. I can get papers from my home country showing that I got married way before my GC approval.
I did not show at any stage in GC application that I was ever married. I thought the marriage is gone so why show it and now it could hurt me. I even dont remember if there was any question regarding marital status on 485 application.

For 3-9 years, it is a good news.
For 10 and 10+ years, this is already laws in place in terms Social Security benefits. Hope that this does not worsen. Presently, retirement and some other benefits are available to foreign nationals such as India, if 40 points are accumulated.
Let us say I accumulate 40 points and return to India for good. Do I still get Social Security in India if -
1. I am a US Citizen living in India?
2. If I am a GC holder living in India?
3. I am neither a US citizen nor a GC holder living in India?
Any helpful links are appreciated. I have tried to calculate benefits using Social Security benefits calculator, but if you key in residence outside USA and non-citizen, it does not work...

They won't be any better off here.Instead of being kicked out fair and square, they will be made to decay on H1 visas for 15-20 years. Talk of choosing a rock over a hard place. Besides, the British MPs seem to at least understand what skilled immigration means - here they will have the pleasure of being grouped with meat-packers and grape-pickers who matter-of-factly walked across the border.
I think its also a lesson for those tired of the US immigration system and considering moving to other countries - lets face it, immigrants are not exactly welcome anywhere. Either stick it out, or return to home country.

My I485 is pending, recently I have changed my address online. I also recieved confirmation letters for this address change.
After 2 weeks of address change, USCIS issued an RFE. I have not yet received it, but I just want to prepare for this.
What could be the reason for this RFE? Is it common?
People here have related change of address to RFE but I personally do not blv. it happens as I changed address 3 times and nuthing adverse happened.
Wait for the RFE. It could be something minor. Since you are eb1 they might need something related to your job/experience. Each RFE is different and no one can predict what it could be. I have seen that 80-90% RFE can be replied easily so dont worry. Post again when you have information on what USCIS is asking for and I am sure that somone out here will be able to help you out.

I think using AC21 does not imply that 485 will be denied. In a hypothetical situation lets assume it is denied we need to find why it is being denied? One can always switch to h1b (with previous employer - should be valid when AOS is denied) by going to home country and getting h1b stamp on passport but even before you have to do it you can appeal in court and you will be able to stay here.
I was discussing the same issue today with Ron Gotcher ( you can find it on his website as I have the same userid) and he said unless you are inadmissible or commit a fraud or have broken immigration law in past AOS is not denied. Just in case if you have done any of the above three things then your AOS can be denied and you can not even get any type of non immigrant visa.......... For using AC21 just make sure that:
140 is approved Your GC sponsor will not revoke 140Your GC job description and new EAD job description are same or similar (title does not matter) . ONet code for both the jobs match. If you ensure the above things then there is no issue using EAD for a job after 180 day of filing 485. Hope this helps and people who got scared does not gives me red dots for speaking aloud.

well..I have been waiting for my labor certifcation to get certfied for too long. just after Sep 11 I applied both for US GC and Canadian PR. My wife also applied for her GC. meanwhile her GC moved to regional when suddenly DOL thought it was time to regroup and there it went into BPC. In the meantime we got canadian PR some 2 years ago but we did not move thinking that we have jobs here.Then she got pregnant and lot of complications ( premature labor) and during those complications her company got acquired by another bigger firm who thought they don't need her..and result was job loss plus GC into the trash....meanwhile my labor certification even after 5 years was still sleeping in EB3 category(PD Oct, 2001) when i still have Masters( god knows why my lawyer put into that category)..Now my canadian PR was set to expire in march, 2007..so I thought i should decide fast..and i applied for jobs..and I got offer in vancouver with moving expenses paid from califronia..It has been the toughest decision because my employer is Indian here in california..and I have had good growth(10% average) but not the way I had wanted..I guess he also exploits..Indian exploiting another Indian..because they know I am not going anywhere..plus we work hard.. I asked him to match what was being offered in vancouver..and he started converting CAD into USD..well..it is not fair..So I have decided to heck with US and the Employer..and move on...at least I can come back..it is not an easy move because my son being premature child had lot of free facilities in california..hopefully he will get the same in Vancouver until he gets to 3 years ..and then it stops..

I wish things could work out for you in US. It is sad and there are thousands of people like you with badly affected personal lives due to the broken immigration system. A lot of my motivation to work for IV also comes from coming across people like you and thus feel strongly to do something to solve problems affecting each one of us in the IV community we have all built. You can contact your local Senator's office. They proved very helpful in my case. (I got my EAD within a week of contacting them)
One thing I noticed was that when I contacted them about my EAD renewal delay, they also followed up on my pending GC app. and sent me a letter saying that the date wasn't current. I guess in your case they might prod USCIS to process your GC quicker...
